Edison on City-Owned Property Described in Recorded Document
No. 96-0088341, and Making a Determination of Exemption Under
CEQA in Connection Therewith
BACKGROUND
The City of Moorpark is the record owner in fee of real property within portions of Lots
53 and 54 of the Resubdivision of the Colonia Virginia Tract, as per Map recorded in
Book 20, Pages 33 and 34 of Miscellaneous Records (20 MR 33 and 20 MR 34) in the
Office of the County Recorder. That said portions of Lots 53 and 54 are more
specifically described in a Director’s Deed from the State to the City as Recorded
Document No. 96-0088341, recorded on June 27, 1996 in the Office of the County
Recorder (Attachment 1).
On April 19, 2017, the City entered into a License Agreement for Use of City-Owned
Property for Access with the Bennett Partnership (Fence Factory). As part of the
Princeton Avenue Improvement Project, a new access location and driveway for the
Fence Factory site will be constructed within the City-owned property described in
Recorded Document No. 96-0088341. On February 16, 2022, the City Council
approved the Final Plans and Specifications (Specification No. MPK 21-03) for the
Princeton Avenue Improvement Project and awarded a construction contract to Security
Paving, Inc. (Security Paving). The approved Plans and Specifications include the
design of the new driveway and access location to the Fence Factory site at 14110
Princeton Avenue. The Notice to Proceed letter was issued on July 1, 2022, with an
effective start date on August 1, 2022. Construction of the improvements to Princeton
Avenue, including this new access location and driveway, has commenced and both
staff and Southern California Edison have determined that portions of their facility will
need to be relocated.

DISCUSSION
Utility relocation and coordination is a key component to ensuring continuity of services
to the public during construction activities and after project completion. Throughout
project design, pre-construction, and construction activities, staff has been in constant
coordination with all affected utilities, which include Southern California Edison, AT&T
California, Charter Communications, Crown Castle, and the Gas Company, for the
relocation of their facilities. The infrastructure improvements on Princeton Avenue, and
its associated construction sequencing and activities, require utility facilities to be
relocated, especially where there are unavoidable conflicts. During the course of
construction and in coordination with Security Paving and Southern California Edison, it
was determined that the new driveway and access location to Fence Factory and the
proposed retaining wall structure along the southside of Princeton Avenue will require
Southern California Edison to relocate their electrical supply system from overhead
poles to underground conduits. The timing of this relocation and design was not
determined until the rough grading of the Fence Factory driveway was complete. Now
that the Fence Factory driveway has been graded, Southern California Edison can
finalize the design to construct new conduits for the relocation of their facilities.
The relocation of Southern California Edison facilities will require new electrical conduits
and wires to be placed within (underground) the new, proposed driveway to the Fence
Factory site. As previously mentioned, the driveway is located within City-owned
property. Therefore, Southern California Edison is seeking an easement from the City
to construct, operate, and maintain their electrical supply and communications systems,
and appurtenant structures, on the City-owned property. Attachment 2 is the final
design for the placement of new conduits and vaults and the removal of existing power
poles. Southern California Edison has prepared a Grant of Easement for their electrical
supply and communications system for City Council’s consideration (Attachment 3,
Exhibit A). Staff recommends that City Council consider and grant an easement to
Southern California Edison for the relocation of their electrical supply and
communications systems on to the City-owned property.
ENVIRONMENTAL DETERMINATION
The Community Development Director has evaluated the Grant of Easement and the
construction, use, operation, and maintenance of an electrical supply and
communications systems within the City-owned property described in Recorded
Document No. 96-0088341 for compliance with the California Environmental Quality Act
(CEQA) and has determined that the proposed improvements are within Section 15301,
Class 1 (existing facilities of both investor and publicly-owned utilities used to provide
electric power) for Categorical Exemption. There is also no evidence of unusual
circumstances related to minor alterations or installation of an electrical supply system
that involves negligible or no expansion of an existing use that would give rise to
environmental impacts typical to these types of improvements. For these reasons, staff
recommends that the City Council concur with these findings and grant an easement to
Southern California Edison and that the electrical supply and communications systems
are exempt from CEQA.

COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive for the Fiscal Years 2021-2023
Goals and Objectives. However, the City Council has made the Princeton Avenue
Improvement Project a priority for many years.

Consider Approval of Certificate of Acceptance for
a Deed for the La Falda Avenue Access Road
BACKGROUND
1. Caltrans acquired a number of properties to provide the
right-of-way required to construct the freeway connector
project. The right-of-way acquired immediately south of
Los Angeles Avenue east of High Street, severed an
existing "paper street" (deeded but not travelled)
parallel to and immediately south of Los Angeles Avenue,
called La Falda Avenue. That portion of La Falda Avenue
located west of the freeway was left with no connection to
Los Angeles Avenue or any other street in the area.
2. On September 6, 1995, the City Council approved an
Agreement with Caltrans providing for the deeding to the
City of an Easement for a new access road to connect this
severed street to Los Angeles Avenue. The location of the
subject street is shown on the map attached as Exhibit 1.
DISCUSSION
A. Agreement
The Agreement approved on September 6, 1995, has been
signed by the City and forwarded to Caltrans for
execution.
B. In-Lieu Payment
In accordance with the terms of the Agreement, Caltrans is
processing a check to the City in the amount of $97,500 to
fund a future City project for the grading of a non-paved
roadway to actually re-establish this access.

c. Deed
A copy of the Deed for the access road is attached as
Exhibit 2. The original will be signed by Caltrans and
then taken by Cal trans to the County of Ventura for
recordation, along with the subject certificate of
Acceptance.
D. Certificate of Acceptance
A Certificate of Acceptance (Exhibit 3) has been prepared
for the above described Deed.
RECQMMEHDED ACTION
Staff recommends that the City Council approve the
Certificate of Acceptance for the Deed to the subject
property and direct the City Clerk to execute same and
forward said document to Caltrans for recordation with the
Deed.

NOTICE IS HEREBY given by the City of Moorpark in the County
of Ventura, state of California, as follows:
1. That on the 4th day of October, 1995, the Grant Deed from
the State of California was accepted by the City Council
of the City of Moorpark.
2. That the name of the political subdivision accepting said
Grant Deed is the City of Moorpark, in the County of
Ventura, State of California, whose address is 799

3. That the City Clerk of the City of Moorpark is authorized

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING A GRANT OF
EASEMENT TO SOUTHERN CALIFORNIA EDISON TO
CONSTRUCT, USE, OPERATE AND MAINTAIN AN
UNDERGROUND ELECTRICAL SUPPLY AND
COMMUNICATION SYSTEMS AT A CITY-OWNED
PROPERTY DESCRIBED IN RECORDED DOCUMENT NO.
96-0088341, AND MAKING A DETERMINATION OF
EXEMPTION UNDER CEQA IN CONNECTION THEREWITH
WHEREAS, the City of Moorpark (City) is the record owner in fee of real property
within portions of Lots 53 and 54 of the Resubdivision of the Colonia Virginia Tract, as
per Map recorded in Book 20, Pages 33 and 34 of Miscellaneous Records (20 MR 33 and
20 MR 34) in the Office of the County Recorder; and
WHEREAS, that said portions of Lots 53 and 54 are more specifically described in
a Director’s Deed from the State to the City as Recorded Document No. 96-0088341,
recorded on June 27, 1996 in the Office of the County Recorder; and
WHEREAS, Southern California Edison owns, operates, and maintains facilities
for transmitting and distributing electricity for any and all purposes within the City,
including along Princeton Avenue and the City-owned property described in Recorded
Document No. 96-0088341; and
WHEREAS, the City is constructing the Princeton Avenue Improvement Project
(Specification No. MPK 21-03) and requires Southern California Edison facilities along
Princeton Avenue to be relocated underground within City-owned property described in
Recorded Document No. 96-0088341; and
WHEREAS, in order for Southern California Edison to construct, relocate, use,
operate and maintain the electrical and communications supply systems, a 6-foot wide
easement under City-owned property is needed; and
WHEREAS, City is willing to grant the easement to Southern California Edison for
the purposes to construct, relocate, use, operate and maintain the electrical and
communications supply systems; and
WHEREAS, City Staff has determined that the construction, relocation, use,
operation and maintenance of the electrical supply and communications systems on the
City-owned property is exempt from the California Environmental Quality Act (CEQA)
because it is within the scope of Section 15301, Class 1 (existing facilities of both investor
and publicly-owned utilities used to provide electric power) for Categorical Exemption and
there is no evidence of unusual circumstances that apply to this project.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs
with the Community Development Director’s determination that the construction,
relocation, use, operation and maintenance of the electrical and communications supply
systems on the City-owned property is exempt from the California Environmental Quality
Act (CEQA) because it is within the scope of Section 15301, Class 1 (existing facilities of
both investor and publicly-owned utilities used to provide electric power) and there are no
unusual circumstances applicable to the project.
SECTION 2. Based on the findings contained herein, the City Council approves
the Grant of Easement to Southern California Edison at the City-owned property
described in Recorded Document No. 96-0088341 for construction, relocation, use,
operation and maintenance of the electrical and communications supply systems,
attached hereto as Exhibit A, and authorizes the Mayor to sign the Grant of Easement.
SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall
cause a certified resolution to be filed in the book of original resolutions.
