Staff Recommendation: 1) Authorize the City Clerk to file the Notice of Completion; and 2) Authorize release of the Performance Bond and Payment Bond (Number 4451149) as outlined in the agenda report. MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jessica Sandifer, Community Services Manager DATE: 12/21/2022 Regular Meeting SUBJECT: Consider Authorizing Recordation of the Notice of Completion for Arroyo Vista Recreation Center (AVRC) Gas Line and Heating, Ventilation and Cooling (HVAC) Replacement Project and Release of Bonds in Accordance with the Contract BACKGROUND & DISCUSSION On November 3, 2021, the City Council awarded the Arroyo Vista Recreation Center (AVRC) Gas Line and Heating, Ventilation and Cooling (HVAC) Replacement project to Bon Air Incorporated (Bon Air) for a contract value of $342,000, plus a contingency in the amount of $51,300. There were two change orders issued for the project which resulted in a credit of $1.67. The Change Order costs were approved by the City Manager, within the Council approved project contingency. The final contract cost is $341,998.30. The Change Order individual costs are itemized below: Change Order No.Description Cost/(Credit) 1 credits - change to adapter curbs, reuse of existing feeders and conduits for AC / add costs: replace plywood, extra ductwork in kitchen $ (5,229.60) 2 change diffuser sizes, patch and repair openings $ 5,227.93 TOTAL (1.67)$ Staff is recommending that the City Council authorize the recordation of the Notice of Completion. With the City Council’s authorization to record the Notice of Completion, the project bonds will be released as follows: • Performance Bond No. 4451149 shall be null and void one (1) year after the recordation of the Notice of Completion; and Item: 10.H. 199 Honorable City Council 12/21/2022 Regular Meeting Page 2 • Payment Bond No. 4451149 shall be null and void upon expiration of the time within which the California Labor Commissioner may serve a civil wage and penalty assessment against the principal, any of its subcontractors, or both the principal and its subcontractors pursuant to Labor Code Section 1741, and upon expiration of the time within which a joint labor management committee may commence an action against the principal, any of its subcontractors, or both the principal and its subcontractors pursuant to Labor Code Section 1771.2, if the condition of this Bond be fully performed, then this obligation shall become null and void. FISCAL IMPACT There is no fiscal impact with the release of performance and payment bonds. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION 1. Authorize the City Clerk to file the Notice of Completion; and 2. Authorize release of the Performance Bond and Payment Bond (Number 4451149) as outlined in the agenda report.
