MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ky Spangler, City Clerk DATE: 12/21/2022 Regular Meeting SUBJECT: Consider Resolution Ratifying a Clerical Correction to City Council Resolution No. 2022-4148 Certifying the Results of the General Municipal Election Held on November 8, 2022 BACKGROUND On December 7, 2022, the City Clerk’s Office received the Certificate of the County Clerk certifying the canvass of votes for the November 8, 2022, General Municipal Election. The details regarding the total ballots cast and total votes cast was incorporated into a supplemental resolution for City Council consideration and adoption at its December 7 meeting, and the County Clerk-Recorder, Registrar of Voters (County Clerk) Certificate and required Statement of Votes was included as an attachment to the resolution. Resolution No. 2022-4148 was adopted by a unanimous vote of the City Council. DISCUSSION On December 8, 2022, the City Clerk’s Office was notified by the County of Ventura Elections Division of a clerical error on the County Clerk’s Certificate related to the number of ballots cast in each of the City’s three races; however, there was no change to the number of votes cast for each candidate. Although the error made by the County Clerk is clerical in nature and a corrected Certificate could be attached to the adopted resolution, because Section 2 of Resolution No. 2022-4148 expressly includes the whole number of ballots cast in person and voted by mail, it is prudent to ratify a resolution correcting the language and attaching the corrected County Clerk’s Certificate for recordkeeping purposes. Staff has prepared a resolution for Council adoption ratifying the corrected ballot count and attaching the corrected County Clerk Certificate and the supporting, unchanged Statement of Votes. 202 Honorable City Council 12/21/2022 Regular Meeting Page 2 FISCAL IMPACT None. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) Adopt Resolution No. 2022-____ ratifying a clerical correction to City Council Resolution No. 2022-4148. 203 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RATIFYING A CLERICAL CORRECTION TO RESOLUTION NO. 2022-4148 RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, AND DECLARING THE ELECTION RESULTS AND SUCH OTHER MATTERS AS REQUIRED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Moorpark, California, on Tuesday, November 8, 2022, as required by law; and WHEREAS, notice of the election was duly and regularly given in time, form and manner as provided by law, voting precincts were properly established, election officers were appointed, and in all respects, the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the Elections Code of the State of California for holding of elections in cities; and WHEREAS, pursuant to City Council Resolution No. 2022-4109, adopted June 15, 2022, the County Clerk of Ventura canvassed the returns of the General Municipal Election held for the purpose of electing a Mayor for the full term of two years and electing two (2) Members of the City Council, by district, for full terms of four years; and on December 7, 2022, the County Clerk certified the results of the election to this City Council and the results were received, attached and made a part of Resolution No. 2022-4148 attached as Exhibit A; and WHEREAS, following the provision of the Certificate of the County Clerk to the City Clerk, the Ventura County Elections Division identified a clerical error in the number of ballots cast in each of the City of Moorpark’s three races; however, indicating no change to the number of votes cast for each candidate in each respective race; and WHEREAS the County Clerk has issued a clerically corrected Certificate dated December 8, 2022, reciting the true and correct Canvass of the Votes Cast, including the total number of ballots cast and total number of vote cast in the November 8, 2022, General Municipal Election, attached and made a part hereof in Exhibit A; and WHEREAS, pursuant to Section 10262 of the State Elections Code, the City Clerk’s certification of the election results is attached and made a part hereof in Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the name of the person voted for at the General Municipal Election for Mayor for the full term of two years are in ballot order as follows: Chris R. Enegren ATTACHMENT 204 Resolution No. 2022-____ Page 2 That the names of persons voted for at the General Municipal Election for two Members of the City Council for the full term of four years are in ballot order as follows: Council District 1 Renee Delgado Michael Navarro Roseann Mikos Council District 3 Tom Means SECTION 2. The whole number of in-person votes cast in the Mayoral election was 1,908 1,643 and the whole number of vote by mail ballots cast was 15,003 12,462, making a total of 16,911 14,105 ballots cast in the Mayoral election. The whole number of in-person votes cast in the Council District 1 election was 421 380 and the whole number of vote by mail ballots cast was 3,427 3,146, making a total of 3,848 3,526 ballots cast in the Council District 1 election The whole number of in-person votes cast in the Council District 3 election was 613 495 and the whole number of vote by mail ballots cast was 5,069 4,129, making a total of 5,682 4,624 ballots cast in the Council District 3 election. The total ballots cast at the Moorpark General Municipal Election and totals votes for the Mayor and for each District are as follows: Position/ District Number Total Votes Cast Total Ballots Cast Mayor 11,299 14,105 District 1 3,204 3,526 District 3 3,566 4,624 That the number of votes given in the City to each such person named for the office for which the persons were candidates is as listed in Exhibit A, attached. The City Council does declare and determine that: Chris R. Enegren was elected as Mayor of the City Council of the City of Moorpark for a full two-year term; and Renee Delgado (District 1) and Tom Means (District 3) were elected as Members of the City Council, each for a full four-year term. 205 Resolution No. 2022-____ Page 3 SECTION 3.
