All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:31 p.m. 2. PLEDGE OF ALLEGIANCE: City Attorney Kevin Ennis led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Castro, Enegren, Groff, Pollock, and Mayor Parvin. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported on the election which occurred on November 8 and extended congratulations to Supervisor-elect Parvin, the first Ventura County Board of Supervisor's member from the City of Moorpark, and also extended congratulations to Mayor-elect Enegren and to Councilmember-elect Means who was present in the audience. He further commented that Nathan Sweet and Rob Perez were re-elected to the Moorpark Unified School District Board, and the results for City Council District 1 are still too close to call, noting an updated vote result will be released Thursday at 2:00 p.m. Councilmember Pollock stated on November 14 he attended the CalCities Legislative Update and provided a report on three bills. Senate Bill (SB) 1439 extends the campaign contribution limit of $250 that previously applied only to appointed officials to now include local elected officials. SB 1439 requires local elected officials that received a campaign contribution of $250 or more to abstain from voting on entitlements for that contributor for 12 months following receipt of the contribution, and if you voted on an entitlement, you must refrain from receiving contributions of $250 or more from the entitlement applicant for the next 12 months. If multiple Councilmembers received more than $250 in contributions from the same contributor, it could present a problem. He commented if the City had a $250 campaign contribution limit, this would avoid the issue for the Council. He further reported on SB 960 that allows anyone authorized to work in the United State to be a Police Officer, and this could be in conflict with federal laws regarding the ability to carry firearms. Lastly, AB 1406 would require California law enforcement officers to carry Tasers on the opposite side of where they carry their firearm. Councilmember Pollock reported on November 16 he attended a Southern California Association of Governments (SCAG) Regional Council Advanced Mitigation Plan Committee meeting; the Plan is focused on getting ahead of environmental mitigations before a project is proposed and provided an example encountered during the consideration the Carlsberg Specific Plan. The Committee voted today to send the plan forward to the SCAG Regional Council. Councilmember Pollock reported on a Southern California Edison red flag fire warning that could result in a Public Safety Power Shutoff for the Anton and Zone circuits that serve the City of Moorpark in the north and west. Mayor-elect Enegren reported on November 4 he attended a Ventura County Transportation Commission meeting. Mayor-elect Enegren reported on November 11 he attended the Veterans Day Memorial ceremony. Councilmember Groff reported on November 9 he attended the Moorpark Chamber of Commerce Board of Directors meeting. Councilmember Groff reported on November 11 he assisted the Rotary Club of Moorpark Morning putting up flags around the community for Veterans Day, and later attended the Veterans Day Memorial ceremony. Councilmember Groff reported on November 15 he attended a ribbon cutting at Mathnasium. Mayor Parvin made the following City announcements: Visit the Moorpark City Library on Saturday, November 19, at 1:00 PM for a presentation and reading with local author Monika Savic. Savic has lived in Moorpark since 1990 and has taught English for nearly thirty years at Moorpark College. She is the daughter of Dutch immigrants, and her novel, The Nightingale Sings Alone, is loosely based on her family's experience during the Nazi occupation of the Netherlands. Put on your quads or blades and join us for a night of skating, music, contests, and fun at Thanksgiving Skate Night. The skate night will be held on Saturday, November 19 from 5:00 to 8:00 p.m. at the Arroyo Vista Community Park multiuse court. Admission is FREE. For more information visit moorparkca.gov/skate. Mayor Parvin reported on November 4 she participated in a Ventura County Farmworker Housing discussion for the unincorporated areas the County. Minutes of the City Council/Successor Agency Moorpark, California Page 4 November 16, 2022 Mayor Parvin reported on November 5 she joined the Moorpark Hindu association in their delivery of goods to the Moorpark Food Pantry. Mayor Parvin reported on November 8 she attended a Moorpark Chamber of Commerce Economic Development meeting. Mayor Parvin reported on November 10 she attended the Ronald Reagan Presidential Library event where a Nazi era train car was delivered for a future exhibit in 2023. Mayor Parvin reported on November 10 she attended a Ventura Council of Governments (VCOG) meeting where broadband "last mile" was discussed. Mayor Parvin reported on November 11 she attended the Veterans Day Memorial ceremony. Mayor Parvin reported on November 16 she participated in a Local Agency Formation Commission (LAFCo) meeting. 8. PUBLIC HEARINGS: None. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Economic Development Division Update. Staff Recommendation: Receive and file the report. Mr. Bandek gave the staff report and PowerPoint presentation. There were no speakers. In response to Mayor-elect Enegren, Mr. Bandek confirmed currently available space for lease is viewable via the Economic Development website linked to LoopNet and noted they are looking into reorganizing the site to make it visible by business district. Mr. Bandek also clarified social media posting practices of staff. CONSENSUS: It was the consensus of the City Council to receive and file the report. 10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED) MOTION: Mayor Parvin moved, and Councilmember Pollock seconded a motion to approve the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2022/23 - November 16, 2022. Staff Recommendation: Approve the warrant register. Consider Resolution Adopting the Salary Plan for Hourly Employees and Rescinding Resolution No. 2022-4082 to Increase the Minimum Wage. Staff Recommendation: Adopt Resolution No. 2022-4144, amending the Salary Plan for Hourly Employees and rescinding Resolution No. 2022- 4082. (ROLL CALL VOTE REQUIRED) E. Consider Resolution Ratifying Chapter 5 Section 507, Chapter 9 Section 903, and Appendix B of Ventura County Fire Protection District Ordinance No. 32, Pertaining to Building Standards for Application within the Jurisdictional Boundaries of the City of Moorpark, and Rescinding Resolution No. 2019-3856; and Making a Determination of Exemption Under CEQA in Connection Therewith. Staff Recommendation: Adopt Resolution No. 2022-4145, ratifying Chapter 5 Section 507, Chapter 9 Section 903, and Appendix B of Ventura County Fire Protection District Ordinance No. 32, pertaining to building standards for application within the jurisdictional boundaries of the City of Moorpark and rescinding Resolution No. 2019-3856, and making a determination of exemption under CEQA in connection therewith.(ROLL CALL VOTE REQUIRED) F. Consider Resolution Authorizing Submittal of Building Forward Library Infrastructure Grant Application and Other Grant Related Actions. Staff Recommendation: Adopt Resolution No. 2022-4146 authorizing submittal of the Building Forward Library Infrastructure Grant and authorize the City Manager to sign all grant related paperwork. (ROLL CALL VOTE REQUIRED) G. Consider a Cooperative Agreement with the California Department of Public Health Regarding Application of Pesticides for Public Health Purposes. Staff Recommendation: Approve the 2023 Cooperative Agreement and authorize the Mayor to execute the Agreement on behalf of the City. H. Consider a Professional Services Agreement with Earth Systems Pacific to Provide Professional Geotechnical Construction Testing and Observation Services for the Construction of the Princeton Avenue Improvement Project. Staff Recommendation: Approve Professional Services Agreement for Geotechnical Construction Testing and Observation Services for the Princeton Avenue Improvement Project (C0020) to Earth Systems Pacific and authorize the City Manager to execute the Agreement in the amount of $77,000.00, subject to final language approval of the City Manager.
