HomeMy WebLinkAboutRES CC 2023 4157 2023 0201 RESOLUTION NO. 2023-4157 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING AND ESTABLISHING USER AND REGULATORY FEES AND SERVICE CHARGES WHEREAS, user and regulatory fees are established by the City Council; and WHEREAS, the City recently completed a first-of-its-kind study to identify the cost of providing various user and regulatory fee-related services; and WHEREAS, the study examined fee-related services provided by the City, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, the City Council finds that providing these services is of special benefit to applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from applicants who have sought or require the City's services by revising its schedule of fees; and WHEREAS, the City Council hereby finds that the study provides adequate evidence to conclude that the revised fees do not exceed the cost to provide the services for which the fees are charged; and WHEREAS, no Development Impact Fees (identified in Exhibit A) are changed as part of this action; and WHEREAS, City Council Resolution Nos. 2002-2004, 2008-2670, 2009-2836, 2010-2971, 2017-3608, 2018-3752, 2019-3854, 2020-3907, 2020-3955, and 2020-3957, are hereby rescinded upon the effective date described in Section 2 of this Resolution; and WHEREAS, the City Council adopted Resolution No. 2021-3998 on March 17, 2021, Adopting Revised Facility Rental Fees, Deposits, and Additional Charges; and WHEREAS, the fees, deposits, and charge amounts included in this schedule supersede those rates adopted via Resolution No. 2021-3998; and WHEREAS, City Council Resolution No. 2021-3998 is hereby rescinded upon the effective date described in Section 2 of this Resolution; and WHEREAS, from time to time, the City Council adjusts staff billing rates for charging against deposit-based fees for the review and processing of certain permit applications and for staff time incurred in the furtherance of public works projects listed on the City's Capital Improvements Program (CIP); and Resolution No. 2023-4157 Page 2 WHEREAS, the schedule of staff billing rates have been incorporated into the attached Exhibit A in order to develop a more consolidated schedule of user and regulatory fees and service charges; and WHEREAS, the staff billing rates included in this schedule supersede those rates adopted via Resolution No. 2021-4036; and WHEREAS, City Council Resolution No. 2021-4036 is hereby rescinded upon the effective date described in Section 2 of this Resolution; and WHEREAS, the City Council desires that annually the City Manager may update the fees and charges based on the annual percentage change in the all-urban Consumer Price Index for Los Angeles-Long Beach-Anaheim, CA (CPI). If the CPI does not change or goes down in a given year, no change shall be made to the fee schedule that year; and WHEREAS, in adopting this Resolution, the City Council is taking action only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Schedule of Fees and Service Charges, attached hereto as Exhibit A, is hereby approved. SECTION 2. The new or adjusted fees adopted by this Resolution shall go into effect July 1, 2023. SECTION 3. Nothing in this resolution shall supersede any adjustments to fees or service charges approved by the Director of Disaster Services pursuant to Moorpark Municipal Code Section 2.48.060(C)(1). SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Group Classification Definitions GROUP 1: Governmental agencies directly serving City residents when the Rental use is of direct benefit to City residents,and Moorpark nonprofit organizations with current tax exempt status under Section 501(c)(3),501(c)(4),501(c)(6),501(c)(19)of the U.S.Revenue Code chartered within the limits of the City of Moorpark or with an official branch or chapter located within the City of Moorpark.Rentals by Moorpark nonprofit organizations must meet all of the following criteria in order to be categorized under Group 1: - The Rental is intended for,and open to,the general public. - No admission or entry fee is charged to attend the Rental. - The Rental spans no more than three(3)consecutive days,and is held no more than once per year. - Rental attendance is less than 2,000 people. GROUP 2: City residents and businesses for noncommercial purposes(no entrance fees or sales),certain nonprofit organizations based in the City of Moorpark,and governmental agencies serving the residents of the City of Moorpark,when the rental does not comply with the requirements of Group 1. - The designation of City of Moorpark resident applies to individuals who live within the incorporated Moorpark City boundary. Resolution No. 2023-4157 Page 32 City of Moorpark FACILITY RENTAL FEES Payment Schedule Payment Schedule For Reservation Applications submitted more than thirty(30)calendar days in advance of the first rental date requested,and with rental fees exceeding $500.00,the Renter may submit partial payment of not less than$200.00,which will be applied toward the rental fees.Payment of all rental fees is due in full thirty(30)calendar days prior to the first rental date on the Rental Permit. For Reservation Applications submitted thirty(30)calendar days or less before the first rental date requested,full payment must be made at the time the Reservation Application is submitted.
