MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 02/01/2023 Regular Meeting SUBJECT: Consider Reduction of Surety Bond – Street, Storm Drain & Erosion Control Improvements (Bond No. 0778574) and Surety Bond – Grading (Bond No. 0778575) at 13960 Peach Hill Road (Oakmont of Moorpark, LLC) BACKGROUND On August 1, 2018, the City Council adopted Resolution No. 2018-3727, approving Commercial Planned Development No. 2018-01 for a 77-unit assisted living and memory care community at 13960 Peach Hill Road (Oakmont of Moorpark). On August 13, 2020, staff issued Grading Permit No. 273G for grading and site improvements associated with the development of the Oakmont of Moorpark at 13960 Peach Hill Road. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 19-ML-11087, are completed in accordance to the approved plans and specifications. DISCUSSION The grading and site improvements associated with the development of Oakmont of Moorpark are constructed and were accepted by City staff on December 13, 2022. The warranty period of the improvements ends one-year after the date of acceptance. As part of City acceptance, staff recommends that the surety bonds be reduced to ten percent (10%) during the one-year warranty period as follows: Surety Type Bond Number Original Bond Amount Prior Authorization Action Authorized Action as of 2/1/2023 Surety Bond – Street, Storm Drain & Erosion Control Improvements 0778574 $388,717.24 None Reduction to $38,871.72 Surety Bond – Grading 0778575 $153,916.40 None Reduction to $15,391.64 Item: 10.F. 226 Honorable City Council 02/01/2023 Regular Meeting Page 2 After the one-year warranty period is complete, staff will return to City Council to recommend exonerating the two surety bonds. ENVIRONMENTAL DETERMINATION The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378. The reduction of bonds requested in this action meets the above criteria and is not subject to CEQA. No additional environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
