MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ky Spangler, City Clerk DATE: 03/01/2023 Regular Meeting SUBJECT: Consider Waiving City Council Policy Regarding Commissioner Recruitment and Consider Appointment to Fill an Unscheduled Vacancy on the Moorpark Arts Commission SUMMARY Following appointments made on January 18, 2023, the Moorpark Arts Commission experienced an unscheduled vacancy immediately following the recruitment period that concluded in December 2022. In that recruitment for the Commission was recently concluded with six applicants for the five available positions, it is requested that the City Council waive Policy 2.2.4 which requires a recruitment be conducted, receive a presentation from the remaining applicant, and consider appointment to fill the unscheduled vacancy. BACKGROUND Every two years the City Council makes appointments to the City’s Arts, Parks and Recreation, and Planning Commissions pursuant to the provisions of the Moorpark Municipal Code (MMC), Title 2 (Administration and Personnel) and the current City Council Policies Resolution. Policy 2.2 states Commission applicants are required to attend a regular or special City Council meeting, as scheduled by the City Clerk, to make a brief presentation on qualifications and interest in the appointment with failure to attend resulting in disqualification for appointment. Commission recruitment took place from October 24 to December 5, 2022, with applicant consideration agendized for the December 21, 2022, and January 18, 2023, City Council meetings. Three Arts Commission members were appointed in December with the remaining two positions appointed on January 18, 2023. On February 1, 2023, one of the appointees tendered a resignation, creating an unscheduled vacancy. An unscheduled vacancy notice was posted on February 6, however, pursuant to Government Code Section 54974, 10 working days must pass prior to an appointment being made by the City Council. The February 15, 2023, Council meeting did not provide sufficient time for the 10 working days to elapse and therefore appointment to the Arts Commission to fill the vacancy was scheduled for consideration on March 1. Item: 9.A. 1 Honorable City Council 03/01/2023 Regular Meeting Page 2 DISCUSSION The City Council’s Policy 2.2.4 states that a recruitment will be initiated if an unscheduled vacancy occurs with more than six months remaining in a term of office. The City Council may exercise its discretion via a motion waiving the policy requiring a recruitment be conducted and choose to consider remaining applicants. In that a recruitment was concluded less than three months ago, and six applications were received for the five positions, City staff recommends the Council move to waive the Policy, receive a presentation from the remaining applicant, Charles Blaugrund, and then consider appointment to the Arts Commission. It should be noted that Mr. Blaugrund has previously served on the Arts Commission from 2011 to 2022. Following the presentation, the procedure for nominations and appointments are as follows: A.The Mayor shall solicit suggested nominees from members of the Council. B.Prior to making a motion for appointment, the Mayor shall announce the names of all persons he/she intends to nominate, and in the order to be nominated, for a board, commission, or committee. C.The Mayor shall then make a motion putting forth each individual name to be approved for appointment. D.A second shall be required. E.The Council shall vote on each appointment individually. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
