All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Enegren called the meeting to order at 6:30 p.m. 2. PLEDGE OF ALLEGIANCE: City Clerk Ky Spangler led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Castro, Delgado, Groff, Means, and Mayor Enegren. Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney; PJ Gagajena, Assistant City Manager and Interim Finance Director/City Treasurer; Brian Chong, Assistant to the City Manager; Jeremy Laurentowski, Parks and Recreation Director; Daniel Kim, City Engineer/Public Works Director; Carlene Saxton, Community Development Director; Stephanie Anderson, Recreation Services Manager; Chris Ball, Senior Management Analyst; Sujin Beck, Public Works Manager; David Sanchez, Parks & Facilities Supervisor; Captain Darin Hendren, Ventura County Sheriffs Office; and Ky Spangler, City Clerk. 4. PROCLAMATIONS AND COMMENDATIONS: A. Proclamation Declaring February as Black History Month. Mayor Enegren presented a Proclamation to Ebba Tefera with the Moorpark College Black Student Union recognizing February as Black History Month. B. Certificate of Recognition to Ky Spangler, City Clerk in the City Manager's Office for Receiving the City's Apricot Award, Winter 2022. Mayor Enegren presented a Certificated of Recognition to Ky Spangler, City Clerk in the City Manager's Office, as the Apricot Award Recipient for Winter 2022. Introduction of New Employee David Sanchez, Parks & Facilities Supervisor in the Parks, Recreation & Community Services Department. Mayor Enegren introduced new City employee, David Sanchez, Parks & Facilities Supervisor, in the Parks, Recreation and Community Services Department. D. Introduction of New Employee Sujin Beck, Public Works Manager in the Public Works Department. Mayor Enegren introduced new City employee, Sujin Beck, Public Works Manager, in the Public Works Department. 5. PUBLIC COMMENT: Charles Blaugrund, Moorpark resident, spoke to thank the Council for providing him a second opportunity make a presentation to be considered for reappointment to the Arts Commission. 6. REORDERING OF, AND ADDITIONS TO, THE AGENDA: CONSENSUS: It was the consensus of the City Council to adjourn the meeting in memory of Michael Sokenu, son of Moorpark College President Dr. Julius Sokenu, at the request of Mayor Enegren. 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Delgado reported on January 19 she attended the presentation of $750,000 of grant funds by Congresswoman Julia Brownley for the City's new Library. Councilmember Delgado reported on January 29 she attended the Moorpark Chamber of Commerce breakfast. Councilmember Delgado reported on January 27 she attended a luncheon for the Conejo Simi Moorpark Association of REALTORS® on behalf of the City of Moorpark. Councilmember Delgado reported on January 27 she attended opening night of Newsies at the High Street Arts Center. Councilmember Delgado reported on February 1 she attended the League of California Cities New Mayors and Councilmembers Academy. Councilmember Groff reported on January 19 he attended the presentation by Congresswoman Julia Brownley of the $750,000 check for the City's new Library. Councilmember Groff reported on January 24 he attended the swearing in of new Ventura County Sheriff Jim Fryhoff. Councilmember Groff reported on January 25 he attended the Special City Council meeting where Brown Act training was provided. Councilmember Groff reported on February 1 he attended the League of California Cities New Mayors and Councilmembers Academy. Councilmember Castro reported on January 19 he attended the presentation by Congresswoman Julia Brownley of the $750,000 check for the City's new Library. Mayor Enegren reported on January 19 he attended the Library check presentation from Congresswoman Julia Brownley. Mayor Enegren reported on January 25 he attended a meeting with various stakeholders, including the Ventura County Transportation Commission (VCTC), the California Department of Transportation (Caltrans), representatives from Didi Hirsch Mental Health Services, and the California Highway Patrol, on the 118 Flyover Bridge Barrier System project which is funded for$10,000,000 by Caltrans. The project will begin environmental review in August, followed by design, and construction by hopefully 2024. Mayor Enegren reported on January 25 he attended the Special City Council meeting where Brown Act training was provided. Mayor Enegren reported on January 27 he attended the Moorpark Chamber of Commerce breakfast. Mayor Enegren announced City staff would like to remind residents that the Draft 2050 General Plan and Environmental Impact Report are available for public review. Please visit www.moorparkgeneralplan.com to provide your comments and for information regarding upcoming meetings and events. Mayor Enegren extended an invitation to put on your quads or blades and join us for a night of skating, music, contests, and fun at the Valentine Skate Night. The skate night will be held on Saturday, February 11 from 5:00 p.m. to 8:00 p.m. at the Arroyo Vista Community Park multiuse court. Admission is free. For more information visit www.moorparkca.gov/skate. 8. PUBLIC HEARINGS: A. Consider Resolution Adjusting and Adopting User and Regulatory Fees. Staff Recommendation: Adopt Resolution No. 2023-4157 updating and establishing User and Regulatory Fees. (ROLL CALL VOTE REQUIRED) Ms. Saxton gave the staff report. Mr. Terry Madsen from ClearSource Financial Consulting provided a PowerPoint presentation via Zoom. Questions and comments followed from Councilmembers to staff which focused on the following: 1) how recently have fee schedules in nearby cities been adopted and how do fees in neighboring cities compare to Moorpark's proposed fees; 2) the proposed resolution includes an annual increase based on the Consumer Price Index (CPI) to ensure fees keep pace with rising costs; 3) discussion of the methodology used to develop the proposed fees which first considered Moorpark's cost to deliver its various services and thereafter compared how the proposed fees aligned with other cities in the region; 4) future annual increases will maintain the currently-proposed cost recovery levels; and 5) emphasis on the importance of continuing organizational process improvements, streamlining, and service enhancements. Mayor Enegren opened the public hearing at 7:17 p.m.; having no speakers, the public hearing was closed. MOTION: Councilmember Groff moved and Councilmember Delgado seconded a motion to adopt Resolution No. 2023-4157 updating and establishing User and Regulatory Fees. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED) MOTION: Mayor Enegren moved, and Councilmember Groff seconded a motion to approve the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2022/23 - February 1, 2023. Staff Recommendation: Approve the warrant register. B. Consider Minutes of City Council/Successor Agency Regular Meeting of December 21, 2022. Staff Recommendation: Approve the minutes. C. Consider Minutes of City Council/Successor Agency Regular Meeting of January 4, 2023. Staff Recommendation: Approve the minutes. D. Consider Agreement with Moorpark Foundation for the Arts for Arts and Culture Event Services. Staff Recommendation: Approve Agreement with Moorpark Foundation for the Arts for arts and culture event services for an amount not-to-exceed $25,000 annually, and authorize the City Manager to sign the Agreement, subject to final language approval of the City Manager. E. Consider a Resolution Exonerating Surety Bond - Grading & Improvements (Bond No. 4419289) for Site Improvements Associated to Parcel Map No. 2017-02 at 800 Los Angeles Avenue - Moorpark Covenant Group, LLC. Staff Recommendation: 1) Adopt Resolution No. 2023-4158, exonerating Bond No. 4419289, Surety Bond - Grading & Improvements; and 2) Authorize the City Clerk to exonerate the bond as shown in the agenda report and draft resolution (ROLL CALL VOTE REQUIRED) F. Consider Reduction of Surety Bond — Street, Storm Drain & Erosion Control Improvements (Bond No. 0778574) and Surety Bond — Grading (Bond No. 0778575) at 13960 Peach Hill Road (Oakmont of Moorpark, LLC). Staff Recommendation: 1) Authorize the City Clerk to reduce surety bond 0778574 to $38,871.72; and 2) Authorize the City Clerk to reduce surety bond 0778575 to $15,391.64. 11. ORDINANCES: None. 12.
