HomeMy WebLinkAboutORD 516 2023 0719 ORDINANCE NO. 516 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTIONS 3.04.130 AND 3.04.250 OF CHAPTER 3.04 (PURCHASING) OF TITLE 3 (REVENUE AND FINANCE) OF THE MOORPARK MUNICIPAL CODE INCREASING THE DOLLAR THRESHOLDS FOR INFORMAL AND FORMAL BID PURCHASES OF SUPPLIES, MATERIALS AND EQUIPMENT WHEREAS, the City Council adopted Ordinance No. 2 on July 20, 1983, creating a purchasing system for the purchase of supplies and equipment at the lowest possible cost; and WHEREAS, the City Council adopted Ordinance No. 43 on April 15, 1985, to amend certain sections (3.12.120 and 3.12.230) regarding the formal (sealed) bid procedure and open market or informal bid procedures respectively, to increase the purchasing thresholds; and WHEREAS, Moorpark Municipal Code Chapter 3.12 (Purchases) was renumbered as Chapter 3.04 (Purchasing) during updates to the Municipal Code; and WHEREAS, due to the increases in the cost of purchasing supplies and equipment since 1985, it is appropriate to amend the Moorpark Municipal Code to update the existing purchasing thresholds in order reflect market changes and streamline formal and informal bidding procedures; and WHEREAS, City staff has reviewed this ordinance and determined that its approval is exempt from the California Environmental Quality Act (CEQA) on the basis that the change in the dollar thresholds of purchasing limits for formal and informally bid items is an administrative and financial action of the City that does not have any possibility of having any effect on the environment, and on that basis does not constitute a project requiring environment review, as defined by Section 15273 of the State CEQA Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council concurs with City staff's determination that the approval of this Ordinance is exempt from the California Environmental Quality Act (CEQA) on the basis that the change to the dollar thresholds of purchasing limits for formal and informally bid items is an administrative and financial action of the City that does not have any possibility of having any effect on the environment, and on that basis, does not constitute a project requiring environment review, as defined by Section 15273 of the State CEQA Guidelines. Ordinance No. 516 Page 2 SECTION 2. Section 3.04.130 of Article II (Formal Bid Procedure) of Chapter 3.04 (Purchasing) of Title 3 of the Moorpark Municipal Code is hereby amended to read as follows: "3.04.130 Generally. Except as otherwise provided in this chapter, purchases of supplies and equipment of an estimated value greater than fifteen fifty thousand dollars ($15,000.00 50,000.00) shall be awarded to the lowest responsible bidder pursuant to the formal bid procedure hereinafter prescribed. Public projects, as defined in Section 20161 of the Public Contract Code of the state shall be awarded pursuant to applicable provisions of the Public Contract Code." SECTION 3. Section 3.04.250 of Article III (Open Market or Informal Bid Procedure) of Chapter 3.04 (Purchasing) of Title 3 of the Moorpark Municipal Code is hereby amended to read as follows: "3.040.250 Generally. Purchases of supplies and equipment of an estimated value in the amount of fifteen fifty thousand dollars ($15,000.00 50,000.00) or less may be made by the purchasing agent in the open market pursuant to the procedure prescribed in Sections 3.04.260 through 3.04.280 of this chapter and without observing the procedure prescribed in Sections 3.04.130 through 3.04.240 of this chapter; provided, however, all bidding may be dispensed with for purchases of supplies and equipment having a total estimated value not-to-exceed of less than one five thousand dollars ($1-,000.00 5,000.00)." SECTION 4. If any section, subsection, sentence, clause, phrase, part or portion of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 5. This ordinance shall become effective thirty (30) days after its passage and adoption. Ordinance No. 516 Page 3 SECTION 6. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a written record of the passage and adoption thereof in the minutes of the proceedings of the City Council at which the same is passed and adopted; and shall publish notice of adoption in the manner required by law.
