MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 06/07/2023 Regular Meeting SUBJECT: Consider Resolution to Adopt a Project List to be Funded by Senate Bill 1 (SB1): Road Repair Accountability Act of 2017 BACKGROUND AND DISCUSSION On April 28, 2017, the Governor signed into law Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017, which nearly doubled the amount of revenue cities and counties receive from the State for local street maintenance and rehabilitation needs. On September 16, 2017, the Governor signed Assembly Bill 135 (AB 135) to clean up the legislation for SB 1. In the part of the statute relevant to this staff report, the law was changed to simplify the process by which cities and counties could approve SB 1 project lists. Cities only need to adopt project lists at a regularly scheduled meeting by resolution and not adopt the list as a budget amendment. The California Transportation Commission (CTC) provided guidance to cities and counties that require project lists to be submitted that include, at a minimum: a description and location of projects to be funded by SB 1 revenues; schedule; and useful life of the work. The CTC does not approve city and county lists but rather tracks and reports on the program. Cities can revise the lists as desired. The City’s projected SB 1 funding for Cycle 7 is $895,145, to be distributed in Fiscal Year (FY) 2023/24. To ensure that the City receives FY 2023/24 funding, the project list must be sent to the CTC by July 1, 2023. The proposed projects are described below and are reflected in the attached draft resolution. The City will be required to submit a completed and in- progress expenditure report each year in December. For FY 2023/24, staff is proposing one new project. Staff is currently completing the Final Report for a citywide Pavement Management Program (PMP). Although the report is still in its draft form, the street survey and data analyses are complete with Pavement Condition Indexes (PCI) determined for street segments throughout the City. Based on the PCI determination and the projected Item: 10.F. 240 Honorable City Council 06/07/2023 Regular Meeting Page 2 revenue of $895,145 for Cycle 7, the next area of pavement improvements are described below: • Local industrial and commercial streets within the area bounded by Spring Road and Flinn Avenue, • Local residential streets located off of Hidden Pines Court, Tierra Rejada Road to the north, and City boundary to the south, and • Local residential streets located south of Countrywood Drive, north of Sagewood Drive, east of Country Hill Road, and west of Tierra Rejada Road. The table below provides for a summary of established projects from the prior cycles. As previously mentioned in this staff report, the Final Report for the citywide Pavement Management Program (PMP) is in progress and staff will return to the City Council to present on its findings and recommendations. All of the proposed street rehabilitation projects for Cycle 7, and all previous cycles, will be compared and reviewed with the PMP to determine a final project(s). Once a project(s) is(are) established, a new capital improvement project will be presented to the City Council for consideration. It should be noted that actual revenue received may be different from the amount of revenue requested as revenues are contingent upon tax receipts. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT Staff anticipates that approximately $895,145 of new funding will be made available to the City in this seventh program year/cycle. The proposed FY 2023/24 Budget includes $895,500. A budget amendment will be prepared in FY 2023/24 at the time that City staff returns to City Council with a proposed pavement improvement project. The purpose of the budget amendment will be to create a new Capital Improvement Program (CIP) project, define the limits and scope of work, and appropriate funds for the proposed pavement improvement project. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment 1: Draft Resolution No. 2023-____ Attachment 2: Local Streets and Roads – Projected Revenue 243 ATTACHMENT 1 RESOLUTION NO. 2023-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2023/24 TO BE FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017), was passed by the Legislature and signed into law by the Governor on April 28, 2017, to address significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of the City of Moorpark are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City of Moorpark (City) must include a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and WHEREAS, the City will receive an estimated $895,145 in RMRA funding from Cycle 7, Fiscal Year 2023/24, SB 1; and WHEREAS, this is the seventh year in which the City will receive SB 1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, funding from SB 1 will help the City maintain and rehabilitate streets in the City this year and into the future; and WHEREAS, the 2018 California Statewide Local Streets and Roads Needs Assessment found that California’s streets and roads are in “at-risk” condition and this revenue will help increase the overall quality of our road system and over the next decade will bring our streets and roads into a “good” condition; and WHEREAS, without revenue from SB 1, the City would have otherwise postponed street projects; and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and use cutting-edge technology, materials and practices, will have significant positive co-benefits statewide. 244 Resolution No. 2023-____ Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The foregoing recitals are true and correct. SECTION 2. The following list of newly proposed projects will be funded in-part or solely with Fiscal Year 2023/24 (Cycle 7) Road Maintenance and Rehabilitation Account revenues: Project Title: Project 2023-001 (Pavement Maintenance) Description: General maintenance including but not limited to pavement maintenance and repairs and repairs to adjacent facilities due to the work. Location: Various sections in the City including: • Local industrial and commercial streets within the area bounded by Spring Road and Flinn Avenue. • Local residential streets located off of Hidden Pines Court, Tierra Rejada Road to the north, and City boundary to the south. • Local residential streets located south of Countrywood Drive, north of Sagewood Drive, east of Country Hill Road, and west of Tierra Rejada Road. Estimated Project Schedule: Start (04/2024), Completion (06/2025) Estimated Project Useful Life: 7 years SECTION 3. The following previously proposed and adopted projects may also utilize Fiscal Year 2023/24 Road Maintenance and Rehabilitation Account revenues in their delivery. With the relisting of these projects in adopted fiscal year resolution, the City is reaffirming to the public and the State our intent to fund these projects with Road Maintenance and Rehabilitation Account revenues: Project Title: Project 2021-001 (Arroyo Drive Improvements) Description: Preconstruction and Construction activities related to resurfacing of Arroyo Drive from the Simi Valley city limit to the Collins Drive. Expands the original Project 2021-001 that originally called for construction activities related to resurfacing Arroyo Drive from the Simi Valley city limit to the Villa Del Arroyo Mobile Home Park and expands the activities to also include complete streets components of pedestrian and bicycle safety, as well as drainage and stormwater capture. Investigation of traffic control devices and railroad crossing improvements will also be included. Preconstruction and construction activities are included. Project Location: Arroyo Drive, east of Collins Drive to Simi Valley city limit. Estimated Project Schedule: Preconstruction (Start 07/2024), Completion (06/2025). Construction (Start 10/2025), Completion (06/2026).
