MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Carlene Saxton, Community Development Director DATE: 07/19/2023 Regular Meeting SUBJECT: Consider the Establishment of an Ad Hoc Committee to Re-Negotiate Certain Terms of the Development Agreement between the City and Scott Nakaatari of behalf of Alliant Strategic Development LLC on behalf of Alliant Moorpark Housing LLC for the Arroyo Springs Apartments Project (Previously the Duncan Ashley Project) BACKGROUND Arroyo Springs Apartments Project On November 17, 2015, an application was submitted for Residential Planned Development No. 2015-02, Vesting Tentative Tract Map 5972, General Plan Amendment No. 2015-02, Zone Change No. 2015-03, and Development Agreement No. 2015-01 requesting approval for construction of 95 residential condominiums on 8.3 acres of land, located at 4875 Spring Road and 384 Los Angeles Avenue on an application of Spring Road LLC. This project is known as the Duncan Ashley Project (Original Project). On September 7, 2016, former Mayor Parvin and former Councilmember Van Dam were assigned to the ad hoc committee established for the negotiation of the Development Agreement for the Original Project. In 2017 and 2018, the City Council approved the Original Project and related entitlements. Since that time, the Original Project has not been constructed and the related properties have since been sold to a new owner. The Original Project entitlements has since expired, but the Development Agreement remains in effect for a term of 20 years. On May 24, 2023, a Development Agreement Amendment Application was filed by Alliant Strategic Development LLC. The applicant recently acquired the properties. The applicant has indicated that they desire to modify the existing Development Agreement to revise the original project scope and to develop a fully affordable apartment complex (New Project), which would rely on Density Bonus Regulations. On November 8, 2022, the applicant filed a Pre-Application for the conceptual Arroyo Spring Apartments Project. Through the Pre-Application process, it was determined that several Item: 9.B. 174 Honorable City Council 07/19/2023 Regular Meeting Page 2 requirements outlined in the existing Development Agreement (DA) would preclude the Project from moving forward. Tentatively, the conceptual New Project would include 150 affordable rental units, 204 parking spaces, and various onsite amenities, although the New Project has not yet been applied for. Because this is a new request from the developer and the prior committee’s work was completed, a new ad hoc committee is now requested to address the amendment application from the current owner. Development Agreement Ad Hoc Committees Within the City of Moorpark, DAs are negotiated with two Councilmembers, City staff and the applicant. City staff and Council set the parameters regarding the negotiations and terms of the DA with the applicants. In order, to move forward into the DA negotiations, staff is requesting that the City Council identify two members to serve on an ad hoc committee to negotiate the terms of the DA for the Arroyo Springs Apartments Project. There are no current ad hoc committee assignments for this Project. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT There is no financial impact associated with formation of the City Council subcommittee. COUNCIL GOAL COMPLIANCE This action does not support a current strategic objective. STAFF RECOMMENDATION Select two members of the City Council to participate on the ad hoc committee for the Arroyo Springs Apartments Project. 175
