SUBJECT: Consider Nomination for Appointment to the Ventura County Air
Pollution Control District Advisory Committee
BACKGROUND
The Ventura County Air Pollution Control District (APCD) Advisory Committee is an
appointed body composed of 20 members that reviews proposed rules from the APCD’s
staff prior to the Air Pollution Control Board holding a public hearing on the proposed
rules. The Advisory Committee occasionally takes up other air pollution related issues.
Pursuant to the APCD Advisory Committee Bylaws, all Committee members are
appointed by the APCD Board of Directors following nomination by the nominating entity,
in this case the City Council. The Bylaws state that Advisory Committee members should
be skilled and experienced in the field of air pollution control. Advisory Committee
members serve a four-year term or until replaced; or resignation; or removal by the Board
and may serve past the term of the nominating entity until replaced or reappointed.
The City’s current representative, Donald Bird, was nominated for appointment by the
City Council in December 2018 with the APCD Board making formal appointment at its
February 12, 2019, for a term expiring in 2023. Mr. Bird currently continues to serve at
the City’s representative on the Advisory Committee.
Pursuant to the City Council Policies Resolution, applicants to regional boards and
committees are not required to make a presentation to the Council as part of the
appointment process. Similar to the Area Housing Authority of the County of Ventura, the
Ventura County Area Agency on Aging, and the Citizens Transportation Advisory
Committee, the City Council appoints applicants to these entities following its review of
applications submitted.

In the case of APCD Advisory Committee, the Council nominates a representative who is
then appointed by the APCD Board.
DISCUSSION
On July 27, 2023, the City Clerk initiated a recruitment for the Air Pollution Control District
Advisory Committee seeking interested applicants which concluded on Monday,
September 18 at 5:00 p.m. Three applications were received and are attached hereto.

Following discussion among Councilmembers and the Mayor regarding applicant
qualifications, the City Council Policy Resolution provides the procedure for appointments
as follows:
A.The Mayor shall solicit suggested nominees from members of the Council.
B.Prior to making a motion for appointment, the Mayor shall announce the
names of all persons he/she intends to nominate, and in the order to be
nominated, for a board, commission, or committee.
C.The Mayor shall make a motion putting forth each individual name to be
approved for appointment.
D.A second shall be required.
E.The Council shall vote on each appointment individually.
In this case, the Council’s action will be to nominate its recommended representative with
the nomination information being conveyed to the APCD. It is anticipated that the ACPD
Board will take action on the appointment at its November 2023 meeting.
ENVIRONMENTAL DETERMINATION
This action is exempt from the California Environmental Quality Act (CEQA) as it does
not constitute a project, as defined by Section 15378 of the State CEQA Guidelines.
Therefore, no environmental review is required.
FISCAL IMPACT
None.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.

I hold a M.S. in Environmental Policy & Management which focused on the creation, implementation, and impacts of
environmental policy. Much of the graduate program was centered around the National Environmental Policy Act and
Environmental Impact Assessments. At those assessments are based around projects, the education has helped me assess
the impacts of new rule proposals on all involved stakeholders while serving on the APCD.

electrical infrastructure. The job routinely involves negotiating the conflicts between natural resources and the built world,

I have had the honor to serve on the Air Pollution Control District Advisory Committee for over 4 years and have enjoyed
being part of the process to improve the air quality in Ventura County. I would like to continue to advocate for better air
