Mayor Energen and Honorable City Council, I wanted to reach out and voice some concerns I have over your High Street Encroachment Permit Resolution. I am not opposed to some regulation of this as I believe we all share the vision of activating the street while keeping it aesthetically pleasing. Here are some thoughts Street Fencing: By not allowing street fencing, you are putting new businesses at a disadvantage to not be allowed to serve alcohol to their sidewalk diners. I have heard that there is a possibility that ABC will change rules at some point to not require fencing, but that is not currently the case and we should not leave this to chance. From my conversation with community development, ABC does not even allow temporary fencing for alcohol service at this time. Lighting: By not allowing railings, you are also not allowing a restaurant to string cafe lights like is done at Lucky Fools which helps diners see menus and helps create "place " Floodlights from the building are not nearly as inviting and do not add to the character of High Street. Outdoor Furnishings: The resolution states that "Tables shall not exceed 42 inches in width at the greatest dimension." This table size does not allow for a rectangular table for 4 people. As Moorpark is a very family friendly town, I would love to see this increased to at least 48 inches. Outdoor Displays: In this section it states,'Outdoor displays shall be limited to single items, object displays, or a few examples of items or goods sold in the store and must comply with all other standards of these Guidelines." To me this does not help make sure the display is aesthetically pleasing. I would love to see a guideline like photos of typical displays must be submitted to the community development director for approval." This would help ensure that displays are what you actually get, more than just stuff looking like a garage sale. Portable outdoor heating: Done correctly, Heating does not need to be an eye sore. Restaurants like Carerra's in town have very attractive portable heating on their patios and I don't see why this could not be any different. Six Foot Sidewalks: I generally support this and am thankful that you have a 4 foot possibility with approval.
