MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Roger Pichardo, Program Manager DATE: 10/18/2023 Regular Meeting SUBJECT: Consider Senate Bill (SB) 1383 Local Assistance Grant Program Fiscal Year (FY) 2022/23 and Adopt Resolution Authorizing Submittal of Application to California Department of Resources Recycling and Recovery (CalRecycle) for Grant Funds in the Amount of $77,305 BACKGROUND The California Department of Resources and Recovery (CalRecycle) offers the Senate Bill (SB) 1383 Local Assistance Grant Program FY 2022/23 Pursuant to Chapter 395, Statutes of 2016. This noncompetitive grant program will provide funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383. The term of the program begins April 1, 2024, and ends April 2, 2026. Program expenditures may start no earlier than the date of the award of funds. DISCUSSION Under the terms of the CalRecycle SB 1383 Local Assistance Grant Program FY 2022/23, the City of Moorpark is eligible to apply for approximately $77,305 to assist with the implementation of regulation requirements associated with SB 1383. The CalRecycle grant funding can be used to support a variety of program areas related to SB 1383, such as planning, edible food recovery and collection, education and outreach, program enforcement and inspection services, program evaluation and gap analysis, and record keeping. Additionally, grant funding can also be used for the procurement of locally recovered organic waste products, such as mulch and compost. The City currently allocates $25,000 annually for the procurement of mulch that is installed in our parks. This grant funding would offset those costs, resulting in substantial savings to the General Fund. Allocation to recipients is calculated on a per capita basis using the Department of Finance’s population statistics. The Program application is due November 15, 2023, and must contain an approved grant resolution from the City Council authorizing submittal of the application and identifying the individual(s) authorized to execute any agreements, contracts, and requests for payments. Program expenditures do not require applicants to provide cost share or matching funds. Item: 10.J. 384 Honorable City Council 10/18/2023 Regular Meeting Page 2 ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT If state grant funds are awarded to the City, program expenditures will be made throughout the course of the grant's term and will be budgeted accordingly in the Solid Waste Fund. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2023-____ 385 RESOLUTION NO. 2023-_____ A RESOLUTION OF THE CITY OF MOORPARK AUTHORIZING SUBMITTAL OF SENATE BILL (SB) 1383 LOCAL GRANT ASSISTANCE PROGRAM FISCAL YEAR (FY) 2022/23 APPLICATION AND RELATED AUTHORIZATIONS TO THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY WHEREAS, the California Department of Resources Recycling and Recovery (CalRecycle) has established the SB 1383 Local Assistance Grant Program FY 2022/23 Pursuant to Chapter 395, Statutes of 2016 to assist local jurisdictions with the implementation of regulation requirements associated with SB 1383; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the application, awarding, and management of the SB 1383 Local Assistance Grant Program FY 2022/23; and WHEREAS, CalRecycle’s SB 1383 Local Assistance Grant Program FY 2022/23 application procedures require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of SB 1383 Local Assistance Grant Program FY 2022/23. WHEREAS the City of Moorpark authorizes the submittal of SB 1383 Local Assistance Grant Program FY 2022/23 application to CalRecycle; and WHEREAS the City Manager or Designee is hereby authorized and empowered to execute in the name of the City of Moorpark all grant documents, including but not limited to, applications, agreements, amendments, and requests for payment, necessary to secure grant funds and implement the approved grant project; and WHEREAS these authorizations are effective for five (5) years from the date of adoption of this resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. An aggregate budget amendment of $129,043 for state grant funds awarded to the City to assist with the implementation of regulation requirements associated with SB 1383, as more particularly described in Exhibit A, attached hereto, is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
