GILLESPIE Chief of Police The State Department of Transportation (Ca.l_tr.ans) entered into agreement November_ 30, 1.971 with the County of Ventura to complete the connection, of Highway 23 and Highway 118. Now that the City is incorporated, Caltrans has asked -the City to enter into an. agreement with them allowiing Caltrans to proceed with this project. The Staff has reviewed the Freeway Agreement presented by the State and has had several questions with regard to the details of the project and the elements of the agreement. Some of these concerns were raised in a letter to the project engineer dated Clay 1.7, 1989. Caltrans has responded to some of those questions by letter, however_ they have indicated an unwillingness to amend the agreement to make it more specific. Both Bob Wallin, Project Engineer and Jack Ha.l.l.in, Chief Engineer of District-, 7 Branch. C of Caltrans have indicated ghat; the Freeway Agreement language is intended to be generic and cannot: be changc,d without causing a delay in the project. They have both expressed a willingness to work out the specifics and details of the pro ;ject using further memorandums of agreement between the City of Moorpark and Calt.raris. Our Attorney has reviewed the Freeway Agreement and has indicated some concern with regard to the acquisition and c.onst:ruct:i_on time frames not. being specifically addressed. The City Attorney has recommended that we negotiate an acquisition/construction schedule with the State and that: this schedule be incorporated :into tbo agreement. 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 The Honorable City Council May 31, 1989 r Page 2 Caltrans requires adoption of the Freeway Agreement by resolution authorizing the Mayor to execute the Agreement. The attached resolution fulfills that requirement and goes further to indicate our intention to approve the agreement based on the understanding that a subsequent acquisition /construction schedule addressing the details of design and coordination of construction will be developed between Caltrans and the City of Moorpark. Recommendation: Staff continues to have reservations about the lack of specificity in the generic Freeway Agreement. Direct Staff as deemed appropriate.
