MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Roger Pichardo, Program Manager DATE: 01/03/2024 Regular Meeting SUBJECT: Consider Forming an Ad Hoc Committee to Discuss Amendments to the Solid Waste Franchise Agreement BACKGROUND On June 6, 2018, the City Council approved a 12-year solid waste franchise (Agreement) with USA Waste of California, Inc. (Waste Management) to provide residential and commercial solid waste services. To reduce greenhouse gas emissions by diverting organic waste from landfills following the passage of Senate Bill 1383 (SB 1383) in 2016, CalRecycle introduced and finalized prescriptive regulations in November 2020. These regulations mandate local jurisdictions to enact mandatory ordinances to reduce organic waste disposal. Additionally, the regulations require all businesses, multifamily housing, and residential solid waste customers to have access to recycling programs that include the collection of food waste scraps and landscaping debris among other organic waste items. Due to the City’s 2018 solid waste franchise agreement predating CalRecycle’s 2020 final regulations, the franchise agreement did not contain specific provisions regarding the implementation of mandatory food waste collection requirements. In early November 2023, Waste Management staff contacted the City Manager’s Office, requesting a meeting to discuss the franchise agreement, including the implementation of mandatory food waste recycling requirements. On November 16, the City conducted a meeting with Waste Management staff to receive a presentation and discuss the deferral of the 2024 solid waste rate adjustment, which applies to both residential and commercial customers. Throughout this meeting, Waste Management provided comprehensive information and details regarding the deferment, as well as aiming for dialogue and collaboration on future amendments to the franchise agreement to align with SB 1383. Item: 9.A. 473 Honorable City Council 01/03/2024 Regular Meeting Page 2 DISCUSSION On December 7, 2023, City staff received a correspondence (attached) from Waste Management regarding the 2024 annual rate adjustment and to request a discussion of amendments to the solid waste franchise agreement. Staff is seeking the Council’s approval to form an ad hoc committee to discuss amendments to the solid waste franchise agreement, which was approved on June 18, 2018, with Waste Management, to ensure compliance with SB 1383. Of note, the City Council created an ad hoc committee to negotiate the 2018 franchise agreement as well. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT There is no financial impact associated with formation of the City Council ad hoc committee. COUNCIL GOAL COMPLIANCE This action does not support a current strategic objective.
