GEDNEY City Treasurer TO: FROM: DATE: SUBJEC T: THE HONORABLE CITY COUNCIL STEVEN KUENY, CITY MANAGER� APRIL 15, 1985 CLEMENT ISSUE Mrs. Clement has responded to.the recent action of the City Council to no longer contest CALTRANS improvement plans for her property. A copy of her letter is attached. Staff is continuing to work with the affected parties concerning the wall. The land use and zoning issue should be considered separately at another time. The Assessor Parcel Map indicates two parcels at least for tax purposes (copy attached). If there are two legal parcels, then it may be appropriate to have separate access for each. The parcels could have a shared access with a cormon ingress/egress. The issue of ingress/egress is one that must have the approval of CALTRANS. The matter to be decided is whether the standard curb and gutter, as approved by CALTRANS, should be installed. For traffic and pedestrian safety reasons, I do not recornnend a m:xlification to the Council's rrost recent action. GILLESPIE Chief of Police At the March 18, 1985 meeting, the City Council took action to concur with CalTrans' decision to deny the requested deletion of curb and gutter in front of the commercial office on your property. The City Council reversed its earlier direction on this matter as a result of the potential safety hazard to school children and other pedestrians, caused by the head-in parking of vehicles in front of the Satellite TV business. The enclosed pictures illustrate that pedestrians are forced onto the highway as a result of the parking. I've also enclosed a copy of the February 8, 1985 CalTrans letter for your information. At this time, the City staff will consider any alternatives you may wish to propose that are consistent with conditions 2 and 3 of the CalTrans letter. If we do not hear from you by April 15, 1985 we will proceed to inform CalTrans and Regal Homes that the City no longer objects to the improvements as originally approved by CalTrans. An additional item of concern is the sign used by the business. As you can see in the photograph in the lower right corner of the attached sheet, the sandwich board "Open" sign does not conform to the City's sign requirements. As the property owner, you are ultimately responsible for this violation. We request that you have the tenant remove the subject sign. If you have any questions concerning either matter, please don't hesitate to contact me, and if you have an alternative proposal for the curb and gutter, please let me know by April 15.
