S U 13 7 E C T = PUBLIC HEARING ON THE FOLLOWING: (1) PROPOSED AMENDMENT
TO THE TEMPORARY PRODUCE STANDS SUBJECT TO A CONDITIONAL
USE PERMIT; (2) PROPOSED AMENDMENT TO ARTICLE 47, HOME
OCCUPATION, BY DELETING THE EXISTING DEFINITION AND
ADOPTING A HOME OCCUPATION ORDINANCE.
Background
At the City Council meeting of April` 16, 1986, the City Council
directed the Community Development Department to review and draft
appropriate ordinances to address the enforcement problems associated
with these two land uses.
1. Temporary Produce Stands regulated by a Conditional
Use Permit would require.the staff and Planning
Commission to review such matters as: land use com—
patibility, ingress/egress, parking, singage, etc.
Also, the Amended Ordinance would require a minium
of one (1) acre parcel size.
2. The purpose of the Home Occupation Ordinance is to
protect the City's Residential Zones and specifically
establishes review criteria and the process required
before the issuance of a Home OCCUDation Clearance
and if applicable, a Business License.
Recommended Action
1. Approve the Negative Declaration as being in compliance with the
CEQA guidelines;

WHEREAS, at a duly noticed public hearing on June 11, 1986,

WHEREAS, the Planning Commission, after review and consid-
eration of the information contained in the staff report dated June 11,
1986, and based upon an initial review, it has been found that a signifi-
cant effect would not occur; therefore this body has reached its decision
in the matter;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Planning Commission hereby recommends
to the City Council that the Zoning Ordinance be amended to allow Tem-
porary Produce Stands by requiring a Conditional Use Permit in the eight
(8) existing zones contained herein -be amended to read as follows:
"All temporary stands established or maintained for the
sale of agricultural or horticultural products, grown on the premises,
as permitted by this Article shall conform to the following conditions
and limitations.
1. The floor areas of such stands shall not exceed four
hundred (400) square feet each;
2. Such stands shall not be located or maintained within
twenty (20) feet of any public road, street or highway;
3. Owners thereof shall remove such stands when not in
use for a period of thirty (30) days;

4. Building specifications shall be submitted for
approval;
5. Land area must be one 91) acre or more. The existing
temporary produce stand would be Grandfathered in.
SECTION 2. That at its meeting of August 13, 1986, the
Planning Commission took action to request staff to prepare a
resolution recommending the the City Council amendment to the
Zoning Ordinance to allow Temporary Produce Stands by requiring
a Conditional Use Permit in the eight (8) existing zones contained
herein; said resolution to be presented at the next regularly
scheduled meeting. The action with the foregoing direction was
approved by the following roll call vote;
AYES: Commissioner Keenan, Rosen, LaPerch, Claffey
and Holland.

a) Temporary Produce Stands
At the Moorpark city Council Public Hearing of April 16, 1986,
the City Council directed the Community Development Department
to submit a proposal that would allow for Temporary Produce
Stands with certain restrictions. The ability to adequately
review such locations was brought to the attention of City
Council over the existing produce stand on Los Angeles Avenue
near the "Moose Lodge". By requiring the Conditional Use
Permit the Planning staff and Planning Commission would have
the ability to use such criteria, i.e., ingress/egress, land
use compatibility, dust, signage, setbacks, parking and to
include the present definations, conditions and limitations
which are as follows:
Stands, Temporary - All temporary stands established or maintained
for the sale of agricultural or horticultural products, grown on the
premises, as permitted by this Article shall conform to the following
conditions and limitations.

Proposal: Land area must be one (1) acre or more. The existing temporary
produce stand would be Grandfathered in and as long as the use
continues under the existing conditions and limitations the
temporary produce stand will be permitted to operate.
b) Home Occupation Definition & Adopting a Home
Occupation Ordinance.
The Home Occupation Ordinance has been drafted because our existing
ordinance only addresses the Home Occupation situation in one
paragraph and it does not address the varied types of situations
that have been encountered through the City's complaint process.
The inadequacy, vagueness, inability to safely protect the resi-
dential zones in regards- to health, safety and welfare of the
City's residents has resulted in this proposed ordinance which
specifically sets the criteria which must be met prior to the
issuance of a Home Occupation Clearance and Business License.
Recommended Action
1. That the Planning Commission recommend to the City Council approval
of the Amendment to the Zoning Ordinance to Allow Temporary Produce Stands
by requiring a Conditional Use Permit.
2. That the Planning Commission recommend adoption of the Home Occupation
Ordinance and to delete the existing Home Occupation defination.
