The City Council previously directed staff to process the
necessary amendment to the Moorpark Municipal Code to refine our
permit procedures for carnivals, fairs and other temporary
recreational and amusement type entertainments. This action was
precipitated by the desire of the Moorpark JAYCEES to hold their
Moorpark Country Days carnival on a parcel in the M-1 Zone.
Because of the length of time required for processing (both
before the Planning Commission and the City Council), we have
determined it feasible to remove from the Zoning Code the require-
ment of a Conditional Use Permit for such temporary type amuse-
ment, leaving only the CUP requirements for facilities and/or
grounds for those amusement enterprises of a permanent nature.
The Planning Commission considered the proposed amendment at its
meeting of July 24, 1985, and adopted Resolution No. PC-85-47
(copy attached), recommending the proposed amendments as out-
lined in the resolution.
Introduce the attached Ordinance No. , which amends the
Moorpark Municipal Code to provide that temporary carnivals and
other temporary recreational and amusement type enterprises,
such as fairs, rodeos, etc., shall be subject to the permit
procedures set forth in the business regulation sections of
the Code.

RESOLUTION NO. PC-85-47
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL OF SAID CITY AN AMENDMENT TO
CHAPTER 1, ZONING, OF DIVISION 8 OF THE VENTURA
COUNTY ORDINANCE CODE, ADOPTED,BY SAID CITY COUNCIL
ON SEPTEMBER 21, 1983, IN VARIOUS PARTICULARS
PERTAINING TO TEMPORARY RECREATIONAL AND AMUSEMENT
TYPE ENTERTAINMENTS.
WHEREAS, Article 44 of Chapter 1, Zoning, of Division 8
of the Ventura County Ordinance Code, adopted by the Moorpark City
Council on September 21, 1983, sets forth procedures for the amend-
ment to the provisions of said Ordinance Code; and
WHEREAS, the Planning Commission has held a duly noticed
public hearing regarding a proposed ameddment of certain
sections of said Ordinance Code (Zoning) pertaining to temporary
recreational amusement type enterprises; and
WHEREAS, after careful consideration, the Planning Com-
Commission has reached its decision in the matter;
NOW, THEREFORE, THE PLANNING COMMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, DOES RESOLVE- AS FOLLOWS:
SECTION 1. It is recommended to the City Council of the
City of Moorpark that the following sections of Chapter 1, Zoning,
of Division 8 of the Ventura County Ordinance Code, adopted
September 21, 1983, be amended to read as hereinafter set forth:
11 Section 8128-0.45 of Article 10 (C-1 Zone)
2) Section 8129-0.75 of Article 11 (C-2Zone)
3) Section 8130.0.2.7.9 of Article 12, (C-P-D Zone)
"(a) A temporary carnival, fair, rodeo, gymkhana
and other similar temporary recreational and amuse-
ment type enterprise, subject to license (permit)
requirements set forth in Sections 2211 through
2216 of Article 1, Chapter 2 of Division 2 of the
County Ordinance Code.
"(b) Definition of temporary carnival:
A recreational and amusement type enterprise
not to exceed five (5) consecutive daysin.duration
per event, and five (5) days per organization per
calendar year."

SECTION 2. That a copy of this resolution, along with the
staff report to this Commission Pertaining to the subject matter,
be forwarded to the City council for consideration.
SECTION 3. That this resolution shall take effect
immediately.

SUBJECT: Code Amendment re Temporary Recreational
and Amusement Type Entertainments.
BACKGROUND:
The City Council has directed staff to process the necessary
amendment to the Municipal Code to refine our permit procedures
for carnivals, fairs, and other temporary recreational and amuse-
ment type entertainments. Because of the length of time required
for processitfJ (both before the Planning Commission and the City
Council), we -have determined it feasible to remove from the
Zoning Code the reqirement of a Conditional Use Permit for such
temporary type amusement, leaving only the CUP requirements for
facilities and/or grounds for those amusement enterprises of a
permanent nature.
The matter has been set for hearing at your meeting of July 25,
legal notice has been given as required by law, and the
attached resolution is a recommendation to the City Council to
require that these temporary types of recreational and amusement
enterprises be subject to the license (permit) procedures under
the business regulations of the Municipal Code. This action was �
precipitated by the desire of the Moorpark JAYCEES to hold their
Moorpark Country Days carnival on a parcel in the M-1 Zone.
RECOMMENDATION:
Adopt the attached resolution.
