Reynolds Jr., Administrative Service Manager DATE: May 26, 1999, (CC Mtg. 6/2/99) SUBJECT: Consider Refund of Swap -Meet Vendor Business Registration Fees DISCUSSION On April 30, 1999, City acted in response to Moorpark College's request for assistance with the swap -meet, and consistent with the Municipal Code, required each vendor at the swap -meet to pay an annual Business Registration fee of $30. The City registered 238 businesses between May 2 and May 23, for a total amount collected of $7,140. The event manager informed each vendor that the fee was non- refundable. Since canceling the event May 19, 1999, and following the final swap -meet of May 23, the City has been contacted by several of these vendors requesting a refund of their Business Registration fee. The Business Registration fee was established in 1986, based on the cost of issuing the permit. Each permit is valid for 12 months. In 1989, the City Council by minute action, enacted a no refund policy. Any refund to the sw action as an exception issuing any refund wi because the $30 was s p 000 461 Staff is requesting that the Council consider refunds to these business owners as an exception to the 1989 policy, because the City for unrelated reasons, cancelled the event. It is realized that the businesses complied with the City's Business Registration program, and intended to use this Registration for a full twelve months at the swap -meet. It is assumed that these businesses would not otherwise conduct their activities in Moorpark. In the event that a business wishes to sell at other events in Moorpark, a new Business Registration fee would have to be paid. After the first event, only a few businesses had registered. The swap -meet management company paid for 86 licenses on behalf of the vendors, to assure that they were in compliance during subsequent events. Some of the refunded monies therefore, would be returned to the event manager, because not all of these original vendors returned. Staff has records of which of these vendors returned to the swap -meet and reimbursed the manager, and this detail will be administered by staff to the satisfaction of all involved. STAFF RECOMMENDATION That the City Council authorize a 100o refund of the Business Registration fees paid by Moorpark swap -meet vendors. 00046�
