MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Carlene Saxton, Community Development Director DATE: 01/17/2024 Regular Meeting SUBJECT: Workshop to Consider Regulations for Mobile Food Facilities BACKGROUND On October 4, 2023, the City Council requested staff bring forth a discussion item to restrict mobile food facilities (MFFs), also known as food trucks on High Street. This item is intended to garner additional feedback from the Council on such a policy and to provide an opportunity for the public to provide input. Staff notes that additional noticing was provided for businesses along High Street in the downtown area to ensure their interests are able to be heard as part of this preliminary outreach. Existing Regulations Existing City Code regulations for MFFs are included below for reference. These requirements are applicable Citywide and there are currently no specific regulations for operations on High Street. Item: 9.A. 1 Honorable City Council 01/17/2024 Regular Meeting Page 2 In addition to the requirements of the City’s Code, MFF operators must be licensed by the Ventura County Environmental Health Department. The County imposes additional rules, including that the MFF operate within 200 feet of a toilet and handwashing facility if stopped for more than a one-hour period. Downtown High Street Two existing public parks (Magnolia Park – 296 Charles Street and Walnut Acres Park – 161 Second Street) bar the operation of MFFs on High Street between 8:00 a.m. and 4:00 p.m. on school days. Similarly, MFFs are not permitted on Moorpark Avenue during these timeframes due to the proximity to Chaparral Middle School and Flory Academy. DISCUSSION Staff would like the Council to provide feedback to the following questions: - Should food trucks be allowed on High Street? - Should food trucks be allowed citywide? - Should food trucks be allowed for special event s within the public right-of-way, citywide and/or on High Street? - Should food truck hours be limited? ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT There is no financial impact associated with this item. COUNCIL GOAL COMPLIANCE This action is consistent with Goal 2 of the City Council Goals and Objectives – Strategic Economic Development: Objectives 2.1 “Economic Development Strategy;” 2.2 “Business Engagement and Outreach;” and 2.3 “Downtown Specific Plan.” STAFF RECOMMENDATION Receive a presentation, receive public input and provide direction to staff regarding potential regulations related to mobile food facilities. 2
