Staff Recommendation: 1) Adopt Resolution No. 2024-4224, exonerating Surety Bond No. 0778574 for Street, Storm Drain & Erosion Control Improvements and Surety Bond No. 0778575 for Grading; and 2) Authorize the City Clerk to exonerate the bonds as shown in the agenda report and draft Resolution. MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 01/17/2024 Regular Meeting SUBJECT: Consider Resolution Exonerating Surety Bond No. 0778574 for Street, Storm Drain & Erosion Control Improvements and Surety Bond No. 0778575 for Grading at 13960 Peach Hill Road (Oakmont of Moorpark, LLC) BACKGROUND AND DISCUSSION On August 1, 2018, the City Council adopted Resolution No. 2018-3727, approving Commercial Planned Development No. 2018-01 for a 77-unit assisted living and memory care community at 13960 Peach Hill Road. On August 13, 2020, staff issued Grading Permit No. 273G for grading and site improvements associated with the development of the Oakmont of Moorpark at 13960 Peach Hill Road. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 19-ML-11087, are completed in accordance with the reviewed and accepted Plans and Specifications. The grading and site improvements associated with the development of Oakmont of Moorpark are constructed and were accepted by City staff on December 13, 2022. The constructed site improvements have performed beyond the one-year warranty period and staff recommends that the following bonds be exonerated: Surety Type Bond Number Original Bond Amount Prior Authorization Action Authorized Action as of 1/17/2024 Surety Bond – Street, Storm Drain & Erosion Control 0778574 $388,717.24 Reduced to $38,871.72 on 2/01/2023 Exonerate Surety Bond – Grading 0778575 $153,916.40 Reduction to $15,391.64 on 2/01/2023 Exonerate Item: 10.G. 33 Honorable City Council 01/17/2024 Regular Meeting Page 2 Attached for the City Council’s consideration is a Resolution exonerating Surety Bond No. 0778574 for Street, Storm Drain & Erosion Control Improvements and Surety Bond No. 0778575 for Grading. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) 1. Adopt Resolution No. 2024-____, exonerating Surety Bond No. 0778574 for Street, Storm Drain & Erosion Control Improvements and Surety Bond No. 0778575 for Grading ; and 2. Authorize the City Clerk to exonerate the bonds as shown in the agenda report and draft Resolution. Attachment: Draft Resolution No. 2024-____ 34 ATTACHMENT RESOLUTION NO. 2024-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, EXONERATING SURETY BOND NO. 0778574 FOR STREET, STORM DRAIN & EROSION CONTROL IMPROVEMENTS AND SURETY BOND NO. 0778575 FOR GRADING AT 13960 PEACH HILL ROAD (OAKMONT OF MOORPARK, LLC) WHEREAS, the City Council adopted Resolution No. 2018-3727, approving Commercial Planned Development No. 2018-01 for a 77-unit assisted living and memory care community at 13960 Peach Hill Road; and WHEREAS, on August 13, 2020, staff issued Grading Permit No. 273G for grading and site improvements associated with the development of the Oakmont of Moorpark at 13960 Peach Hill Road; and WHEREAS, as part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 19-ML-11087, are completed in accordance with the reviewed and accepted Plans and Specifications; and WHEREAS, the City Engineer/Public Works Director accepted the grading and site improvements at 13960 Peach Hill Road on December 13, 2022, and deemed those improvements to be complete; and WHEREAS, City staff now recommends that the City Council fully exonerate Surety Bond No. 0778574 for Street, Storm Drain & Erosion Control Improvements (site improvements) and Surety Bond No. 0778575 for Grading (Bond No. 0778575), related to 13960 Peach Hill Road. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark hereby exonerates Surety Bond No. 0778574 and Surety Bond No. 0778575. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
