MINUTES OF THE CITY COUNCIL
Moorpark, California May 13, 1987
The adjourned meeting of the City Council of the City of Moorpark,
California was held on May 13, 1987 in the Council Chambers of City Hall
of said City, located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
The meeting was called to order at 7:15 p.m. by Mayor Clint
Harper.
Z. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Councilmember Galloway.
3. ROLL CALL:
Present: Councilmembers Eloise Brown, John Galloway, Bernardo
Perez, and Mayor Clint Harper.
Absent: Councilmember Thomas Ferguson
Steven Kueny, City Manager; Cheryl Kane, City Attorney;
Scott Field, Assistant City Attorney; Patrick Richards,
Director of Community Development; Gerald Forde, Director
of Community Services; Thomas Genovese, Director of
Administrative Services; John Knipe, Assistant City
Engineer; Lt. Michael Brown, Police Department; Earl
Ledbetter, Special District Analyst; and Maureen W. Wall,
City Clerk.
4. APPROVAL OF MINUTES:
None were presented for approval.
5. PROCLAMATIONS, COMMENDATIONS, SPECIAL PRESENTATIONS:
None were presented for approval.
6. PUBLIC COMMENTS:
A. Theresa Montgomery, 13076 East Mesa Verde Drive. She spoke in
opposition to using Mesa Verde Drive as an access to the 69
acre Community Park.
7. . CONSENT CALENDAR:
Nothing was presented for approval.

8. PUBLIC HEARINGS:
There were no public hearings.
9. ORDINANCES/RESOLUTIONS:_
B. Ordinance No. 90. Introduction and first reading of an
Ordinance —req—ardinq a revision to the Sign Code to allow
tract pole flags and amend temporary_ commercial window sign
coverage.
Patrick Richards, Director of Community Development, gave the
Staff Report dated May 1, 1987. Mayor Harper stated that he
still objects to the flag size. The following Motion was then
heard.
MOTION: Councilmember Brown moved and Ccuncilmember
Galloway seconded a Motion to waive further reading of the
Ordinance. The voice vote was approved with Mayor Harper
voting No, and Councilmember Ferguson absent. The City
Attorney, Cheryl Kane, then read the Ordinance in title only.
Then the following Motion was heard.
MOTION: Councilmember Brown moved and Councilmember Galloway
seconded a motion to approve Ordinance No. 90 for first reading
and introduction. The Motion passed with Mayor Harper voting
No and Councilmember Ferguson absent.
D. Resolution No 87- Renaming of Moorpark Road to
Spring Street.
Thomas Genovese, Director of Administrative Services, gave the
Staff Report dated April 29, 1987. By consensus of Council,
Staff was directed to return to the Fire Department for an
explanation as to why other names as suggested by Council were
not preferred.
G. Resolution No. 87- A proposed Resolution concerning the
manner in which City Council meetings are conducted. This
item was continued to May 20, 1987.
H. Resolution No. 87-382 A proposed Resolution approving
the Engineer's report for Moorpark Lighting and Landscaping
Maintenance Assessment District No. AD-84-2 for the fiscal
year commencing July 1, 1987 and ending June 30, 1988. John
Knipe, Assistant City Engineer, gave the Staff Report which
gave an overview of the Engineer's reports for the Assessment
District. The following Motion was then heard.
MOTION: Councilmember Perez moved and Councilmember Galloway
seconded a motion to approve Resolution No. 87-382. The vote
passed with Councilmember Ferguson absent.

Resolution No. 87-383 A proposed Resolution approving the
Engineer's Report for the Parks Maintenance Assessment
District No AD-85-1 for the fiscal year commencing July 1,
1987 and ending June 30, 1988. John Knipe gave an overview
of the Engineer's Report. It was additionally reported that
Peach Hill Park has $60,000 included for maintenance of the
Park and there is a maintenance agreement with the developer
for one year. The following Motion was then heard.
MOTION: Councilmember Perez moved and Councilmember Brown
seconded a Motion to approve Resolution No. 87-383. The voice
vote was unanimous with Councilmember Ferguson absent.
Councilmember Galloway expressed his displeasure with the Parks
Maintenance figures provided.
J. Resolution No 87-384 A proposed Resolution ordering the
annual assessments for the Moorpark Lighting and Landscape
Maintenance Assessment District No. AD-84-2 for the Fiscal
Year commencing July 1, 1987 and ending June 30, 1988 and
fixing a time and place for hearing objections thereto.
There being no discussion, the following motion was heard.
MOTION: Councilmember Brown moved and Councilmember Perez
seconded a Motion to approve Resolution No. 87-384. The voice
vote was unanimous with Councilmember Ferguson absent.
K. Resolution No 87-385 A proposed Resolution ordering the
annual assessments for the Parks Maintenance Assessment
District No AD-85-1 for the Fiscal Year commencing July 1,
1987 and ending June 30, 1988 and fixing a time and place
for hearing objections thereto.
There being no discussion, the following Motion was heard.
MOTION: Councilmember Perez moved and Councilmember Brown
seconded a Motion to approved Resolution No. 87-385. The voice
vote was unanimous with Councilmember Ferguson absent.
10. COMMENTS FROM COUNCILMEMBERS:
A. Councilmember Perez inquired how the City might get people to
conform to the truck weight regulations along Peach Hill Road.
Lt. Mike Brown stated that the Traffic Officer recently
employed by the City is being used to supplement control in
this area. The Police Department is also watching the Walnut
Canyon area. Trucks which come up Peach Hill Road are in
violation of the City's law. Lt. Brown further stated that his
Department will be utilizing Neighborhood Watch contacts to
further "get the word out". Councilmember Perez also inquired
about abandoned vehicles and asked what the City was doing with
this problem. City Manager Steven Kueny responded that the
City is responding to any and all citizen complaints.

B. Councilmember Brown commented that she had noted a tree
had been removed in what appeared to be the right-of-way along
Peach Hill Road. City Manager Kueny responded that a portion
of the trees appear to be in the right-of-way and that the City
will be sending letters to the residents concerning the City's
policies of tree removal. Councilmember Brown also commented
concerning children in her area from out of town who were
selling cookies. She inquired whether or not permits were
required to do so. Steven Kueny responded that a News Release
on this issue will be sent to local newspapers.
C. Councilmember Galloway reported the Youth Art Event went
well. He asked the City to present proclamations of
appreciation to the people who participated. He was to provide
a list of those people to the City Clerk. Councilmember
Galloway additionally commented that it was not a surprise that
trucks passed through Moorpark since there is a "Weigh Station
Closed" sign posted at the temporary Weigh Station west of the
City. Lt. Brown responded that Caltrans posted those signs as
a safety measure, so that trucks would not move to the right of
the roadway in preparation to stop at the Weigh Station and
then move quickly back into the lane of traffic when they
noticed the station was closed.
D. Mayor Harper reported that lights from storage sheds on
Poindexter seemed to be particularly bright. Steven Kueny
responded the City will review the situation. Additionally,
Mayor Harper commented that off -road vehicles seemed to be back
and asked Lt. Brown to increase patrol for these violators. He
additionally reported an abandoned vehicle on Marquette
Street. Lt. Brown reported the vehicle had been tagged on May
5, 1987 and probably will be towed next week, but the owner
does have some time before this action can be taken.
11. STAFF REPORTS/RECOMMENDED ACTION ITEMS:
B. Consider Revision of Ordinance No. 33 - An Ordinance Relating
to Commissions.
Staff's Recommendation was to ask Council to give Staff
direction in the preparation of a revised draft Ordinance.
B. 1. Mr. William Mason, 437 Shasta Avenue, Moorpark,
commented concerning Ordinance No. 33. It was his
feeling, since we have an election in June of 1987 that
the newly elected officials should have the right to
nominate or re -nominate someone of their choice to the
Commissions. He additionally felt the people should have
a right to know who a City Councilmember is considering
for nomination. He asked the City Council to take action
on this item so that the ordinance would be in effect
prior to the June election. After discussion, the City
Council continued this item by consensus to May 20, 1987.

C. Tierra Rejada Road and Bridqe Project
1. Consider the approval of an agreement for possession of
real property, Tierra Rejada Road, Moorpark, California.
Staff Recommendation was to approve the agreement
and authorize the Mayor to sign. Steven Kueny reported
that this property involves the Boething Family Trust,
and additionally reported concerning a slope easement
needed from Southern California Edison. SCE, however, is
not willing to give this to the City until the City
agrees to a cut in the street median, which Staff is not
recommending. After discussion, the Council directed the
Mayor to sign the possession agreement.
2. Consider awarding the Tierra Road and Bridge Project
Staff's recommendation was to award the bid. This item
was continued to May 20, 1987.
3. Consider the summary of approved expenditures and
request, for additional appropriation of funds.
Staff'srecommendation was to appropriate funds for the
project. This item was continued to May 20, 1987.
E. Consideration of meeting dates for a joint meeting between the
City Council and the Parks and Recreation Commission.
Staff's recommendation was to direct Staff to set a meeting
date and time. Jerry Forde, Director of Community Services,
gave a Staff Report dated April 27, 1987. Mayor Harper
commented he would like to have the meeting as soon as
possible. Councilmember Brown commented she would prefer to
wait until after the June election which is so close.
Councilmember Galloway commented that communication is
essential between the City Council and the Parks and Recreation
Commission. He would prefer that that communication come from
the Council as a whole. He felt there was a gross
misunderstanding in the role of the chairmanship on the Parks
and Recreation Commission. He additionally felt an apology was
warranted from the chairman and that the City Council ought to
respond to concerns which had been raised. He also stated the
Commission should be directed to operate under certain
guidelines. Councilmember Perez commented that a meeting
should be held as soon as possible; both bodies need to come to
a consensus of what the Commission's roles are. The following
Motion was then heard.
MOTION: Councilmember Galloway moved and Councilmember
Brown seconded a Motion to meet with the Parks and Recreation
Commission on May 18, 1987 at 6:15 p.m. The voice vote was
unanimous, with Councilmember Ferguson absent.

F. Consider an appeal of a denial for a time extension for the
wideningof a portion of New Los Angeles Avenue fronting
PM-3828 Southmark Corporation. Staff took no position on
this issue.
John Knipe gave the Staff Report dated April 29, 1987.
Councilmember Brown commented she would like to see the City
Council stand with their previous decision. Additionally, she
would prefer that road work be accomplished as soon as it is
warranted rather than after it has been proven that the work is
necessary. The following Motion was then heard.
MOTION: Councilmember Brown moved and Councilmember Perez
seconded a Motion to reaffirm the Council's previous action
which would result in no reconsideration of the appeal. The
voice vote was unanimous with Councilmember Ferguson absent.
G. Consider a proposal to remove 50 trees in the
Second, Third, Fourth Street/Sierra, Shasta Area. Staff's
recommendation was to approve the contract for professional
services to remove the trees. Councilmember Galloway commented
he would like to see an additional mechanism for replacement of
the gutters and trees, and also an incentive to homeowners for
their participation in the tree removal process. After further
discussion, this item was continued to May 20, 1987.
AT THIS POINT IN THE MEETING, the Council recessed, the time being 8:50
P.M. The Council, with Councilmember Ferguson absent, reconvened at 9:05
P.M.
L. Consideration of Support for Senate Bill 326 Relating to the
Ventura County Flood Control District. Staff's
recommendation was to support Senate Bill No. 326. Steven
Kueny gave the Staff Report dated May 6, 1987. He further
indicated the City might invite a Flood Control representative
to the City's next Council meeting. By consensus of Council,
this item was deferred to May 20, 1987.
M. Consideration of Partial Access to and Development of the 69-
Acre Community Park Site. Staff's recommendation was to
proceed as directed by the Council. This item was continued
to May 20, 1987.
N. Consider Pending Assembly Bills 2190 and 2191 concerning State
Mandated District Elections in Cities. Staff's
recommendation was to forward letters of concern as deemed
appropriate. Councilmember Brown moved and Councilmember Perez
seconded a Motion to prepare letters for the Mayor's signature
against the bills. The voice vote was unanimous with
Councilmember Ferguson absent.
AT THIS POINT IN THE MEETING, Councilmember Brown left the dais.

12. STAFF REPORTS/INFORMATION ITEMS:
A. A resort concerning the traffic signal warrant study at the
intersection of Moorpark Avenue and Poindexter Avenue First
Street. This report is to be brought back to the City
Council on May 20, 1987 by consensus of Council.
E. Report concerning the widening of Highway 118 through the
Virginia Colony area. By consensus of Council, Staff was
directed to take no further action until the Environmental
Impact Report on the widening is available. This report was
received and filed.
F. Report concerning a noise com laint near an industrial area.
Pat Richards gave a brief report dated May 8, 1987. He further
stated the problem is being resolved. By consensus of Council,
this report was received and filed.
13. FUTURE AGENDA ITEMS:
Councilmember Perez asked that Staff prepare a formal letter of
request for an example of an Affirmative Action plan from Mr. Briggs
and Mr. Hatcher of the NAACP. He further'asked that the Council hold
a Freeway Connector Strategy Session.
14. CLOSED SESSION:
The City Manager asked that an additional closed session be added to
the Agenda concerning potential litigation. Councilmember Perez
moved and Councilmember Galloway seconded a Motion to add to the
Agenda a Closed Session concerning potential litigation pursuant to
Government Code Section 54956.9(b)(1) as the need arose subsequent to
the posting of the Agenda. The voice vote was unanimous with
Councilmembers Brown and Ferguson absent. This was added to the
Agenda as Item 14C.
B. Personnel Session
Council then adjourned by consensus to discuss personnel
matters, the time being 9:40 p.m. At 9:56 p.m., Council
reconvened in Open Session.
C. Potential Litigation
At 9:57 p.m., Council adjourned to discuss potential
litigation pursuant to Government Code Section 54956.9(b)(1).
Council reconvened at 11:30 p.m.

15. ADJOURNMENT:
Councilmember Perez moved and Councilmember Galloway seconded a
Motion to adjourn to 6:00 p.m. on May 18, 1987 to discuss in Closed
Session, potential litigation and to convene in Open Session at 6:15
p.m. to conduct a joint meeting between the City Council and the
Parks and Recreation Commission. The voice vote was unanimous with
Councilmembers Brown and Ferguson absent.
