Establishment of Coordinator, Special Projects Position Written, pg.4 Written, pg.4 Written, pgs.4,23-25 Written, pgs.4,26-27 Written, pg.5 Written, pg.6 Written, pgs.6,28-31 Written, pgs.6,32 Written, pgs.6,33-35 Written, pgs.6,36 Written, pg.7 VnD n n n n n ACTION ACTION ACTION ACTION ACTION ACTION ACTION INFORMATION ACTION ACTION ACTION ACTION Moorpark Unified School District RESOLUTION NO. 1987-88-30 RESOLUTION OF THE BOARD OF EDUCATION FINDING THAT DISPOSITION OF THE SITE OF MOORPARK MEMORIAL HIGH SCHOOL IS IN THE BEST INTERESTS OF THE STUDENTS AND THE DISTRICT WHEREAS the assets of the Moorpark Unified School District are under the control and direction of the Board of Education, and those assets include certain real property in and about the City of Moorpark, County of Ventura, State of California; and WHEREAS the real property of the District includes a 29 acre High School site located at 280 Casey Road, commonly known as Moorpark Memorial High School; and WHEREAS the District is presently constructing a new high school facility on a site on Tierra Rejada Road, and intends to relocate the programs of the present High School. to the new site on or before September 1, 1988; and WHEREAS the Moorpark Unified School District is experiencing an enrollment growth rate in excess of 18% above the 1986-87 year, and the District must rely upon all of its existing assets in meeting its needs for school facilities and school sites to house the rapidly growing K-12 population; and WHEREAS the District's enrollment projections indicate a need for additional future schools in grades K-8, specifically an additional elementary school, expansion of the existing middle school or construction of an additional middle school and construction of a permanent facility for the Continuation High School program; and WHEREAS the State of California presently has not allocated funds to provide for the future site acquisition and facility construction for these needed schools, and the District. may be required to rely upon its own resources to provide sites and facilities; and WHEREAS the school site at 280 Casey Road is not a surplus school site, but rather a school site in a location not optimal for the District's present needs, and other school locations will better serve the population centers of the District; and WHEREAS State law provides that school districts may enter into agreements to exchange school district property for other property, and the law provides that districts may lease or sell their properties and acquire other properties, and the law provides that under such circumstances the value received by a growing school district for property may not be less than fair market value; and, -26- Resolution of the Board of Education Page 2 NOW, THEREFORE BE IT RESOLVED that the Board of Education of the Moorpark Unified School District hereby finds and declares that the disposition of the school site at 280 Casey Road is in the best interests of the students of the District, and that time is of the essence for such disposition because of the date for relocation of the High School program and the immediate and urgent need for the Distict to begin the planning and construction of its next elementary school. PASSED AND ADOPTED THIS 24th day of November, 1987 by the governing board of the Moorpark Unified School District of Ventura County, California, by the following vote: AYES: NOES: ABSENT: STATE OF CALIFORNIA, COUNTY OF VENTURA I, Michael R. Slater , (Authorized Agent) of the governing board of the Moorpark Unified School District of Ventura County, California, do hereby certify that the foregoing is a full, true, and correct copy of a resolution adopted by the said board at a regular meeting thereof held at its regular place of meeting at the time and by the vote above stated, which resolution is on file in the office of the said board. 7" Authorized Agent TOD:SITE—RES BUILDING (cont'd) 15. It is recommended that the Board take the following action with regard to the disposition of the school site at 280 Casey Road: a) Authorize and direct staff to proceed with the legal notice provisions of State law regarding disposition of school district property. b) Authorize and direct staff to enter into an agreement for services with a qualified consultant, who is experienced in and knowledgeable about the lease and sale of school sites, with the total fee not to exceed an amount equal to 2.50 of the gross proceeds from the disposition.- c) Authorize and direct staff to enter into an agreement for services with a land use planner and/or civil engineer for the creation of a site use plan to be used in the disposition process. Any fee for such services shall not exceed an amount to be determined at the November 24, 1987, Board meeting. d) Authorize and direct staff to work with the consultant to negotiate a lease and/or sale of the site which will maximize the income and benefits to the District. Any such proposed agreement for lease and/or sale shall be brought to the Board of Education for approval. e) Authorize and direct staff to investigate any methods of lease and/or sale which will allow the City of Moorpark to acquire a portion of the site for a park or other recreational use, so long as the District does not receive less income than it might otherwise have received from any other lease and/or sale of the entire site. f) Authorize staff to consider the needs of the District for short term use of some facilities at the Casey Road site, such as the football stadium, the auditorium and maintenance shop facilities in its negotiations for any lease and/or sale. g) Direct staff to report its activities and progress on these directives to the Board on a regular basis in such form and manner as shall be appropriate.
