MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Roger Pichardo, Program Manager DATE: 03/06/2024 Regular Meeting SUBJECT: Consider Senate Bill (SB) 1383 Local Assistance Grant Program Fiscal Year (FY) 2022/23 and Adopt Resolution Authorizing City Manager to Submit Grant Application to California Department of Resources Recycling and Recovery (CalRecycle), and Rescinding Resolution No. 2023-4217 BACKGROUND The California Department of Resources and Recovery (CalRecycle) offers the Senate Bill (SB) 1383 Local Assistance Grant Program FY 2022/23 Pursuant to Chapter 395, Statutes of 2016. This noncompetitive grant program will provide funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383. The term of the Program begins April 1, 2024, and ends April 2, 2026. Program expenditures may start no earlier than the date of the award of funds. On February 5, 2024, the City received notice from CalRecycle that not all jurisdictions applied for the subject grant funding. Therefore, the remaining funds, along with additional funds that became available, will be redistributed to the jurisdictions that applied, increasing the amount the City of Moorpark will receive. Although, Resolution No. 2023-4217 authorized the City to receive grant funds under the Program in FY 2023/24, that authorization referenced the FY 2022/23 estimated allocation and does not provide a provision whereby the City can accept any additional funding over the amount stated in the City’s Resolution, which is $77,305.00. Thus, the proposed Resolution authorizes the City Manager to accept additional grant funds to implement the regulation requirements associated with SB 1383. DISCUSSION Under the terms of the CalRecycle SB 1383 Local Assistance Grant Program FY 2022/23, the City of Moorpark is eligible to apply for grant funding to assist with the implementation of regulation requirements associated with SB 1383. CalRecycle grant funding can be used to support a variety of program areas related to SB 1383, such as planning, edible Item: 10.C. 220 Honorable City Council 03/06/2024 Regular Meeting Page 2 food recovery and collection, education and outreach, program enforcement and inspection services, program evaluation and gap analysis, and record keeping. Additionally, grant funding can be used for the procurement of locally recovered organic waste products, such as mulch and compost. Currently, the City allocates $25,000 annually for the procurement of mulch that is spread in the parks. This grant funding could help offset those costs, resulting in savings to the General Fund. Allocation to recipients is calculated on a per capita basis using the Department of Finance’s population statistics. The Program application, which was due on November 15, 2023, and submitted prior to the deadline, contained an approved grant Resolution adopted by the City Council on October 18, 2023, authorizing the submission of the application and identifying the individual(s) authorized to execute any agreements, contracts, and requests for payments in the amount of $77,305. However, since other cities did not apply for grant funding, additional funds will be distributed to the applicants that did apply, based on population. For the City to be eligible for approximately $21,812 in additional funds, staff recommends rescinding Resolution No. 2023-4217 and adopting a new Resolution with a provision that allows the City Manager to accept all grant funding available through the CalRecycle Grant Program. Program expenditures do not require applicants to provide cost-share or matching funds. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT Awarded state grant funds will be used for Program expenditures throughout the course of the grant's term and will be budgeted accordingly in the Solid Waste Fund. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) 1.Adopt Resolution No. 2024-____, authorizing the City Manager or their designee to submit an application to CalRecycle, to execute any forms necessary to secure SB 1383 Local Assistance Grant Program funds, and carry out the specified activities required by CalRecycle; and 2.Rescind Resolution No. 2023-4217. Attachment: Draft Resolution No. 2024-____ 221 RESOLUTION NO. 2024-_____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR SENATE BILL (SB) 1383 LOCAL GRANT ASSISTANCE PROGRAM THROUGH THE STATE OF CALIFORNIA, CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY, AND RESCINDING RESOLUTION NO. 2023-4217 WHEREAS, Public Resources Code sections 48000 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle) to administer various grant programs (grants) in furtherance of the State of California’s (state) efforts to reduce, recycle and reuse solid waste generated in the state thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the application, awarding, and management of the grants; and WHEREAS, CalRecycle grant application procedures require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of CalRecycle grants; and WHEREAS, the City Council adopted Resolution No. 2023-4217 authorizing the City Manager or their designee to submit an application to CalRecycle, to execute any forms necessary to secure SB 1383 Local Assistance Grant Program Funds, and carry out the specified activities required by CalRecyle. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Manager or Designee is hereby authorized and empowered to execute in the name of the City of Moorpark all grant documents, including but not limited to, applications, agreements, amendments, and requests for payment, necessary to secure grant funds and implement the approved grant project. SECTION 2. These authorizations are effective for five (5) years from the date of adoption of this resolution. SECTION 3. Resolution No. 2023-4217 shall be rescinded with the Resolution herein upon its effective date. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
