Information concerning the composition of the Moorpark
Mosquito Abatement District (M.M.A.D.)
At your meeting of February 3, 1988, staff was asked to determine under what
authority the abatement di strict had been formed, and whether there were
statutes which determined how appointments to the district were made.
M.M.A.D. was formed by the Ventura County Board of Supervisors pursuant to
Health and Safety Code Section 2215.5 in October of 1960. At the time of
formation, the district consisted wholly of unincorporated territory. This
being the case, it was the Board of Supervisors who was the appointing
authority for all five members to the district's board (Health and Safety
Code Section 2240(a). Since the district's formation, Moorpark
incorporated. Today the incorporated area of the City makes up
approximately 40% of the district.
According to Health and Safety Code Section 2240, if a district is situated
in one county only and includes both incorporated and unincorporated
territory, one member may be appointed from the district at large by the
board of supervisors, and one member may be appointed from each city which
is situated in the district. If this method does not result in a five
member board (the minimum number required), then the board of supervisors
shall appoint from the district at large enough additional members to make a
board of five members.
There is a provision which allows for the increase or decrease in the number
of members of the district board who represent unincorporated territory in
the district. However, there is not a similar provision allowing for the
increase or decrease in the number of those who represent incorporated
areas.
