Cases Currently Being Handled A. Cases Pending at Court Level 1. Dumping in the Arroyo Three individuals were cited and released for illegal dumping in the Arroyo area. All three went to court. One man pleaded guilty and was fined $50.00. The other 2 men pleaded not guilty and requested a jury trial. They contended that the dumping took place in the County. City of Moorpark was unable to argue this point without survey. City withdrew court action. 2. ' 480 Moorpark - Pete's Auto Body Case is based on a illegal non -conforming use relating to a spray paint booth in a CPD zone. City attorney reviewed the case and felt it would be better to approve their request for zone clearance rather than proceed in court. 3. 13840 E. L.A. Ave. Riddle Rental Code enforcement has worked for 7 months with Mr. Riddle and is unable to gain voluntary compliance. This case relates to numerous code violations including zoning, building codes, disable vehicles and trash/debris. City attorney has reviewed this case and will hold a shown cause hearing before proceeding to court. V. Cases before the Planning Commission 1. 4661 Adonis - Boat Violation Mr. Hamamura's request to appeal the Ditor's decision has been denied by the Planning Commission and forwarded to the City Council for resolution by requesting access to his rear yard over a City's dedication of access rights. PJR:crl CODE/W/CHRONI February 12, 1988 Page 5 2. Substandard Structure 4389 L.A. Ave. Apostolic Church. First notification letter has been sent to the church. The church is planning to demolish the structure but as of this date has not taken out demolishing permits. Second letter of notification will be sent. 3. Substandard Structure and Living Conditions a. 14476 Avenue Colonia b. 14476 Avenue Colonia C. 97 First Street Several follow up inspection's with property owners has been made. Letters of follow-up inspections noting each violation and compliance has been mailed to property owners. A third property inspection will be made with owners on February 11, 1988. Note: Code Enforcement is experiencing a problem with enforcing the abatement of dangerous buildings. The law requires the expertise of a building official to first determine the conditions of the structure. With the County soon to terminate service they appear reluctant to start an enforcement action with the City. City of Moorpark is reluctant to pay Ventura County for an inspector's opinion. 4. Substandard Living Conditions a. 142 First Street b. 147 First Street C. 149 First Street Initial and follow up inspection with the property owners have been made. Violations have been discussed and compliance date set. A second follow up inspection with the property owner will be held on February 11, 1988. 5. Overcrowding (Millard St Esther Ave., Dorothy Ave. Sarah Ave. Approximately 250 hours have been spent from July 87 to February 88 inspecting overcrowding complaints within this area. PJR:crl CODE/W/CHRONI February 12, 1988 Page 6 For the past 3 months code enforcement has been working closely with a farm labor specialist to reduce the rate of over crowding by migrant farm workers. Although several such locations have been identified, none are in the area of concern. Inspections are made of all residents reported to have overcrowding problems, but the large number of people allegedly living in these residents are gone on arrival. With the onset of spring crops the overcrowding complaints will surface again. Due to this fact prior complaints have been left open. 6. Neighborhood Clean Up Program Approximately 12 hours were spent on this program First clean up program of 1988 was held on Saturday January 30, 1988. The event was published by local newspapers and flyers that were distributed to every commercial business in the City of Moorpark. Anderson Rubbish Company volunteered 3-thirty yard bins and a driver to help with unloading. The Jaycees volunteered their time helping with traffic control, unloading of rubbish and pick up of rubbish for disabled or senior citizens. Simi Valley landfill again donated a disposal area for the rubbish collected. There were about 30 to 40 families who took advantage of the clean up program. 7. Grading at the West End of Avenida Colonia Avenida Colonia residents, along with building and safety, police, fire, water, Southern California Edison and the telephone company were contacted and interviewed in regard to the grading at the west end of Avenida Colonia. A report summarizing the interviews has been written and is being reviewed by the City Manager. The interviews and written report took approximately 18 hours to complete. PJ R:crl CODE/W/CHRONI February 12, 1988 Page 7 VI. Realignment of Bail Schedule Estimated time allotment for bail schedule 40-60 hours. Ventura County courts requested that all cities within the county realign their bail schedules. On inspection of the current bail schedules it was discovered that the City of Moorpark is not even on the court computer system. Code enforcement has spent 4-6 hours reviewing current Municipal Codes. Additional time will be required to identify the most widely used codes. Codes hat have been adopted by reference such as he Uniform Building Code will have to take on Municipal code numbering before being accepted by the court computer. This is also a good time to adopt new or amend old codes such as peddlers exemption or a law to prohibit urinating in public. Once the City has decided which Municipal Codes will be cited a reasonable bail will be set for each offense. Finally the municipal codes and bail must be adopted by the court. Vll. Exemption for Religious and Non -Profit Solicitors Code enforcement spent approximately 8-10 hours. in the researching and writing of a solicitors exemption for religious and non-profit organizations. This report is ready for City Council's review. Vlll. Signs at Illegal Dump Sites Approximately 10 hours were utilized in determining the most flagrant illegal dump sites within the City. This time also covered the research of type of signs, cost of signs and installation cost involved with the posting. IX. City First Notice to Appear 10-15 hours spent on development of "Notice to Appear'. Code enforcement has been working in conjunction with the Judicial Council of California to establish the City's first "notice to appear." This citation has been designed to accommodate any present or future issuing body within the City government. The City has received the final approval by the judicial court and citations are presently being printed. PJ R: crl CODE/W/CHRONI February 12, 1988 Page 8 X. Graffiti 35 hours allotted for research into graffiti in Moorpark. Research was done to determine the amounts, locations, removal and means to detour further graffiti within the City of Moorpark. A report has been written and is ready for the Council's review. XI. Newracks 10 hours have been used to research the issues related. Newsracks within the City have been inspected and violations noted. Durfree Distributors have been notified by certified mail of City intention to impound newsracks should violations fail to be corrected within 15 days. Since this notification, the City has learned not all newsracks in Moorpark are owned by Durfree Distributors. Research will be followed to determine who owns other existing new racks. XII. Building Zoning Code Violations 1. 362 High Street Structures built without zoning or building permits. 2. 14110 E. L.A. Avenue - Iron Fabricators Structure built without zoning or building permit. Incorrect storage of flammable liquids. 3. 13950 E. L.A. Avenue - Mobil Truck Repair Junk yard in M-2 zone - hazardous waste dumped on the ground. 4. 75 Wicks Road - Mr. Brown, resident. Eight structures built without building permits. XIII. Short Term Goals - Within 6 months 1. Continue to work with pending cases and handle new complaints as they come in. 2.
