Right-of-Way Acquisition (Moorpark West)
BACKGROUND INFORMATION

The purpose of this memo is to inform the Council that the
executed documents have finally been received by the city
Engineer's office and forwarded to the City Clerk for
execution of the Certificate of Acceptance of Deed and
recordation. The original Grant Deed previously executed by
Country Properties, Inc. was not recorded due to
irregularities in the signature format. Because the
property changed hands shortly after the Grant Deed was
executed, it was necessary to obtain a new litigation
guarantee, prepare a new Grant Deed, obtain City Attorney
review and approval of the new Grant Deed, and obtain
notarized execution of the new Grant Deed by the new
property owner, Moorpark West.
The city Manager is currently attempting to finalize the
acquisition of the last two parcels of right-of-way
necessary for this project. For one of these parcels
(Boles) a Grant Deed a-nd Purchase Agreement have been
executed but the Grant Deed has not yet been recorded due to
paper work problems associated with a partial reconveyance
of title from a lender. Acquisition of the remaining
parcel (Gisler) is subject to ongoing negotiations.
