SUBJECT: ACCEPTANCE OF MONEY AND DESIGNATION OF NEW FUND FOR BICYCLE/EQUESTRIAN TRAIL PURPOSES
On August 19, 1987, the City Council agreed to obtain a deposit from the developer of PD1010 (Palmer) for the estimated cost of the equestrian/bike trail adjacent to the project. This deposit was to be in lieu of the developer's construction of the subject trail adjacent to his project. The City Engineer estimated the cost at $17,000.00 including construction contingency and engineering costs. After a review with the developer's engineer, it was agreed that a deposit of $16,000.00 would be acceptable. The Council needs to consider two actions:
1.Acceptance of the $16,000.00 deposit, and2.Where to place the funds.
It is recomme nded that this $16,000.00 amount be accepted and that these funds be placed in a newly created fund entitled "Arroyo Simi Bicycle/Equestrian Trial". By placing this deposit into a separate fund, it will indicate the Council's support for the future construction of the trail and assure that the funds do not inadvertently become co-mingled with other deposits held by the City.
STAFF RECOMMENDATIONS:
1.Accept the $16,000.00 from G. H. Palmer for the futureconstruction of the bicycle/equestrian trail adjacent to PD1010.2.Designate a new fund entitled "Arroyo Simi Bicycle/EquestrianTrail and place $16,000.00 in this fund.

SUBJECT: PD-1010 (Palmer) Bicycle/Equestrian Trail Deposit
Enclosed is a deposit of $16,000 for the future construction of the Bicycle/Equestrian Trail \t,ithin PD-1010 (Palmer). This deposit is submitted in lieu o� constructing the trail.
Based on the City Council action of August 19, 19 87, this deposit satisfies the condition of appr oval requiring construction of the Bike/Equestrian Trail for PD-1010.

Another option would be for the City to obtain a deposit from Palmer for the estimated costs of the trail and hold these funds in the City Treasury until such time as it has been determined exactly where the trail can be located or until such a time as there is a demonstrated need for the trail. Currently, the trail would lead to nowhere because there are no other portions of the trail in existence along the bank of the Arroyo.
The developer, Palmer, is anxious to satisfy this condition of development and is willing to either build the trail or deposit the money with the City.
RECOMMENDED ACTION
It is recommended that the City Council directs staff to proceed with one of the following options:
1.Construct the equestrian/bike trail adjacent tothe tennis court and basketball court as shown onthe attached print (Sheet 11 of 22); or,
2.Obtain a deposit from the developer (Palmer) forthe estimated cost of the equestrian/bike path andhold this money on deposit until after theimprovements have been made to the Arroyo or it isbeen determined that a legitimate need exists toconstruct the equestrian/bike trail.
