GENOVESE City Treasurer MEMORANDUM T O : The Honorable City Council FROM : Steve Kueny, City Manager DATE : September 11 , 1987 SUBJECT : Response to the Draft Environmental Impact Statement for the 118/23 Freeway Connection At the September 2, 1937 meeting the Council decided: 1 . to defer formal response to the EIS until after the scheduled September 14 , 1987 Public Hearing. 2. to direct the Director of Community Development to review the environmental checklist for comment con- cerning CalTrans ' response. 3 . to direct the Planning Commission to: a. ) Assess the impacts/merits of ramps at Princeton versus Condor in the Campus Park area and determine if there is a preference; and b. ) Review impacts on the Tierra Rejada Road area and Campus Park area in the event the freeway connection alignment is south of the Arroyo Simi. Items 2 and 3, above are addressed in a separate report prepared by the Director of Community Development and attached hereto. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 4 . add the following comments to those addressed in the August 28 , 1987 report : a. ) Ask CalTrans to include a review of other projects statewide where the residential impact (people) received priority over biological , physical or other similar factors . This was intended to consider possible relocation of the wetlands habitiat. One possible location might be to an area north of the freeway alignment . b. ) Sources of the water for the wetlands area and percentage of each including upstream sewer plant - effluent . c. ) LOS at key intersection for both project and no project d. ) Alternative local sites for any excess material other than the Simi Valley Landfill . e. ) Consideration of a possible freeway connector alternative south of the Arroyo Simi was to be more prominately mentioned. In addition to the comments above, I suggest reiterating a point previously made by the City that regardless of the alignment, ultimately the Collins Drive interchange accommodate the extension of New Los Angeles Avenue. RECOMMENDED ACTION Finalize comments and direct Mayor to send letter with City' s final comments to CalTrans prior to September 30 , 1987 . For Moorpark, the Director of Community Development, Assistant City Engineer and City Manager participated in the meeting. It is felt that there are a number of deficiencies and questions concerning the information contained in the Draft EIS. Each of the cities will be preparing separate written comments to CalTrans. While most of the potential impacts are localized for Moorpark, it is apparent that the study limits should be expanded to include portions of Route 23 and Route 118 outside of Moorpark. A possible expanded limit could include Route 23 to its interchange with Route 101 and Route 118 to its interchange with Route 27 (Topanga Canyon) . The other two cities will be requesting the expanded study limits so that potential traffic, noise, air qualitiy and growth inducing impacts are discussed for those areas. As recommended by staff the City Council is to review the proposed written comments to the Draft EIS. After review, a comprehensive set of comments will be forwarded to CalTrans. The Council may want to wait until after the scheduled September 14, 1987 public hearing to complete its discussion and direction to staff regarding concerns with the information in the Draft EIS. The following comments and concerns are the collective efforts of the Director of Community Development, City Engineer' s office and City Manager. The staff concerns are as follows: 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 A. TRAFFIC 1 . What happens to traffic projections if a portion of Los Angeles Avenue ( 118) does not build out to 6 lanes by 1992 or when the gap is closed? Is additional ROW needed on a portion of 118 between Spring Road and Moorpark Avenue to accomodate 6 lanes. 2 . Explain the 100-300% increase relative to highway 23 ( I-5) ; does it refer to both north and south of New Los Angeles Ave. ? 3 . Projected LOS at key surface 118/23 intersections in 1995, 2000, 2010 particularly Spring Road at - New Los Angeles Ave. . 4. Impact of reduced median width from 90 tot2155 Set on uture lane additions. ( S-6) 5 . Why is less Lraffic projected if freeway i."not built? Why is percentage of truck traffic cut in half? Explain projections. (S-1, I-1, IV-27) 6. Explain how no traffic disruption will occur during construction on 118. ( IV-27 ) 7 . Clarify signal locations identified on pages I-4 & 5. 8 . More discussion is needed on statement that "There is not enough capacity available on Route 101 to accomodate any significant excess traffic from Route 118. " ( I-4) B. WETLAND - STREAM BED 1 . Is the wetland considered natural or man made. Does it make a difference? 2 . The alternative for the replacement of wetland does not have a recommendation or dollar cost. 3 . Is it appropriate to wait for final design plans to determine the wetland replacement alternative selection? ( IV-14) 4. How can the wetland impact be completely avoided. 5 . Allow local public agencies to review approval on final stream relocation. C. OAK TREE DISCUSSION Provide a more detailed analysis of size, age, location, ability to avoid, etc . Is 2 : 1 replacement ratio adequate mitigation? D. NOISE 1 . Impact on residences on Los Angeles Ave. (Surface 118) between Spring Road and Moorpark Ave. especially if it goes to 6 lanes. 2 . What is the predicted noise level for sites 7, 6A & 4. 3 . Is there any impact on existing freeway 23 & 118 south and north, and east and west respectively, of the study area. E. AESTHETICS 1. They should consider use of contour grading. 2 . Landscaping should be provided with project. 3 . Appropriate bridge designs should be included subject to local review and approval . F. ARCHEOLOGICAL Should include a mitigation measure similar to that for paleontology G. EXCESS MATERIAL 1 . Impact if any on life of existing Simi Valley Landfill . 2 . Number and impact of vehicle trips on existing route to landfill . H. DEMOGRAPHICS 1. The quoted 5% growth rate is valid only through 1989 then it would slowly decline through 1995 pursuant to the City' s growth control ordinance. 2 . Information should be updated. it appears much of the information was generated in 1982 when this document was first undertaken. 3 . ( IV-27 & 28) Regarding growth inducing impacts - certain statements implying cause and effect are not necessarily true. I . The potential for valley fever was not addressed. The matter of dust alleviation was handled in only two sentences on page IV-35 . Existing homes are in the path of prevailing winds, more than water may be needed, e.g. chemical treatment and restrictions on grading during windy conditions J. GENERAL COMMENTS 1 . City limit is westerly not easterly of Gabbert Road (S-7 ) . 2 . City incorporated in 1983 not 1984 ( III-1) . 3 . Construction costs should be specified in 1987 dollars or as otherwise estimated 4. Consideration of a freeway connector alternative, south of the Arroyo Simi alignment including cost estimates and analysis of impacts. The City Engineer is also prepared to discuss the three "build" alternative alignments included in the Draft EIS. The City Council also needs to finalize its action concerning a continuance of the September 14 public hearing. As previously discussed, the intention of this action is to allow time for CalTrans to develop supplemental information and for the public and public agencies to respond to the new information. RECOMMENDED ACTION: 1. Direct staff as deemed appropriate concerning written comments to the Draft EIS. 2 . Direct Mayor to send letter requesting CalTrans to conduct September 14, 1987 public hearing and to continue it to allow for additional testimony. / /-47). J September 3, 1987 Mr. W. B. We feel that CalTrans should proceed with the public hearing scheduled for September 14, 1987 but that the hearing be continued for an approximate sixty (60) day period. This continuance will allow for written and oral comments to any supplemental information `developed by CalTrans. We feel that this minor delay will help insure that the information contained in the EIS is accurate and complete. Preparation of a comprehensive environmental document will allow the project to proceed consistent with the established schedule. Richards, Director of Community Development DATE: September 8, 1987 SUBJECT: ENVIRONMENTAL SIGNIFICANCE CHECKLIST - DRAFT ENVIRONMENTAL IMPACT STATEMENT FREEWAY GAP CLOSURE ROUTES 23 AND 118 Background The City Council; at its regular meeting of September 2, 1987 considered the City' s responses to the Draft Environmental Impact Statement for the 23/118 freeway connection and alternative alignments. At this meeting the Council requested the Director of Community Development to review the Environmental Significance Checklist (Initial Study) and list those answers which were found to be in disagreement. Discussion Section 15063 (c) of the California Environmental Quality Act (CEQA) Guidelines list the purpose of an Initial Study as: 1. To provide the Lead Agency with information to use as the basis for deciding whether to prepare an EIR or Negative Declaration; 2. To enable an applicant or Lead Agency to modify a project, mitigation adverse impacts before an EIR is prepared, thereby enabling the project to qualify for a Negative Declaration; 3. To assist the preparation of an EIR, if one is required, by: a. Focusing the EIR on the effects determined to be significant, b. Identifying the effects determined not to be significant, and c. Explaining the reasons for determining that potentially significant effects would not be significant. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council September 8, 1987 Page 2 Therefore, one of the primary reasons for conducting an initial study is to help focus the EIR (or EIS). If the initial study does not identify that a specific matter has significant environmental effects, it may not receive proper analysis as part of the EIR (or EIS) preparation. Section 15064(d) of the CEQA Guidelines requires for an evaluation of both the direct and indirect environmental consequences of a project. Primary are such matters as dust, noise, and traffic caused by the project. Indirect effects are those such as growth inducing. Checklist Review The following is a listing of those answers within the Environmental Significance checklist (Initial Study) which the Director of Community Development does not agree with. Physical 1. Yes/Yes - The project will significantly alter the topography of the area north of Los Angeles Avenue west of Virgina Colony. Also, depending on which mitigation measure is used there may be a significant earthen berm places between the freeway and existing residences. 16. Yes/No - The project will cause an increase in the number of vehicle trips per day and will therefore cause an increase in the amount of air pollutant. Should not cause significant effect on the ambient air quality but will add to the cumulative poor quality within the region. 17. Yes/No - The project may cause odors produced from cars and trucks exhaust to travel in a northeast flow because of prevailing winds moving in that direction. 19. Yes/Yes - The project will cause a rise in the ambient noise level upon completion and may cause an increase in the future with higher traffic volumes. Also, the intermittent noise will increase with the project. 21. Yes/Yes - A portion of the adjacent residential uses will look down upon the proposed project. Substantial new lighting will be places at intersections and freeway on-ramps causing an increase in the night time glare. This project will produce a substantial increase in new lighting/ 26. Yes/No - The project will fill a portion of an existing wetland. Social and Economic 31. Yes/Yes - The California Urban Strategy promotes the concept of infilling and not promoting growth inducing effects. This project has the potential to open up the north eastern portion of the City for future development. 23/118/CCITEMS The Honorable City Council September 8, 1987 Page 3 33. Yes/Yes - The convenience this project will cause and affect the location, distribution, density and growth rate of the entire eastern portion of Ventura County. 34. Yes/Yes - The project will have direct and indirect affects upon the life styles of those who reside within proximity. The neighborhood character and stability will be affected in the way the project actually physically changes (such as noise, odor etc. ) or perceives to change it as an area no longer desirable as a living environment. 39. Yes/Yes - The project will cause some changes in property values both positive and negative. To what degree is unknown at this time. 42. Yes/Yes - Present circulation brings vehicle trips on to City streets and State highway within the city' s central core. The project will reroute people and goods away from these areas. However, a larger portion of the vehicle trips produced by the project will still travel westward. 51. Yes/Yes - The construction activities are expected to take several years therefore they are of significant note. Recommendation 1. Include the Director' s comments within the response to the Draft Environmental Impact Statement for the 23/118 Freeway Connection and Alternative Alignments; or 2. Modify the Director' s comments and then forward as part of the City response; or 3. Richards, Director of Community Development DATE: September 10, 1987 SUBJECT: PLANNING COMMISSION'S REVIEW - DEVELOPMENT OF ALTERNATIVE FREEWAY ALTERNATIVE FREEWAY ALIGNMENT IMPACTS Background At the August 26, 1987 City Council meeting the Planning Commission was directed to review two aspects of the proposed 118/23 Freeway connection. First, the Council desired the Commission to assess the relative impacts/merits of freeway entry//exit ramps at Princeton Avenue versus Condor Road in the Campus Park area and determine if there was a preference. Second, the Council desired the Commission to review the impacts on the Tierra Rejada Road area and the Campus Park area in the event the freeway connection alignment is south of the Arroyo Simi . The Planning Commission considered the Council ' s request at their meeting of September 8, 1987, Chairman Holland was absent with cause. Commission Comments Two of the Commission members favored the Condor Road freeway entry/exit ramp proposal because it took traffic away from adjacent homes. However, they did state that it was a difficult design and made even more complex because of signal locations. Two of the Commissioners stated that there was not enough information to state a preference at this time. One noted that the Condor Road design had "merit" for consideration but the details were not clear enough to make a decision. The Princeton Avenue design "looks" better and may provide a better design considering safety as the issue. Regarding the second matter for discussion; the Commission was unanimous in it' s comments regarding a lack of information regarding the southern alignment. A press release has been forwarded to all the local newspapers regarding this matter. DISCUSSION The location of freeway ramps can have dramatic impacts on existing and future land use consideration. The direction and location of such also affects future traffic circulation patterns. The interplay between the two considerations is quite pronounced with this freeway connection. It would appear that at present whatever decisions are made towards freeway ramp locations or alignment will dictate future land use decisions. Staff has prepared several exhibits to and the Commission in your discussions which are attached to this memorandum. The City Council is most anxious to receive the Commissions comments as soon as possible.
