ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, REPEALING SECTION 12.01.460 OF
TITLE 12 OF THE MOORPARK MUNICIPAL CODE,
AND REPEALING SECTION 7120 OF CHAPTER 1 OF
DIVISION 7 OF THE VENTURA COUNTY ORDINANCE
CODE, ADOPTED SEPTEMBER 211 1983, PERTAINING
TO TRAINS BLOCKING CROSSINGS.
THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA.
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Section 12.01.460 of Title 12 of the
Moorpark Municipal Code, pertaining to trains blocking crossings,
is hereby repealed.
SECTION 2, That Section 7120 of Chapter 1 of Division 7
of the Ventura County Ordinance Code, adopted Septebmer 21, 1983,
pertaining to railroad crossings, is hereby repealed.
SECTION 3. That this ordinance shall take effect
thirty (30) days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the passage
and adoption of this ordinance; shall enter the same in the book of
original ordinances of said City; shall make a minute of the passage
and adoption thereof in the records of the procedings of the
City Council at which the same is passed and adopted; and shall,
within fifteen (15) days after the passage and adoption thereof,
cause the same to be published once in the Moorpark News, a weekly
newspaper of general circulation, as defined in Section 6008 of
the Government Code, for the City of Moorpark, and which is hereby
designated for that purpose.

SUBJECT: ORDINANCE MODIFICATION
The existing Moorpark Municipal Code section dealing with trains
blocking railroad crossings is inconsistent with the Public Utilities
Commission regulation regarding the same subject.
M.M.C. section 12.01.460 Trains Blacking Cro�ssingss - sets a maxi-
mum limit of five (5) minutes time fora cross ngi to he blocked.
General order number 135 of the P.U.C. delineates a maximum time
period of ten (10) minutes that a crossing can be blocked.
The P.U.C. regulations supercede local ordinance regulations under
usual circumstances. Therefore, our ordinance should be modified to
reflect the ten minute time restriction.
RECOMMENDATION - Modify existing ordinance from 5 minutes to 10 minutes.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA,
AMENDING SECTION 12.01.460 OF TITLE 12 OF THE
MOORPARK MUNICIPAL CODE RELATING TO TRAINS
BLOCKING CROSSINGS.
THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Section 12.01.460 of Title 12 of the
Moorpark Municipal Code is hereby amended to read as follows:
"Section 12.01.460. Trains blocking crossings.
No person shall operate any train or train of
cars or cause or permit the same to remain stand-
ing so as to block the movement of traffic upon
any public street or highway within the City for
a period of time longer than ten (10) minutes."
SECTION 2. The City Clerk shall, within 15 days after
the passage of this ordinance, cause it to be posted in at least
the three public places designated by resolution of the City Council;
shall certify to the adoption and posting of this ordinance; and
shall cause this ordinance and its certification, together with proof
of posting, to be entered in the book of ordinances of this City.
