Consider Ordinance for the First Amendment to Development Agreement No. 2016-01 Between the City of Moorpark and M.P. Group LLC, Moorpark Homes LLC, and CLP Investment LLC Allowing the Payment of an In-lieu Fee for the Project's Affordable Housing Obligation, Eliminating the On-site Affordable Housing Obligation, and Making other Adjustments to the Development Agreement; Consider Resolution Amending the Conditions of Approval for Residential Planned Development Permit No. 2016-01; and Making a Determination of Exemption Pursuant to the California Environmental Quality Act in Connection Therewithin, on the Application of Nelson Chung of Pacific Communities (on Behalf of M.P. Group LLC, Moorpark Homes LLC, and CLP Investment LLC). Planning Commission Recommendation: 1) Open the public hearing, accept public testimony, and close the public hearing; and 2) Introduce Ordinance No. approving the First Amendment to Development Agreement between the City of Moorpark and M.P. Group LLC, Moorpark Homes LLC, and CLP Investment LLC allowing the payment of an in-lieu fee for the project's affordable housing obligation, eliminating the on- site affordable housing obligation and making other adjustments to the development agreement for first reading, waive full reading, and place this Ordinance on the agenda for May 1, 2024, for purposes of providing second reading and adoption of the Ordinance; and 3) Adopt Resolution No. 2024- approving amendments to the Conditions of Approval ("COA") for Residential Planned Development ("RPD") Permit No. 2016-01 , and finding the project Exempt from the California Environmental Quality Act (CEQA). Consider Resolution Approving California Highway Patrol Tenant Improvements at Moorpark Police Services Center, Authorizing the City Manager to Execute an Agreement with the County of Ventura to Construct the Improvements, and Amending the Fiscal Year (FY) 2023/24 Budget in the amount of $462,986.70 for Construction Services. Staff Recommendation: Adopt Resolution No. 2024- , approving California Highway Patrol Tenant Improvements at Moorpark Police Services Center, Authorizing the City Manager to Execute an Agreement with the County of Ventura to Construct the Improvements, and Amending the FY 2023/24 Budget for Construction Services. Consider Authorizing the City Manager to Execute an Eight-Year Lease with the State of California for California Highway Patrol (CHP) Space Within the Moorpark Police Services Center at 610 Spring Road. Staff Recommendation: Authorize the City Manager to Execute an Eight-Year Lease with the State of California for California Highway Patrol (CHP) Space Within the Moorpark Police Services Center at 610 Spring Road, subject to final language approval by the City Manager, and authorize the City Manager to approve a change order to reimburse the City for architectural and design services related to the lease space expansion. Consider Report of Annual Development Agreement Review, Established in Connection with Residential Planned Development No. 2016-01 (Pacific Communities), Located South of Los Angeles Avenue, East of Maureen Lane, and West of Leta Yancy Road, on the Application of MP Group, LLC, Moorpark Homes, LLC, and CLP Investment, LLC. Staff Recommendation: 1) Accept the Community Development Director's report and recommendation that, on the basis of substantial evidence, MP Group, LLC, Moorpark Homes, LLC, and CLP Investment, LLC has complied in good faith with the terms and conditions of the agreement; and 2) Deem the 2024 annual review process for this project complete.
