HomeMy WebLinkAboutAGENDA REPORT 1988 1026 CC ADJ ITEM 08R• ITEM 9.£ RESOLUTION NO. 88- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING GUIDLINES FOR DRIVEWAYS AND AND DRIVEWAY EXPANSIONS IN RESIDENTIAL AREAS. WHEREAS, studies and investigaitons were made, a staff report and recommendations were submitted before the City Council on October 7, 1988; and WHEREAS, pursunt to the provisions of the California Environmental Quality Act {Division 13 of the Public Resources Code of the State of California (begining at Section 21000)}, an environmental assessment has been made in accordance with the city's adopted Environmental Guidelines, and as a result it has determined that the proposed guidelines are categoricall exempt under Class l(c) of CEQA. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVES AS FOLLOWS: SECTION 1. The City Council finds and determines that the guidelines related to second driveways and expansions thereof will not have an effect on the environment and that a Categorical Exemption is appropriate. SECTION 2. Based upon the staff report dated September 29, 1988 and evidence before the Council at a public meeting, the City Council hereby approves the guidelines attached as Exhibit "A" and incorporated herein by reference as though fully set forth at this point. SECTION 3. These guidelines shall serve to augment Section 8160-2.4 General Yard Regulations of the City's Zoning Code. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause this resolution and his/her certificai ton to be filed in the office of the City Clerk. Wall, City Clerk 881110A/CHRONI PJR:crl • CITY OF MOORPARK EXHIBIT "A" SECOND DRIVEWAYS AND DRIVEWAY EXPANSIONS 1 . Any modification to an existing driveway shall require an encroachment permit. As conditions of issuance of an encroachment permit the property owner shall: a. Acknowledge that he/she has received a copy of this policy and understands his/her requirement thereunder and agrees to adhere to all said requirements; b. In the event of violation of any of the conditions and terms of the city issued encroachment permit as determined solely by the city, he/she shall restore the driveway, curb, gutter and relative improvements to the condition that existed prior to the improvement; c. Acknowledge that he/she has legal obligation to inform subsequent owners of the property of the existence of this encroachment permit. 2. Second driveway approaches are permitted on corner lots on the street side where no previous driveway approach exists. Also, such an approach shall not be placed near a corner radius without approval of the Director of Community Development. 3. Where a second driveway approach is used on a corner lot all gates shall swing inward or shall be a sliding/rolling gate parallel with the side property line. 4. No second driveway shall be permitted on a collector, arterial street or state highway except circular designs approved by the City Engineer and Director of Community Development. 5. All second driveways Homeowners Association approval by the city. and driveway expansions approval (where applicable) shall receive prior to any_ 6. All second driveways in the required front yard shall use turf block which shall be planted and maintained or have grass/lawn from back of walk (back of curb if no sidewalk) to the front fence/wall line. All parking in the side or rear yards shall be behind a view -obscuring fence or wall six (6) feet high, including gates. -1- 880710/CHRONI 7. All parking in the side yard (between house/garage and side property line) shall require a minimum side yard width of fifteen (15) feet. As this insures retention of a minimum distance of five (5) feet between the side property line and any vehicle parked in the side yard. When the side yard is to be used as access for rear yard storage/parking the minimum side yard width shall be ten (10) feet. 8. All second driveways shall be no wider than twelve (12) feet. 9. There shall be a minimum of 40 feet of full height curb between driveways on the same lot. 10. No parking or storage of vehicles of any kind shall be permitted in the required front yard except on the driveway. The driveway is considered the paved area directly in front of the garage opening extending from the curb and is the same width as the garage. 11. Top of curb for driveway approach must be a minimum of 5 feet from adjacent property line except on corner lots or lots on a knuckle. 12. That at least a minimum of a five (5) foot wide landscaped area shall be provided and maintained between the adjacent property line and the paved driveway from the front of the garage to the curb. -2- 880710/CHRONI
