MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 05/01/2024 Regular Meeting SUBJECT: Consider Resolution Accepting the Dedication of a Trail Easement and for the Approval of Final Tract Map No. 6068 (Patriot Professional Plaza) and Making a Determination of Exemption Pursuant to the California Environmental Quality Act in Association Therewith, on the Application of Martin Teitelbaum on Behalf of Patriot Investors, LP SUMMARY On July 20, 2022, the City Council approved Resolution No. 2022-4118 approving Commercial Planned Development Permit No. 2021-01 and Vesting Tentative Tract Map No. 2021-02 for Tract No. 6068. This approval authorized the subdivision of one property located at 858 Patriot Drive into one common area lot and seven commercial lots and the development of seven office buildings totaling 28,955 square feet, on the application of Martin Teitelbaum on behalf of Patriot Investors, LP. A Condition of Approval required the dedication of a trail easement along the western boundary of the site as part of this project to align with existing off-site trails and provide continued public access across the site. DISCUSSION City staff from both the Community Development and Public Works Departments worked closely with the Applicant on the preparation and review of the Final Tract Map. Conditions of Approval associated with the project were also reviewed to ensure compliance prior to approval of the Final Tract Map. One condition requires the dedication of a trail easement to the City prior to recordation of the Final Tract Map. The staff recommendation associated with this item accomplishes compliance with that obligation and enables approval of the Final Tract Map. The City Engineer is satisfied that the Final Tract Map is technically accurate and in substantial conformance to the approved Tentative Tract Map. 170 Honorable City Council 05/01/2024 Regular Meeting Page 2 ENVIRONMENTAL DETERMINATION In accordance with the City’s environmental review procedures adopted by Resolution No. 2004-2224, the Community Development Director determines the level of review necessary for a project to comply with the California Environmental Quality Act (CEQA). Some projects may be exempt from review based upon a specific category listed in CEQA. Other projects may be exempt under a general rule that environmental review is not necessary where it can be determined that there would be no possibility of a significant effect upon the environment. A project which does not qualify for an exemption requires the preparation of an Initial Study to assess the level of potential environmental impacts. The Director has reviewed this Project and found it to be exempt from environmental review in accordance with Section 15268(b) of the CEQA Guidelines. Therefore, no further environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. ATTACHMENTS Attachment: Draft Resolution, including: Exhibit A: Trail Easement Exhibit B: Final Tract Map No. 6068 171 RESOLUTION NO. 2024-______ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ACCEPTING THE DEDICATION OF A TRAIL EASEMENT AND APPROVING FINAL TRACT MAP NO. 6068, INCLUDING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN ASSOCIATION THEREWITH, ON THE APPLICATION OF MARTIN TEITELBAUM ON BEHALF OF PATRIOT INVESTORS, LP WHEREAS, on July 20, 2022, the City Council adopted Resolution No. 2022-4118 approving Commercial Planned Development Permit No. 2021-01 and Vesting Tentative Tract Map No. 2021-02 for Tract No. 6068 associated with the proposed subdivision of one property located at 858 Patriot Drive into one common area lot and seven commercial lots and the development of seven office buildings totaling 28,955 square feet; and WHEREAS, Condition of Approval No. 16 of Resolution No. 2022-4118 states: Prior to the recordation of the Final Vesting Tentative Map, the public access trail easement shall be updated to reflect the as-built layout and dimensions of the trail. Prior to recordation of the updated trail easement, the draft easement shall be submitted to the Parks, Recreation and Community Service and Public Works Directors for review and concurrence prior to recordation. (CDD, PW, and PRCS) WHEREAS, the City Engineer/Public Works Director and Community Development Director have reviewed the Conditions of Approval of Resolution No. 2022- 4118, the proposed trail easement, and the proposed Final Tract Map and associated exhibits to ensure compliance prior to the approval and recordation of the Final Tract Map; and WHEREAS, the City Engineer/Public Works Director has determined that the Final Tract Map is in substantial conformance with the approved Vesting Tentative Map for Tract No. 6068; and WHEREAS, the Community Development Director has determined that this project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15268(b) of the CEQA Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ENVIRONMENTAL DOCUMENTATION: The City Council, based on its own independent analysis and judgment, concurs with the Community Development Director’s determination that the project is exempt from the requirements of the CEQA ATTACHMENT 172 Resolution No. 2024-_____ Page 2 pursuant to Section 15268(b) of the CEQA Guidelines. Therefore, no further environmental analysis is required. SECTION 2. CITY COUNCIL APPROVAL - THE CITY COUNCIL DOES HEREBY RESOLVE AS FOLLOWS: A. ACCEPTANCE AND RECORDATION OF TRAIL EASEMENT: The City Council accepts dedication of the trail easement as described in Exhibit A attached hereto and directs the City Clerk to sign and record a Certificate of Acceptance for the easement with the office of the Ventura County Recorder. B.APPROVAL OF FINAL MAP: The City Council hereby approves Final Tract Map No. 6068 as depicted in Exhibit B attached hereto and authorizes the Mayor and City Clerk to sign Final Tract Map No. 6068. C.RECORDATION OF FINAL MAP: Following submittal to the Ventura County Recorder of the trail easement for recordation, the City Council hereby directs the City Clerk to record Final Tract Map No. 6068 with the office of the Ventura County Recorder. SECTION 3. CERTIFICATION OF ADOPTION: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
