MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 05/01/2024 Regular Meeting SUBJECT: Consider a Resolution Exonerating Surety Bond – Grading & Improvements (Bond No. 4462111) for 3940 Dalaway Drive (APN 505- 0-120-155) BACKGROUND AND DISCUSSION On November 2, 2020, the Community Development Department approved Administrative Permit No. 2020-04 and Zoning Clearance No. 2020-169 to construct a 2,430 square foot manufactured, single-family dwelling with a 441 square foot detached garage, located at 3940 Dalaway Drive (APN 505-0-120-155). On November 16, 2022, the Public Works Department issued Grading Permit No. PWG2022-0018 for grading and site improvements associated with the construction of the manufactured, single- family dwelling at 3940 Dalaway Drive. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 22-ML-11101, are completed in accordance with the reviewed and accepted Plans and Specifications. The grading and site improvements associated at 3940 Dalaway Drive are constructed and were accepted by City staff as follows: •Rough Grade Certificate, dated April 13, 2023 •Fine Grade Certificate, dated February 24, 2024 Item: 10.F. 182 Honorable City Council 05/01/2024 Regular Meeting Page 2 Staff recommends the following bond be exonerated: Surety Type Bond Number Original Bond Amount Prior Authorization Action Authorized Action as of 5/01/2024 Surety Bond – Grading & Improvements 4462111 $28,731.00 None Exonerate Attached for the City Council’s consideration is a Resolution exonerating Surety Bond – Grading & Improvements (Bond No. 4462111). ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2024-____ 183 ATTACHMENT RESOLUTION NO. 2024-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, EXONERATING SURETY BOND – GRADING & IMPROVEMENTS (BOND NO. 4462111) FOR 3940 DALAWAY DRIVE (APN 505-0-120-155) WHEREAS, on November 2, 2020, the Community Development Department approved Administrative Permit No. 2020-04 and Zoning Clearance No. 2020-169 to construct a 2,430 square foot manufactured, single-family dwelling with a 441 square foot detached garage, located at 3940 Dalaway Drive (APN 505-0-120-155); and WHEREAS, on November 16, 2022, the Public Works Department issued Grading Permit No. PWG2022-0018 for grading and site improvements associated with the construction of a 2,430 square foot manufactured, single-family dwelling with a 441 square foot detached garage, located at 3940 Dalaway Drive; and WHEREAS, as part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 22-ML-11101, are completed in accordance with the reviewed and accepted Plans and Specifications; and WHEREAS, the City Engineer/Public Works Director accepted the grading and site improvements at 3940 Dalaway Drive and deemed those improvements to be complete; and WHEREAS, City staff now recommends that the City Council fully exonerate Surety Bond – Grading & Improvements (Bond No. 4462111) for grading and site improvements related to 3940 Dalaway Drive. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark hereby exonerates Surety Bond No. 4462111. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 1st day of May, 2024.
