MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 05/01/2024 Regular Meeting SUBJECT: Consider a Resolution Exonerating Surety Bond – Grading (Bond No. 107311162) and Surety Bond – Performance and Payment (Bond No. 107431090) for 6000 Condor Drive BACKGROUND AND DISCUSSION On May 25, 2021, the Planning Commission passed and adopted Resolution No. PC 2021-656, adopting a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) and approving Conditional Use Permit No. 2020-01, to allow the operation of a distribution and transportation facility within an existing 200,668 square-foot industrial building, expansion of an existing parking lot, and associated site improvements located at 6000 Condor Drive. On September 21, 2021, the Public Works Department issued Grading Permit Nos. 275G and 276G for grading and site improvements associated with the construction and development of a distribution and transportation facility and parking lot expansion at 6000 Condor Drive. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 21-ML-11097, are completed in accordance with the reviewed and accepted Plans and Specifications. The grading and site improvements associated to 6000 Condor Drive are constructed and were accepted by City staff on August 11, 2022. The constructed site improvements have performed beyond the one-year warranty period and staff recommends the bonds be exonerated as noted on the following page. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) 1. Adopt Resolution No. 2024-____, exonerating Surety Bond – Grading (Bond No. 107311162) and Surety Bond – Performance and Payment (Bond No. 107431090) for 6000 Condor Drive; and 2. Authorize the City Clerk to exonerate the bonds as shown in the agenda report and draft resolution. Attachment: Draft Resolution No. 2024-____ 189 ATTACHMENT RESOLUTION NO. 2024-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, EXONERATING SURETY BOND – GRADING (BOND NO. 107311162) AND SURETY BOND – PERFORMANCE AND PAYMENT (BOND NO. 107431090) FOR 6000 CONDOR DRIVE WHEREAS, May 25, 2021, the Planning Commission passed and adopted Resolution No. PC 2021-656, adopting a Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA) and approving Conditional Use Permit No. 2020-01, to allow the operation of a distribution and transportation facility within an existing 200,668 square-foot industrial building, expansion of an existing parking lot, and associated site improvements located at 6000 Condor Drive; and WHEREAS, September 21, 2021, the Public Works Department issued Grading Permit Nos. 275G and 276G for grading and site improvements associated with the construction and development of a distribution and transportation facility and parking lot expansion at 6000 Condor Drive; and WHEREAS, as part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 21-ML-11097, are completed in accordance with the reviewed and accepted Plans and Specifications; and WHEREAS, the City Engineer/Public Works Director accepted the grading and site improvements at 6000 Condor Drive and deemed those improvements to be complete; and WHEREAS, City staff now recommends that the City Council fully exonerate Surety Bond – Grading (Bond No. 107311162) and Surety Bond – Performance and Payment (Bond No. 107431090) for 6000 Condor Drive. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark hereby exonerates Surety Bond Nos. 107311162 and 107431090 for 6000 Condor Drive. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 1st day of May, 2024.
