MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Troy Brown, City Manager DATE: 05/15/2024 Regular Meeting SUBJECT: Receive and File Overview of Cannabis Regulatory Environment in the State of California from HdL Companies SUMMARY On January 3, 2024, the City Council directed staff to return with information on cannabis regulations in the state of California. Staff is not making any recommendations to amend the City’s current cannabis prohibitions, rather the City Council will be receiving a presentation from HdL Companies (HdL) on the regulatory environment in the state of California. Representatives from HdL will be available to respond to any questions the Council or residents may have regarding cannabis regulations in California. Again, no action is required or requested of the City Council. BACKGROUND On January 3, 2024, the City Council introduced an ordinance amending the City’s Zoning Code to comply with Senate Bill (SB) 1186. SB 1186, effective January 1, 2024, precludes public agencies from completely prohibiting the establishment of a physical premises for the retail sale of medicinal cannabis delivery (also known as non-storefront retail) within its jurisdiction. To comply with the requirements of SB 1186, the City Council amended the Zoning Code and was to identify two origination sites within the M-1 zoning district where delivery of medicinal cannabis would be allowed by right per SB 1186. In considering the amendments to the Zoning Code, the City Council established this use through a Conditional Use Permit and only when the property maintained a required setback of 600 feet from established sensitive uses. Prohibitions on all other cannabis activities including retail sales, warehousing, and testing will remain. Item: 9.A. 1 Honorable City Council 05/15/2024 Regular Meeting Page 2 During the process to establish the origination sites, many questions from the public arose and some misinformation was shared in the community. This was evidenced during deliberation of the zoning amendment considered by the City Council when a number of questions regarding retail sales, crime activity, and regulations associated with retail activity were raised by members of the public. The HdL Companies maintain a Cannabis division which has served hundreds of cities in California. This division helps cities understand the regulatory environment available to state and local jurisdictions and is among the preeminent leaders in policy development for cannabis. Mark Lovelace, Senior Policy Advisor will provide an overview of the cannabis industry and be available for any questions. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
