SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY
OF THE CITY OF MOORPARK
Moorpark, California April 17, 2024
A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency
was held on Wednesday, April 17, 2024, at 6:30 p.m. in the Council Chambers of said
City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard
and acted upon by the City Council unless otherwise noted.
1.CALL TO ORDER:
Mayor Enegren called the meeting to order at 6:31 p.m.
2.PLEDGE OF ALLEGIANCE:
Councilmember Castro led the Pledge of Allegiance.
3.ROLL CALL:
Present:Councilmembers Castro, Delgado, Groff, Means, and Mayor

4.PROCLAMATIONS AND COMMENDATIONS:
A.Certificate of Recognition to Vector/Animal Control Specialist Mark
Westerline on the Occasion of his Retirement and in Recognition of 36
Years of Public Service.
Mayor Enegren presented a certificate of recognition to Mark Westerline on
the occasion of his retirement and in recognition of 36 years of Public
Service.
B.Proclamation Declaring May 4, 2024, as the City of Moorpark’s Observance
of Arbor Day.
Mayor Enegren presented a Proclamation to Parks & Facilities Supervisor
Leland Baxter, declaring May 4, 2024 as the City of Moorpark’s Observance
of Arbor Day.

5.PUBLIC COMMENT:
Giovanni Aquila spoke regarding the Moorpark City Transit services which
included an adjustment request to the travel times so they coincide with the
Metrolink schedules and the Moorpark College class schedules. Mr. Aquila
requested additional stops be added on Spring Road and New Los Angeles
Avenue to allow access to the businesses and consideration to add a stop to
Costco and Walmart in Simi Valley.
6.REORDERING OF, AND ADDITIONS TO, THE AGENDA:
None.
7.ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON
MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND
MAYOR:
Councilmember Delgado reported on April 4 she attended the Clean Power
Alliance Board of Directors meeting where they discussed new sources of
alternative power as well as future rates.
Councilmember Delgado reported on April 5 she participated in opening night and
subsequent shows of Crazy For You at the High Street Arts Center.
Councilmember Delgado reported on April 10 she attended the Moorpark Chamber
of Commerce board meeting along with Mayor Enegren where they discussed the
installation dinner and fundraiser that is happening April 26 at 6:00 p.m.
Councilmember Delgado reported on April 11 she attended the Moorpark Young
Professionals Group at The Alley, which is held the second Thursday of every
month at noon.
Councilmember Delgado reported on April 17 she attended the ribbon-cutting
along with Councilmembers Groff and Means and staff, for The Meadowglade a
holistic mental health treatment center.
Councilmember Groff reported on April 4 he attended the Ventura County
Taxpayers Association taxpayer focus event with guest speaker ambassador
Robert O’Brien, former National Security Advisor for the United States.
Councilmember Groff reported on April 5 he attended the City’s all employee
briefing luncheon.
Councilmember Groff reported on April 10 he attended the Ventura County
Taxpayers Association and Ventura County Taxpayers Foundation board meeting.
Councilmember Groff reported on April 13 he attended the Simi Valley/Moorpark
Boys & Girls Club Gala held at the Ronald Reagan Presidential Library.

Councilmember Groff reported on April 17 he attended The Meadowglade ribbon
cutting.
Councilmember Castro reported on April 8 he attended the Transportation and
Public Works Standing Committee meeting.
Councilmember Castro reported on April 13 he attended the Moorpark Police
Department and California Highway Patrol open house.
Councilmember Means reported on April 9 he attended a meeting of the Solid
Waste ad hoc committee along with Councilmember Groff.
Councilmember Means stated that the La Reina Academy is in escrow to purchase
the prior Pinecrest school site and reported he participated in a tour on April 11.
They are looking at potentially opening in August 2024.
Councilmember Means reported on April 12 he attended Crazy For You featuring
Councilwoman Delgado.
Councilmember Means reported on April 13 he attended the Moorpark Police
Department and California Highway Patrol open house.
Councilmember Means reported on April 17 he attended the ribbon cutting at The
Meadowglade.
Mayor Enegren reported on April 5 he attended the Ventura County Transportation
Commission meeting.
Mayor Enegren reported on April 5 he attended the City’s all employee briefing.

of Director’s meeting regarding the proposed water rate increases.

Commerce Board of Directors meeting.
Mayor Enegren reported he attended Crazy for You at the High Street Arts Center.
Mayor Enegren extended an invitation to join our 'Job Skills For Successful Teens’
event on Saturday, April 20, hosted by the Moorpark City Library in collaboration
with the Economic Development Division. From crafting resumes to mastering
interviews, discover essential skills and resources tailored for Ventura County
teenagers entering the job market. The event will run from 11:00 a.m. to 12:30
p.m. at the Moorpark City Library, and no registration is needed.

Mayor Enegren announced registration is open for the Apricot Slam Pickleball
Tournament to be held on April 27 and 28 at the Arroyo Vista Community Park.
Sign your team up for men’s, women’s, mixed, or senior divisions, all skill levels
welcome. Tournament details and registration information is available at the City’s
website.
Mayor Enegren announced the City will be sponsoring a homebuyer workshop on
Saturday, April 27, 2024. The workshop will take place from 9:00 a.m. to 3:00 p.m.
at City Hall in the Apricot Room and is free of charge. The Ventura County
Community Development Corporation will be providing information on the steps to
buy a home, the dos and don’ts of buying, credit boosting tips, information on first-
time homebuyer loans, and down payment assistance programs. You can register
for the workshop by going to www.vccdc.org/events or by calling 805-273-7800.
Mayor Enegren announced the second annual Kids Fest at the Moorpark City
Library on Saturday, April 27. The event includes cartoon classes, a storytelling
adventure with an author’s visit, a superhero appearance - meet Spiderman in
person, and explore the touch-a-truck exhibit including fire engines and police cars.
There will also be games and activities throughout the day, and discover valuable
community resources dedicated to supporting families and children right here in
our neighborhood.
Mayor Enegren extended an invitation to attend the Moorpark Earth Festival on
Saturday, May 4 from 9:00 a.m. to 1:00 p.m. at Arroyo Vista Community Park to
celebrate Earth and Arbor Day with Community Yard Sale booths, eco-friendly
vendors, garden giveaways, and more. New this year is a Kids Swap Meet, where
kids can bring their gently used toys and clothes to sell or trade. Applications and
event information available at the City’s webpage.
Mayor Enegren extended an invitation to sign up now for a family friendly Cinco de
Mile fun run. The run will be held on Sunday, May 5 at the Arroyo Vista Park trail.
Run or walk the trail, play la loteria, and enjoy a taco plate. For details, visit the
City’s webpage.
Mayor Enegren announced registration is now open for Camp Moorpark and
Adventure Camp. Camp Moorpark is a day camp program for ages 5 to 10 and
features weekly themes, special events and parties, games, sports, crafts, weekly
field trips, and more. Adventure Camp is for ages 11 to 13 and features fun on-
site activities plus field trips 3 days per week. For camp packets and enrollment

Mayor Enegren extended an invitation to the 2024 State of the City event on
Monday, May 13, from 4:00 to 6:00 p.m., at the High Street Arts Center where
attendees will gain valuable insights into our community's progress and future.

8.PUBLIC HEARINGS:
A.Consider Ordinance for the First Amendment to Development Agreement
No. 2016-01 Between the City of Moorpark and M.P. Group LLC, Moorpark
Homes LLC, and CLP Investment LLC Allowing the Payment of an In-lieu
Fee for the Project’s Affordable Housing Obligation, Eliminating the On-site
Affordable Housing Obligation, and Making other Adjustments to the
Development Agreement; Consider Resolution Amending the Conditions of
Approval for Residential Planned Development Permit No. 2016-01; and
Making a Determination of Exemption Pursuant to the California
Environmental Quality Act in Connection Therewithin, on the Application of
Nelson Chung of Pacific Communities (on Behalf of M.P. Group LLC,
Moorpark Homes LLC, and CLP Investment LLC). Planning Commission
Recommendation: 1) Open the public hearing, accept public testimony, and
close the public hearing; and 2) Introduce Ordinance No. 522 approving the
First Amendment to Development Agreement between the City of Moorpark
and M.P. Group LLC, Moorpark Homes LLC, and CLP Investment LLC
allowing the payment of an in-lieu fee for the project’s affordable housing
obligation, eliminating the on-site affordable housing obligation and making
other adjustments to the development agreement for first reading, waive full
reading, and place this Ordinance on the agenda for May 1, 2024, for
purposes of providing second reading and adoption of the Ordinance; and
3)Adopt Resolution No. 2024-4234 approving amendments to the
Conditions of Approval (“COA”) for Residential Planned Development
(“RPD”) Permit No. 2016-01, and finding the project Exempt from the
California Environmental Quality Act (CEQA). (ROLL CALL VOTE
REQUIRED)
Ms. Farley gave the staff report.
The public hearing was opened at 6:59 p.m.
Nelson Chung, applicant, gave a PowerPoint presentation.
The public hearing was closed at 7:16 p.m.
Brief comment was made by Councilmember Castro inquiring why the
project became infeasible as stated by the applicant; it was noted that
higher mortgage interest rates and the continuing escalation of construction
costs versus the allowable sales price of affordable housing units impact
project feasibility. There was brief discussion of the State’s requirements
to provide options to developers to fulfill affordable housing requirements,
and on the flexibility that is given by changing the Landscape and Lighting
District requirement to a Community Facilities District (CFD) because of the
broader maintenance of improvements that can be funded through a CFD,
thereby reducing the maintenance burden on the City’s General Fund.

AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, APPROVING THE FIRST AMENDMENT TO
DEVELOPMENT AGREEMENT NO. 2016-01 BETWEEN
THE CITY OF MOORPARK AND M.P. GROUP LLC,
MOORPARK HOMES LLC, AND CLP INVESTMENT LLC,
ALLOWING THE PAYMENT OF AN IN-LIEU FEE FOR THE
PROJECT’S AFFORDABLE HOUSING OBLIGATION,
ELIMINATING THE ON-SITE AFFORDABLE HOUSING
OBLIGATION, AND MAKING OTHER ADJUSTMENTS TO
THE DEVELOPMENT AGREEMENT, AND MAKING A
DETERMINATION OF EXEMPTION PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT IN
CONNECTION THEREWITH
MOTION: Mayor Enegren moved, and Councilmember Groff seconded a motion to
introduce Ordinance No. 522, approving the First Amendment to Development
Agreement between the City of Moorpark and M.P. Group LLC, Moorpark Homes LLC,
and CLP Investment LLC for first reading, waive full reading, and place this Ordinance on
the agenda for May 1, 2024, for purposes of providing second reading and adoption of
the Ordinance; and
MOTION: Mayor Enegren moved, and Councilmember Delgado seconded a motion to
adopt Resolution No. 2024-4234 approving amendments to the Conditions of Approval
(“COA”) for Residential Planned Development (“RPD”) Permit No. 2016-01, and finding
the project exempt from the California Environmental Quality Act (CEQA). The motion
carried by unanimous roll call vote.
9. PRESENTATION/ACTION/DISCUSSION:

10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED)
MOTION: Councilmember Groff moved, and Councilmember Delgado seconded a
motion to approve the Consent Calendar. The motion carried by unanimous roll call vote.
A. Consider Warrant Register for Fiscal Year 2023/24 – April 17, 2024. Staff
Recommendation: Approve the warrant register.
B. Consider Resolution Approving California Highway Patrol Tenant
Improvements at Moorpark Police Services Center, Authorizing the City
Manager to Execute an Agreement with the County of Ventura to Construct
the Improvements, and Amending the Fiscal Year (FY) 2023/24 Budget in
the amount of $462,986.70 for Construction Services. Staff
Recommendation: Adopt Resolution No. 2024-4235, approving California
Highway Patrol Tenant Improvements at Moorpark Police Services Center,

Authorizing the City Manager to Execute an Agreement with the County of
Ventura to Construct the Improvements, and Amending the FY 2023/24
Budget for Construction Services. (ROLL CALL VOTE REQUIRED)
C.Consider Authorizing the City Manager to Execute an Eight-Year Lease with
the State of California for California Highway Patrol (CHP) Space Within the
Moorpark Police Services Center at 610 Spring Road. Staff
Recommendation: Authorize the City Manager to Execute an Eight-Year
Lease with the State of California for California Highway Patrol (CHP)
Space Within the Moorpark Police Services Center at 610 Spring Road,
subject to final language approval by the City Manager, and authorize the
City Manager to approve a change order to reimburse the City for
architectural and design services related to the lease space expansion.
D.Consider Report of Annual Development Agreement Review, Established
in Connection with Residential Planned Development No. 2016-01 (Pacific
Communities), Located South of Los Angeles Avenue, East of Maureen
Lane, and West of Leta Yancy Road, on the Application of MP Group, LLC,
Moorpark Homes, LLC, and CLP Investment, LLC. Staff Recommendation:
1) Accept the Community Development Director’s report and
recommendation that, on the basis of substantial evidence, MP Group, LLC,
Moorpark Homes, LLC, and CLP Investment, LLC has complied in good
faith with the terms and conditions of the agreement; and 2) Deem the 2024
annual review process for this project complete.
11.ORDINANCES:
None.
12.CLOSED SESSION:
Mr. Brown requested the City Council go into closed session for discussion of
Items 12.A. on the agenda. The time was 7:32 p.m.
