DENNIS DELZEIT City Engineer JOHN V. GILLESPIE Chief of Police Attached is the proposed Community Center Rules and Regulations governing the use of the Moorpark Community Center. These rules and regulations have been reviewed and approved by the Parks and Recreation Commission. Also included is the revised Fee Schedule for the Moorpark Community Center. The Parks and Recreation Commission is recommending adjustments in the rental rates for all four categories. Essentially, the rates have been increased in categories I and II; however, rates have been reduced in categories III and IV which serve community and non—profit organizations. The Commission feels that the new fee schedule will better serve those community and non—profit organizations (categories III and IV) by offering lower fees, while the additional compensation earned in the private and profit making organizations will offset the costs involved in the operation of the Community Center for categories III and IV. If any provision of these regulations is held invalid or unconsti- tutional, such declaration shall not effect the other clauses or provisions of these regulations. 102 DEFINITIONS a) "Community Center" -shall mean the building at 799 Moorpark Avenue including: Front and rear patio, Multi -purpose room (large), Room A (smaller), Kitchen, Foyer & Rest Rooms, City Offices and Parking Lot. b) "City" - shall mean the City of Moorpark. c) "Person" - means any individual, group, organization, association, partnership, firm or corporation. d) "Public/General Public" - shall mean any person residing within the City boundaries of the City of Moorpark. e) "Community Group" - shall mean nonprofit groups and organizations wherein more than 50% of the members are City residents. f) "Starting Time" - shall mean the time which any lessor desires to be let into the building (including set-up). g) "Finishing Time" - shall mean the time which any proposed activity is expected to be finished. h) "Alcoholic Beverages" - shall mean alcohol, spirits, liquor, wine beer, and every liquid or solid containing one half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or combined with other substances. i) "Shall" - means mandatory, "May" - means permissive. j) "Amplified Sound" - shall mean sound projected and trans- mitted by electronic equipment, including amplifiers. k) "Section" - shall mean a section of these regulations unless otherwise stated. 102 1) "Non Profit Corporation" - shall mean any Corporation registered with the Secretary of State for the State of California as a Non -Profit Orgainzation. (verification may be required) m) "Alcohol Use" - shall mean the serving of alcohol to guests or participants. -1- n) "Alcohol Sale" - shall mean the exchange, deliverance, or serving of alcohol for money either by the drink, cover charge, or entry fee. 103 ENFORCEMENT The City Manager is hereby authorized to implement and administer the policies and regulations contained herein. Duties may be exercised or performed by the City Manager or by any other employee designated by the City Manager. 104 APPLICATIONS The Community Center is available for the use of individuals or groups subject to the issuance of a permit and payment of fees. All applications must be signed by an adult who shall agree to be responsible for said use. No use permit shall be granted if there is conflict with a prior reservation or City sponsored event. The City reserves the right to cancel a permit upon one weeks notice. Applications are immediately revocable if false statements are made in reserving a facility or if the individual or group willfully violates any rule or regulation established by the City. Requests for use shall be made in writing a minimum of 30 days prior to the event. An application will not be considered more than six months in advance of the requested use. A non-refundable processing fee shall be paid at the time of the reservation of the facility. 105 EXTENDED USE Any group requesting use on a regular basis extending over several months must make written application to the Moorpark Parks and Recreation Commission. The fee schedule for any event will be that in force at the time of the event. All fees and deposits are due 30 days prior to any event. -2- 108 ADDITIONAL CHARGES .liv Additional charges will be levied over the, -.-basic rate under the following conditions: a) When the center is not normally open and City personnel are required to be on duty. b) When staff is needed for set-up, breakdown, or cleanup of the facility. c) When staff is needed for facility control. d) When facility is damaged and/or liability insurance fees are required. e) Wnen alcohol is being served or sold. The determination of requirements for additional personnel and associated charges shall be made by the City Manager or his designated representative. 109 STAFFING City personnel will open and close buildings and grounds and be on duty to supervise the use of the facility. City staff are required to be on the premises at anytime the building is in use. The number of staff required for any event shall be at the discretion of the City Manager or his designated representative. The cost of having said personnel present shall be the responsibility of the renter. 109 Responsibility of the Lessor. - Staff is guaranteed a min- imum of four hours for any event requiring their presence at a time they would not otherwise be on the grounds. 110 SECURITY To ensure proper use and control of facilities and equipment, security guards may be required under the following conditions: a) When alcohol is being served, sold, or consumed. b) When the, event is of such a nature that security is felt to be necessary. Security Guards shall be provided from one of the companies on the City's approved list. The lessor shall be responsible for the cost of providing security. The number of security guards and any additional security measures necessary to protect the general public and city property shall be at the discretion of the City Manager or his designated representative. -3- IA; 111 ALCOHOL The sale, serving,^; or consumption of alcohol is prohibited in the Community Cenee`jr except by.a group making such a request and all necessary permits have been approved and fees paid. Alcohol may not be sold or served if minors under 21 years of age are present: exceptions are weddings and closed family parties. A State Alcoholic Beverage Control Board permit is required when alcoholic beverages are sold. Said permit shall be obtained by the group using the facility. 112 SMOKING Lessors are required to provide their own ashtrays. Cigarette butts and burns may result in loss of cleaning deposit. 113 CLEAN UP Clean up shall be the responsibility of the lessor. Clean up shall include but not be limited to: a) clean kitchen when used ie sinks, stove, refrigerator. b) Empty trash containers. c) Clean facility, clean tables and chairs used, remove all decorations, store tables and chairs. d) Check all electric appliances to make sure they are clean and turned off. e) Sweep floors, mop where needed. f) Clean restrooms and replace all supplies. 114 DECORATIONS Decorations are restricted to the carpeted areas of the walls. No nails shall be used except by prior approval by City staff. No scotch tape will be permitted. Use of lighted candles or any other open or enclosed flame is prohibited unless such use is approved by the Ventura County Fire Marshall. 115 ROOM CAPACITIES The multi -purpose room has a capacity of 423 persons in assembly or 198 persons dining (tables & chairs). Room A has a capacity of 234 persons in assembly or 100 persons dining. Any event exceeding these limits are subject to immediate closure and confiscation of all fees and deposits. 116 WAIVER Fees and deposits may be waived by the Parks and Recreation Commission. Application for waiver must be received at least 10 days prior to the Parks and Recreation Commission meeting. -4- 117 RIGHT OF APPEAL Any applicant may appeal the decision of City staff p$rson. The lessor or applicant must file said appeal with the ;Community Services Assistant within five days. The Community Services Assistant shall affirm or deny the appeal within 10 working days. `The decision of the Community Services Assistant may be appealed in writing to the Parks and Recreation Commission within 10 days of the date on the notification from the Community Services Assistant. The decision of the Commission is final. 118 LIABILITY All persons to whom use permits are granted must agree in writing to hold the City harmless and indemnify City from any and all liability for injury to persons or property occurring as the result of the activity sponsored by lessor, and said person shall be liable to the City for any and all damages to parks, equipemnt, and buildings owned or controlled by City which result from the activity of lessor or is caused by any participant in said activity. A person exercising -any of the privileges authorized by this policy does so at his/her own risk without liability on the part of the City of Moorpark for any injury to persons or property resulting therefrom. When an association of organization which carries public liability insurance requests the use of City facilities, or when the City is involved with scheduling and/or coordinating their activities, a certificate of co-insurance naming the City as an additional insured must be filed with the City prior to the first day of use of facilities involved. The City may require proof of liability insurance with limit of bodily injury and property damage of not less than $100,000. and a certificate of co-insurance for any individual or group when it is determined that: a) liquor is to be sold and/or served on City property and b) the proposed activity may result in injury to persons and/ or damage to property, equipment, buildings and grounds.
