SUBJECT: Report re: Establishment of City Property Maintenance
and Zoning Review Compliance Authority
PROPOSED ACTION:
Discuss the establishment of a review body which would direct concerted
attention toward the development and enforcement of property maintenance
and zoning standards within the City.
BACKGROUND INFORMATION:
At the recent joint meeting of the City Council and Planning Commission,
there was a brief discussion relative to the need for closer review and
follow-up of zoning infractions and property conditions which detract
from the appearance of the community. As part of the discussion, a
question was raised as to whether the Planning Commission should be
the hearing authority for such enforcement activity or whether a
separate Property Maintenance and Zoning Review Commission should be
established.
An example of some of the duties to be performed would be to develop
standards and policies for determining those premises and structures
within the community which constitute a safety hazard or nuisance,
ordering the abatement thereof, and serving as the reviewing authority
to hear appeals; determining zoning and property-line violations,
ordering abatement and serving as the reviewing authority to hear
appeals; determining sign regulation violations, ordering abatement
and serving as the reviewing authority to hear appeals; serving as
the reviewing authority to hear appeals; serving as the reviewing
authority to conduct public hearings and hear appeals regarding the
designation and disposal of abandoned/wrecked vehicles; hearing and
making findings regarding relocation appeals; and dealing with such
related enforcement matters as may from time to time be referred by
the City Council.
In many smaller cities the Planning Commission performs most of the
above duties. If the volume of activity warrants the establishment
of a separate compliance authority, however, such action is not
without prec~dent.

Prior to action being taken (one way or the other), it is felt that
the Planning Commission should be asked to review the matter and to
submit its recommendation to the City Council.

That the memorandum from the City Manager, dated
May 31, 1984, be referred to the Planning Commission,
together with a request that the Commission review
the concept of establishing a Property Maintenance
and Zoning Review Commission and recommend a suggested
course of action to the City Council.
