GILLESPIE Chief of Police On May 8, 1985, the Local Agency Formation Commission reviewed an application submitted by the Carlsberg Corporation to detach approximately 350 acres of their property from the Camrosa County Water District. Presently, Camrosa overlaps the City boundaries in the southern portion of the Carlsberg property between Moorpark Road and Moorpark Freeway (see map). The majority of the Carlsberg property is not within Waterworks District No. 1 and, the detachment was included as part of their annexation request. In order to allow further review of this matter, LAFCO staff recom- mended that the matter be continued to July 10, 1985. In discussing the situation with LAFCO staff, it has been indicated that it is their intent to recommend that the detachment be denied. The reason for this recommendation is that on July 6, 1982, the County entered into an agreement with Camrosa by which they bound themselves not to cause any modification of Camrosa's boundaries in the Carlsberg area. This will create a situation in which there is an overlap of 350 acres which would be within both Waterworks District No.l and Camrosa. While Camrosa has transmission facilities within this area, there are no facilities from which direct service could be made. Therefore, there is no significant cost advantage regarding the service to the Carlsberg property from either District. It has been intended that Waterworks District No. 1 would be the water and sewer provider. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 The Honorable City Council p. 2 -June 17, 1985 SUBJECT: CARLSBERG DETACHMENT FROM CAMROSA COUNTY WATERWORKS DISTRICT NO. l The resulting situation is that future residents within this portion of the Carlsberg property would be within Camrosa, while receiving no service from the District. Also, they would be obligated to pay for existing bonded debt to Camrosa and may also be subject to future indebtness or assessments if approved by Camrosa. This situation may be partially alleviated by Carlsberg paying off the bonded indebtedness on the property to Camrosa so that future residents would not receive a tax bill based upon their then present value of the property. It is a possibility that this measure will be recommended to LAFCO by their staff. This however will not totally alleviate the situation. There are two options available to the City for the removal of the jurisdictional overlap between Waterworks District No. 1/City with Camrosa. These are: 1. At a future date, as part of an annexation elsewhere to the City, the detachment of the overlap area could be included. 2. The City or Carlsberg could initiate the detachment of the O'\Brlap area and' submit an application to LAFCO. If LAFCO approves the detachment, it would then go to Camrosa and Camrosa must approve the detachment. RECOMMENDED ACTION Direct that, as part of the approval of any land use entitlement for the Carlsberg property, Carlsberg be required to initiate the detachment of their property from Camrosa County Waterworks District.
