Richards, Director of Community Development lfr DATE: September 11, 1989 (CC meeting of 9/20/89) SUBJECT: 96 MOORPARK AVENUE - NON-CONFORMING USE Background. In January of 1989 it came to the attention of the Community Development Department that the former newspaper business known as the Moorpark Mirror had established itself at 96 Moorpark Avenue. Although a business office is allowed :in. the underlying zone of C-1, Neighborhood Commercial; there is no record of a conversion from an original single family residential use to commercial. The investigation of the 96 Moorpark Avenue address at both the City and County level office did not disclose any records indicating a legal conversion. Discussion with the property owner and tenant (Moorpark Mirror) indicated the fact that a. beauty shop had been operating from the subject site for many years. At this time the property owner, Lela.n.d Family Trust is requesting that the City make some final determinations regarding the property and how it may be used. Discussion This matter is coming before the City Council so that a determination of permitted land use may be established for the subject property in accordance with Article 42 of the City's Zoning Code (see attached). The subject property was previously single family Residential R-1 zone until. 1980 at which time the County changed the zoning to Cl.- As can be seen today there is a mixture of residential and commercial uses along Moorpark Avenue in this area. Article 42 of. the Zoning Code is the operational section which deals with how nonconforming buildings and nonconforming uses are dealt with. As a building originally constructed for residential use there would need to be a significant number of modifications to meet commercial standards. Section 8162-3.2 of the zoning code allows a nonconforming use of a nonconforming building to change to another use permitted in the same zone provided that no structural alterations are made thereto. This section still assumes that their was a legally established use or structure prior to a code change. This is the basic question needing resolution by the Council. The applicant Dr. Leland had provided a letter and tax form from the previous property owner (see attached) plus copies from the County Assessors Tax Logs. The applicant wishes the City to find these documents sufficient to pronounce a previously existing business as legally established and therefore operate as a legal nonconforming use. Staff's primary concern with continued commercial use, without a Commercial Planned Development, is the lack of adequate parking and future interface problems with adjacent single family residential uses. Having the property under the authority of CPD would give the City maximum authority to correct any concerns. Recommended Action 1. That the City Council find that the former beauty shop was a preexisting use and therefore now legal nonconforming; and 2. That the City Council find that there may be no expansion of the existing structure without an approval of a Commercial Planned Development Permit; and 3. That the City Council find that no use shall occupy the subject site for which there is an insufficient number of parking spaces or for more than four (4) parking spaces; and 4. That the City Council find that no residential use of the subject property is permitted; and 5. That the City Council determine that only uses permitted within the C-1 zone are allowed. 6. That the current property owner shall record a document, approved by the City Attorney which will serve as notice to future owners of the limitations associated with this property. Sec. 8162-1 - Nonconforming Use - Land Sec. 8162-1.1 - Termination of Use - The nonconforming use of land shall be terminated ted not later than three (3) years of b r such use beds nonconforming. As used in this section, the term "use of land" includes the use of land only and the use of act. ssory buildings or structures in conjunction with the use of land when the aggregate assessed value of such buildings or structures for tax purposes is not more than seven hundred and fifty dollars ($750.) . Sec. 8162-1.2 - Exaansion Prohibited - The nonconforming use of land shall not be expanded or extended in anyway either on the same or • any adjoining land. Sec. 8162-1.3 - Discontinuance or Change - The discontinuance of a nonconforming use of land or a change of nonconforming use of land to some other kind of nonconforming use constitutes abandonrent and termination of the nonconforming use, and thereafter the use of land rust conform to the regulations of the applicable zone classification. Sec. 8162-2 - Nonconforming Use - Conforming Building or Structure Sec. 8162-2.1 - Termination of Use = The nonconforming use of a conforming building or structure shall be discontinued not later than five (5) years after such use bec oes nonconforming. As used in this Article, the tern "conforming building or structure" means a building or structure all or substantially all of which is designed or intended for a purpose or use permitted. iih the zone in which it is located. Sec. 8162-2.2 - Expansion Prohibited - The nonconforming use of a conforming building or structure shall not be expanded or extended into any other portion of such conforming building or structure. Sec. 8162-3.2 - Expansion Within Structure - The nonconforming use of a nonconforming building or structure may be expanded or extended throughout such building or structure, provided that no structural alterations shall be made therein except as required by law. / Sec. 8162-3.3 - Nonconforming Use Change - The`nanoonforming,use of a 1/ nonconforming building or structure may be changed to another use permitted in the sarre zone or a rrore restrictive use, provided that no structural alterations are made thereto. Sec. 8162-3.3.1 - Sequence of Use IOstriction - If the nonconform- ing use of a nonconforming building is changed to a use which is a more restrictive use, the sequence of said uses, the first being the most restrictive and the last being the least restrictive is , as follows: One Family Residential Use, Two Family Residential Use, Mtn tiple�armuly PESidential Use, Commercial Office Use, Neighborhood Commercial Use, General Commercial Use, Industrial Park Use, Limited Industrial Park Use and General Industrial Park Use. When the use of a nonconforming building is changed to a use which is permitted in a more restrictive zone, such a nonconforming building shall not thereafter be used for a use which is permitted only in a less restrictive zone. Sec. 8162-3.4 - Involuntary Partial Destruction - Whenever in any zone a nonconforming building or structure is involuntarily damaged or destroyed to the extent of fifty percent (50%) or less of its reason- able value, it may be restored and the occupancy or use of such building or structure or part thereof which existed at the tine of such partial destruction may be continued, if such restoration is started within a period of twelve (12) months of such damage or destruction and is diligently prosecuted to completion. Sec. 8162-3.5 - voluntary Partial D struction - Whenever in any zone a nonconforming building or structure is voluntarily removed, damaged or destroyed to the extent of fifty percent (50%) or less of its reasonable value, no repairs or reconstruction shall be Trade mless . such portion of such building or structure is made to conform to the regulations of the new zone classification in which it is located. Sec. 8162-3.6 - Substantial Destruction or Removal - Whenever in any zone a nonconforming building or structure is removed or is voluntarily or involnt-arily damaged or destroyed to the extent of rrore than fifty per-ennt (50%) of its reasonable value, no repairs or reconstruction shell be made unless every portion of such building or structure is made to conform to the regulations of the new zone classification in which it is located. . c. 8162-4, 8162-5 & 8162-6 PCIDEZ ED BY OPD. 2351 - 5/5/73 Sec. 8162-7 - Use of Nonconforming Lots - The use of land as permitted for the ( zone or sub-zone in which it is located shall be permitted on a lot of less area than that required by the regulations of such zone or subzone, or of less area than that required to meet the minimum area requirements necessary to 539 0C-3 \/ .. • permit use or development of such lot as a discrete unit under the applicable provisions of the Open Space Element of the General Plan, only if the owner or, if there be more than one, any one of the owners of such nonconforming lot does not own, in whole or in part, any contiguous lot; provided, however, that such use shall be permitted on such nonconforming lot if 1) both the nonconforming lot and the contiguous lot are developed with main buildings, as opposed to accessory buildings, for which a permit has been issued by the County or which were built prior to the time that permits were required therefor by the County or 2) the nonconforming lot and contiguous lot each have an area of at least 10 acres. ORD. 3650-5/17/83) Sec. 8162-8 - Nonconforming Uses of Land or Buildings - A variance or permit _is granted automatically hereby, so as to permit the continuation of the particular existing uses of any building, structure, .improvement or premises existing in the respective zones immediately prior to the time this ordinance or any amendment thereof becomes effective if such existing use was not in violation of this or any other ordinance or law. Whenever the zone classification of any property is changed any property being used pursuant to variance or permit may be used thereafter in the manner authorized by said variance or permit as a nonconforming use for the duration of said variance or permit.. Sec. 8162-9 - NONCOMFORMING LOTS RESULTING FROM LOT SPLITS - No building permit shall be issued for any lot which results from the sale of part of a lot or any other type of division of land if such resulting lot did not meet the zoning requirements which applied to the land at the time of said division and does not meet with the zoning requirements which apply to the land at the time of applica- tion for the permit unless a variance is obtained from the Planning Commission. This section is inapplicable to lots resulting from a lawful lot line adjustment. (AM.ORD. 2845-5/14/74 ;AM.ORD. 3483-3/4/80 ; C AM.ORD. 3647-4/26/83) • Sec. 8162-10 Nonconforming Use Violation and Penalties. Sec. 8162-10.1. - Prohibition - Record Owner. Sec. 8162-10.1.1 - It is unlawful for any record owner of land to use or permit to be used the land or any building or structure thereon for any nonconforming use which is in violation of this Article. Any record owner of land who violates any provision of this Article is guilty of a misdemeanor/infraction, as specified in Section 13-1 of the Ventura County Ordinance Code and, upon conviction thereof, shall be punishable in accordance with Section 13-2 of said Code. Any record owner of land who violates any provision of this Article shall be guilty of a separate offense for each and every day during any portion of which such violation is committed, continued, or permitted and shall be punishable therefor as provided in Section 13-2. ORD. 3597-5/18/82) Sec. 8162-10.1.2 - Any record owner owning real property which has been in violation of any provision of this Article for a period of one (1) year, who has been personally served by the County with a notice of nonconforming use violation and of the provision of this Section and Section 13 of the Ventura County Ordinance Code and who continues to violate any provision of this J Article after thirty (30) days after having been personally served by the County with such a notice of nonconforming use violation is guilty of a misdemeanor/infraction, and shall be 540 OC-S CB83c3a v ll • guilty of a separate offense for each and every day during any portion of which such violation is committed, continued, or permitted by such person. Upon conviction thereof, such person shall be punishable in accordance with Section 13-2. (AM. ORD. 3597-5/18/82) Sec. 8162-10.1.3 - "Record Owner" as used in this section means any person, corporation, partnership, or other entity who is shown as titleholder on the official records in the Ventura County Recorder's Office. Sec. 8162-10.2 - Prohibition - Lessee or Sublessee. Sec. 8162-10.2.1 - It is unlawful for any lessee or sublessee of real property to use or permit to be used the leased premises or any building or structure thereon for any nonconforming use which is in violation of this Article. Any lessee or sublessee of such real property who violates any provision of this Article is guilty of a misdemeanor/infraction as specified in Section 13-1 of the Ventura County Ordinance Code and, upon conviction thereof, shall be punishable in accordance with Section 13-2 of said Code. Any lessee or sublessee of such real property who violates any provision of this Article shall be guilty of a separate offense for each and every day during any portion of which such violation is committed, continued, or permitted and shall be punishable therefor as provided in Section 13-2. Sec. 8162-10.3.1 - It is unlawful for any advertiser to contract for space, to pay for space, or to advertise on any building, billboard, or other structure which is a nonconforming use in violation of this Article. Any advertiser who violates any provision of this section is guilty of a misdemeanor/infraction as specified in Section 13-1 of the Ventura County Ordinance Code and, upon conviction thereof, shall be punishable in accordance with Section 13-2 of said Code. Any advertiser who violates any provision of this Article shall be guilty of a separate offense for each and every day during any portion of which such violation is committed, continued, or permitted and shall be punishable therefor as provided in Section 13-2. Sec. 8162-10.4. - Nonconforming Use a Public Nuisance - In addition to • the penalties hereinabove provided, any nonconforming use caused or - permitted to exist in violation of any provision of this Article is hereby declared to be a public nuisance and is subject to summary abatement by;_the County, in which case the County may recover from the owner of the-land or -the"owner"of sudh public ' nuisance, in an action brought in the .name. _of the County for that purpose, the County's expense of removal -of such publid nuisance including court costs and reasonable attorney's fees to be fixed by the court.
