Moorpark, California May 15, 2024
A Regular Meeting of the City Council of the City of Moorpark and the Successor Agency
was held on Wednesday, May 15, 2024, at 6:30 p.m. in the Council Chambers of said
City located at 799 Moorpark Avenue, Moorpark, California. All items listed are heard
and acted upon by the City Council unless otherwise noted.
1. CALL TO ORDER:
Mayor Enegren called the meeting to order at 6:30 p.m.
2. PLEDGE OF ALLEGIANCE:
Ventura County Sheriff's Office Sergeant Shawn Holzberger led the Pledge of
Allegiance.
3. ROLL CALL:
Present: Councilmembers Castro, Delgado, Groff, Means, and Mayor
Enegren.

4. PROCLAMATIONS AND COMMENDATIONS:
A. Proclamation Recognizing May 15, 2024, as Peace Officers Memorial Day.
Mayor Enegren presented Proclamation to Ventura County Sheriffs Office
Sergeant Shawn Holzberger, recognizing May 15, 2024, as Peace Officers
Memorial Day.
B. Proclamation Declaring May 19 to May 25, 2024, as Public Works Week.
Mayor Enegren presented Proclamation to Senior Management Analyst
Michelle Woomer, declaring May 19 to May 25, 2024, as Public Works
Week.

5. PUBLIC COMMENT:
None.
6. REORDERING OF, AND ADDITIONS TO, THE AGENDA:
CONSENSUS: It was the consensus of the City Council to pull Consent Calendar Item
10.E. for individual consideration on the request of Councilmember Groff.
7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON
MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND
MAYOR:
Councilmember Delgado reported on May 2 she attended the Clean Power
Alliance (CPA) Board meeting where rate setting and fees comparisons between
CPA and Southern California Edison fees were discussed.
Councilmember Delgado reported on May 2 she also attended the ribbon cutting
for Jaxs Pizza which is now under new management, along with Mayor Enegren,
Councilmember Groff, and City Manager Brown.
Councilmember Delgado reported on May 3 she had the pleasure of reading the
Spanish portion of a bilingual book alongside Councilmember Groff to Flory
Elementary School students.
Councilmember Delgado reported on May 7 she attended a Moorpark Chamber of
Commerce event, along with Mayor Enegren and Councilmember Means, and had
the opportunity to visit Moorheart Farms, and organization with a mission to help
save horses sent to slaughter.
Councilmember Delgado reported on May 8 she attended the Moorpark Chamber
of Commerce Board of Directors meeting along with Mayor Enegren.
Councilmember Delgado reported on May 8 she attended a ribbon cutting and
property tour of a new affordable housing development in downtown Los Angeles
featuring micro units which are a first in the Los Angeles area.
Councilmember Delgado reported on May 9 she hosted the Moorpark Young
Professionals group which meets the second Thursday of every month at noon at
The Alley.
Councilmember Delgado reported on May 11 she attended the Apricot Festival
and extended thanks to the High Street Arts Center, the Moorpark Morning Rotary
Club, and the City for putting on the event.
Councilmember Delgado reported on May 13 she, along with all of the Council and
City staff, attended the Moorpark State of the City address. She extended thanks

to Economic Development Manager John Bandek and staff for putting together the
event that highlighted all Moorpark has to offer and what is to come.
Councilmember Groff reported on May 2 he attended the ribbon cutting for Jax
Pizza.
Councilmember Groff reported on May 3 he participated in the First5 Take Five
and Read to Kids event at Flory Elementary School.
Councilmember Groff reported on May 13 he attended the State of the City
address.
Councilmember Castro reported on May 2 he participated in the First5 bilingual
reading event at Flory Elementary School.
Councilmember Castro reported on May 6 he attended a Transportation and Public
Works standing committee meeting.
Councilmember Castro reported on May 11 he participated at the CIF track and
field finals hosted at Moorpark High School and then attended the Apricot Festival.
Councilmember Castro reported on May 13 he attended the State of the City
address.
Councilmember Castro commented that May is Mental Health Awareness Month.
Councilmember Means reported on May 5 he attended the Moorheart Farms
ribbon cutting.
Councilmember Means reported on May 11 he attended the Apricot Festival.
Councilmember Means reported on May 13 he attended the State of the City
address.
Councilmember Means reported, due to a prior obligation, he must depart from the
meeting at 7:15 p.m.
Mayor Enegren reported on May 2 he attended the ribbon cutting for Jax Pizza.
Mayor Enegren reported on May 5 he attended the Moorheart Farms ribbon
cutting.
Mayor Enegren reported on May 10 he attended the Ventura County
Transportation Commission meeting.

Mayor Enegren extended an invitation to the Home Run Derby on Saturday,
May 18 at Peach Hill Park. Compete for the most home runs, farthest hit, or just
join us for a BBQ dinner. Advance registration is required. For details, visit the
City's website.
Mayor Enegren announced that as part of Mental Health Awareness Month, the
City of Moorpark invites residents to attend a Suicide Prevention Webinar on
Thursday, May 30, from 6:00 p.m. to 7:30 p.m. Didi Hirsch Mental Health Services
will share information about the nature of suicide, suicide related statistics, suicide
risk factors, and warning signs. A Spanish language webinar will be scheduled
separately on June 13. To register, go to the City's website.
Mayor Enegren announced the Moorpark City Council is now accepting
applications for appointment to the Moorpark Teen Council for a one-year term
beginning on July 1, 2024, and ending on June 30, 2025. Appointed by the Mayor
and confirmed by City Council, the Teen Council typically consists of no fewer than
seven (7) and no more than fifteen (15) members who are Moorpark teens entering
7th to 12th grades in the fall. All applicants must reside within the City limits of the
City of Moorpark and be enrolled in school. Special attention will be given to
ensure that all middle schools and high schools in Moorpark have some
representation on the Teen Council. The Teen Council assists the City's
Recreation Division with planning and implementing Teen Programs. The Teen
Council will typically meet monthly, beginning in September 2024, at the Arroyo
Vista Recreation Center located at 4550 Tierra Rejada Road and will also be asked
to volunteer at City of Moorpark special events sponsored by the City's Parks,
Recreation, and Community Services Department. Applications will only be
accepted during an open annual recruitment and consistent with the posted
instructions for the Teen Council recruitment. Online Applications must be
submitted no later than Monday, May 27 by 5:00 p.m.
Mayor Enegren announced the Parks, Recreation and Trails Planning
Extravaganza on Tuesday, June 4 from 6:00 p.m. to 7:30 p.m. at the Moorpark
Community Center. This family-friendly event will be the final community workshop
for both the Parks & Recreation Master Plan and the Arroyo Simi Trail Master Plan.
You will have a chance to review and comment on both projects, and the Library
and Recreation division will have fun games and activities for the entire family.

8. PUBLIC HEARINGS:
None.
9. PRESENTATION/ACTION/DISCUSSION:
A. Receive and File Overview of Cannabis Regulatory Environment in the
State of California from HdL Companies. Staff Recommendation: Receive
and file presentation from HdL on Cannabis regulations.

Mr. Brown gave a staff report and introduced HdL Companies. Mark
Lovelace, Senior Policy Advisor with HdL Companies provided a
PowerPoint presentation.
AT THIS POINT in the meeting, Councilmember Means departed. The time was
7:15 p.m.
Police Chief Hendren also provided a PowerPoint presentation focused on
legal framework and cannabis establishments in Ventura County.
Questions from the City Council focused on the following: 1) how do
cannabis retail establishments compare to other establishments such as
bars; it was noted that cannabis establishments likely have lower calls for
service than other retail establishments; 2) is there any correlation between
the level of cannabis use and establishments opening where they did not
exist before; 3) is the City experiencing sales tax leakage because cannabis
consumption is already occurring; 4) discussion of other reasons aside from
revenue generation that cities choose to permit cannabis retail
establishments; 5) is there a tax rate threshold that cause sales to return to
an unpermitted/untaxed type; 6) buffer zone standards and sizes; 7) it was
clarified that the establishment in Thousand Oaks is both medicinal an adult
use; 8) is there data on adolescent cannabis use and whether consumption
increases when local establishments open; 9) is there any evidence of
cannabis being laced with fentanyl; 10) discussion of co-morbidities
between domestic violence and cannabis use and the ability to track those
correlations.
A Supplemental Report was distributed which included correspondence
items received.
Stephanie Maio, Moorpark resident, spoke in opposition to the City Council
considering permitting cannabis sales in Moorpark, citing health, safety, and
crime concerns.
Joshua Tockerman, Moorpark resident and cannabis business owner,
spoke regarding the Council's consideration of cannabis sales in Moorpark.
Nicole Luekenga, Moorpark resident, expressed the opinion that this
meeting was not publicized and further spoke in opposition to the City
Council considering permitting cannabis sales in Moorpark.
Discussion followed specifically noting that the City Council is not
considering approval of permitting retail cannabis sales and item is focused
on the collection of information on the regulatory, taxation, and data metrics.
Understanding the ancillary impacts of retail sales is difficult. Looking at
recent studies conducted since policy changes have taken place will be
important as data collection continues.

CONSENSUS: It was the consensus of the City Council to receive and file the
presentation.
10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED)
MOTION: Councilmember Groff moved, and Councilmember Delgado seconded a
motion to approve the Consent Calendar with the exception of Item 10.E. which was
pulled for individual consideration. The motion carried by roll call vote 4-0,
Councilmember Means absent.
A. Consider Warrant Register for Fiscal Year 2023/24 — May 15, 2024. Staff
Recommendation: Approve the warrant register.
B. Consider Minutes of the City Council/Successor Agency Regular Meeting
of April 17, 2024. Staff Recommendation: Approve the minutes.
C. Consider Resolution Amending Authorized Access of City Officials to Sales
and Use Tax Records and Rescinding Resolution No. 2024-4229. Staff
Recommendation: Adopt Resolution No. 2024-4242 and rescind Resolution
No. 2024-4229. (ROLL CALL VOTE REQUIRED)
D. Consider Amendment No. 7 to Fleet Tracking Services using Global
Positioning System (GPS) Units between the City of Moorpark and
NexTraq, LLC. Staff Recommendation: Authorize the City Manager to sign
Amendment No. 7 to the Agreement for Fleet Tracking services between
the City of Moorpark and NexTraq, LLC, subject to final language approval
by the City Manager.
F. Consider Award of One-Year Agreement with Durham School Services
L.P., for Bus Excursions and Charter Bus Transit Services, and Consider
Resolution Establishing the 2024 Summer Beach Bus Program. Staff
Recommendation: 1) Authorize award of one-year Agreement to Durham
School Services, L.P., in an amount not-to-exceed $48,000; and authorize
the City Manager to sign the Agreement, subject to final language approval
of the City Manager; and 2) Adopt Resolution No. 2024-4243, establishing
the 2024 Summer Beach Bus program. (ROLL CALL VOTE REQUIRED)
G. Consider Amendment No. 2 to Agreement with Dial Security, Inc. for
Installation of Intrusion Detection and Fire Alarm Monitoring Systems for
New City Hall Tenant Improvements at 323 Science Drive. Staff
Recommendation: Approve Amendment No. 2 to Agreement with Dial
Security, Inc. for Installation of Intrusion Detection, Fire Alarm Monitoring
and Humidity Sensors in the amount of $925.00, and authorize the City
Manager to execute the agreement, subject to final language approval of
the City Manager.

The following item was pulled for individual consideration:
AT THIS POINT in the meeting, Councilmember Groff announced his recusal from
participation in Consent Calendar Item 10.E. because it involves a project within 500 feet
of property that he owns on High Street.
E. Consider Authorizing Recordation of the Notice of Completion for the
Moorpark Station Sculpture Lighting Project and Release of Bonds in
Accordance with the Contract. Staff Recommendation: 1) Authorize the City
Clerk to file the Notice of Completion; and 2) Authorize release of the
Performance Bond and Payment Bond (Number PPD0100785) as outlined
in the agenda report.
MOTION: Mayor Enegren moved, and Councilmember Delgado seconded a motion to
approve Consent Calendar Item 10.E. The motion carried by roll call vote 3-1-0,
Councilmember Groff recused and Councilmember Means absent.

12. CLOSED SESSION:

13. ADJOURNMENT:
Mayor Enegren adjourned the meeting at 8:10 p.m.
