MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Hiromi Dever, Finance Director DATE: 09/04/2024 Regular Meeting SUBJECT: Consider Resolution Updating Schedule of Fees and Service Charges and Rescinding Resolution Nos. 2023-4196 and 2023-4197 BACKGROUND California Government Code Section 66014 authorizes cities to charge fees for services that may not exceed the reasonable costs of the service being provided. Additionally, Sections 66016, 66018, and 6062(a) set forth the notification and public hearing process required prior to levying fees or service charges, or prior to increasing an existing fee or service charge. In accordance with the provisions of Section 66017 of the Government Code, a public hearing notice was advertised in a newspaper of general circulation for the subject matter. This Government Code Section also provides that certain fees shall take effect no sooner than 60 days from the date of adoption. On February 1, 2023, the City Council adopted Resolution No. 2023-4157, updating user and regulatory fees and services charges, including real time billing rates. This Resolution authorizes staff to update user and regulatory fees using the annual percentage change in the all-urban Consumer Price Index for Los Angeles-Long Beach- Anaheim, CA. On July 19, 2023, the City Council adopted Resolutions updating the User and Regulatory fees including Development Impact Fees (Resolution No. 2023-4196) and Staff Billing Rates (Resolution No. 2023-4197). On September 6, 2023, Ordinance No. 517 was adopted which included the methodology of periodic adjustment to Development Impact Fees using either Consumer Price Index (CPI) or Construction Cost Index (CCI) for the Los Angeles Region as reported by Engineering News Record (ENR) for the 12-month period ending in May. Item: 8.A. 1 Honorable City Council 09/04/2024 Regular Meeting Page 2 DISCUSSION On February 1, 2023, the results of the comprehensive fee study and its recommendation was presented to the City Council and Resolution No. 2023-4157 was adopted. The Resolution authorizes periodic adjustment to the Schedule of Fees and Service Charges to ensure the cost of services are recovered. The methodology of annual update of User and Regulatory Fees uses the annual percentage change in CPI while the update of Development Impact Fees uses the annual percentage change in CCI for the period ending in May. Proposed Schedule of Fees and Service Charges, effective September 9, 2024, includes updates in User and Regulatory fees and Real Time Staff Billing Rates. The annual percentage change of 4% for CPI for the period ending in March was used to update User and Regulatory fees. The revised Schedule of Fees and Charges that will become effective September 9 does not include adjustments to Development Impact Fees; these adjustments and the timing of their effectiveness are discussed below. On June 19, 2024, the City Council adopted Resolution No. 2024-4254 updating employee salary rates; therefore, an adjustment to the real time staff billing rate schedule is warranted to keep up with inflation and to achieve cost-recovery for providing these services. The calculated rates depict the updates for Fiscal Year (FY) 2024/25, which incorporate a 3% Cost of Living adjustment (COLA). In addition, the benefit load rate used for the calculation has been adjusted to 44.2% to reflect FY 2024/25 benefit costs, an increase of 1.2% from FY 2023/24. The overall change to the staff billing rates, incorporating the 3% COLA and increase of benefit load rate, results in an average increase of 3.4%. The proposed 3.4% increases noted in the schedule also includes: all City positions (full-time and part-time) in the Resolution and the Staff Billing Rate schedule includes an “overtime” rate, which takes into account non-management positions. These rates are used for cost recovery purposes for several City programs, including the calculation of deposit-based permit application fees charged by the Community Development Department, staff time devoted to public works projects, and grant reimbursements. Proposed Schedule of Fees and Service Charges for Development Impact Fees (DIFs) will be effective on November 4, 2024. The DIFs are adjusted by the annual percentage change of 0.90% that is published for CCI for the period ending in May. A Public Hearing Notice was published in the Ventura County Star newspaper on August 25, 2024, and August 30, 2024. The Notice was also emailed to the Building Industry Association of Southern California, Southern California Edison, and the Gas Company, as per their requests, and posted on the City’s website and posting board. The draft Schedule of Fees and Service Charges attachment becomes effective September 9, 2024, and November 4, 2024, and is attached to the Draft Resolution as an Exhibit which is available in the Office of the City Clerk. 2 Honorable City Council 09/04/2024 Regular Meeting Page 3 ENVIRONMENTAL DETERMINATION The Community Development Director has determined that the update to Schedule of Fees and Service Charges is exempt from the provisions of the California Environmental Quality Act (CEQA), in that the action of the City Council does not involve the consideration of the approval of a project. In addition, pursuant to Public Resources Code Section 15273, CEQA does not apply to the modification of rates, fares, or other charges which are for the purpose of meeting operating expenses. FISCAL IMPACT Adjustment to the Schedule of Fees and Service Charges will result in a nominal increase in revenue; however, it will be used to offset operating expenses and associated for staff time spent on projects. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2024-____ Exhibit: Schedule of Fees and Service Charges - Effective September 9, 2024, and November 4, 2024 3 RESOLUTION NO. 2024-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING SCHEDULE OF FEES AND SERVICE CHARGES WHEREAS, user and regulatory fees are established by the City Council; and WHEREAS, the City Council finds that providing these services is of special benefit to applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from applicants who have sought or require the City's services by revising its schedule of fees; and WHEREAS, from time to time, the City Council adjusts staff billing rates for charging against deposit-based fees for the review and processing of certain permit applications and for staff time incurred in the furtherance of public works projects listed on the City’s Capital Improvements Program (CIP); and WHEREAS, the schedule of staff billing rates has been incorporated into the attached Exhibit in order to develop a more consolidated schedule of user and regulatory fees and service charges; and WHEREAS, the staff billing rates included in this schedule supersede those rates adopted in Resolution No. 2023-4197; and WHEREAS, City Council Resolution Nos. 2023-4157 and 2023-4196 are hereby rescinded upon the effective date described in Section 2 and 4 of this Resolution; and WHEREAS, the City Council desires that annually the City Manager update the fees and charges based on the annual percentage change in the all-urban Consumer Price Index for Los Angeles-Long Beach-Anaheim, CA (CPI). If the CPI does not change or goes down in a given year, no change shall be made to the fee schedule that year; and WHEREAS, in adopting this Resolution, the City Council is taking action on those fees for the services, programs or products set forth in the Exhibit which has been modified from prior resolutions of the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Schedule of Fees and Service Charges – effective dates September 9, 2024, and November 4, 2024, is attached hereto as an Exhibit, is hereby approved. SECTION 2. The new or adjusted fees adopted by this Resolution shall go into effect September 9, 2024, and November 4, 2024, respectively. ATTACHMENT 4 Resolution No. 2024-____ Page 2 SECTION 3. Payment of all rental fees is due in full thirty (30) calendar days prior to the first rental date on the Rental Permit. Reservation dates on a Rental Permit may not span a time period of more than ninety (90) calendar days, except those Rental Permits issued to youth sports organizations for use under an agreement with the City. Large Event and Large Venue Waste Management: Consistent with Article V of Chapter 8.36, Solid Waste, of the City’s Municipal Code, all large events and large venues, as defined in Chapter 8.36, are subject to the requirements of that Chapter, including the requirement for a waste management plan and a waste management fee as established by resolution of the City Council. C. Contract Security Guards: Fees for private Security Guards may be charged for any rental requiring Security Guards, as determined necessary by the Director.
