MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 09/04/2024 Regular Meeting SUBJECT: Consider Reduction of Surety Bond for Grading & Improvements (Bond No. 100721718) at 13816 Princeton Avenue (Rafiq, LLC – HiTech Auto) BACKGROUND AND DISCUSSION On July 7, 2021, the City Council adopted Resolution No. 2021-4020, approving Commercial Planned Development No. 2020-01 and Conditional Use Permit No. 2020- 04 to allow the demolition of an existing 2,300 square-foot building and development of a 6,186 square-foot, single-story auto repair shop and associated site improvements located at 13816 Princeton Avenue. On February 15, 2023, staff issued Grading Permit No. PWG2023-0019 for grading and site improvements associated with the development of the auto repair shop at 13816 Princeton Avenue. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 22-ML- 11100, are completed in accordance with the reviewed plans and specifications. The grading and site improvements associated with the development of the auto repair shop, HiTech Auto, are constructed and were accepted by City staff on June 27, 2024. The warranty period of the improvements ends one-year after the date of acceptance. As part of the City’s acceptance, staff recommends that the surety bonds be reduced to ten percent (10%) during the one-year warranty period as follows: Surety Type Bond Number Original Bond Amount Prior Authorization Action Authorized Action as of 9/4/2024 Surety Bond – Grading & Improvements 100721718 $185,672.00 None Reduction to $18,567.20 After the one-year warranty period is complete, staff will return to City Council to recommend exonerating the surety bond. Item: 10.J. 163 Honorable City Council 09/04/2024 Regular Meeting Page 2 ENVIRONMENTAL DETERMINATION The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment or is otherwise not considered a project as defined by CEQA Statute § 21065 and CEQA State Guidelines §15060(c)(3) and §15378. The reduction of a surety bond meets the above criteria and is not subject to CEQA. No additional environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
