Gun Violence Restraining Orders: A Critical Tool to Help Reduce Gun Violence Item: 9.B. 18 •There are different types ofrestraining orders. •A GVRO can stop someonefrom having, owning, or buyingany firearms (guns), firearmparts, ammunition, ormagazines when they pose animmediate threat tothemselves or others •Different from a DomesticViolence Restraining Order orCivil Harassment RestrainingOrder What is a Gun Violence Restraining Order? 19 Isla Vista May 2014 20 •2016 Ca. Enacts GVRO Legislation also known as “Red FlagLaws” •Falls under Penal Code sections 18100-18197 •Created ability for law enforcement to obtain Emergency GunViolence Restraining Orders to temporarily prevent a personwho is at-risk of hurting themselves or others frompossessing or purchasing any firearms or ammunition •Exclusively available to law enforcement In 2016, the Legislature Responded 21 Emergency GVRO – EPO-002 22 •Legislature expanded GVRO law tocreate Ex Parte GVRO’s •Available to law enforcement ANDspecific civilians: •Police officers •Close family members •Roommate •Employer / coworker •School teacher or employee •Dating relationship Process involves filling out 6 forms, found at http://www.courts.ca.gov/forms.htm In 2020, the Law Expanded 23 GVROs are Underutilized 46 24 Public awareness is critical •2020 Ca study indicated that 66% of population had never heard ofGVRO’s or ‘red flag’ laws •Yet, once explained, perceived appropriateness was high Law enforcement use •2021 study showed 56% of officers received GVRO training •Willingness to use GVRO’s increases when training received District Attorney’s Office •Currently training all law enforcement agencies in Ventura County onGVROs Working to Improve GVRO Utilization 25 If you know someone who poses a risk of violence and has access to a firearm, you should call the police and ask about a GVRO.
