MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ky Spangler, City Clerk DATE: 12/04/2024 Regular Meeting SUBJECT: Consider Report on the Results of the 2024 General Municipal Election Process SUMMARY Every two years the City of Moorpark conducts a General Municipal Election for the purposes of electing two City Councilmembers and the Mayor . On June 19, 2024, the City Council adopted resolutions calling and giving notice of the General Municipal Election to be held on November 5, 2024, and requesting election consolidation services from the County of Ventura Elections Division. Following the candidate nomination period which began July 15 and concluded on August 9, each open position had only one candidate qualified to appear on the ballot. Pursuant to the California Elections Code, an extended nomination period for City Council District 2 took place as the incumbent member, Councilmember Groff, did not file to seek reelection. At the close of the extended nomination period on August 14, 2024, for City Council District 2 there remained only one candidate qualified to appear on the ballot. The Elections Code (Section 10229(a)) requires that, in the event there is only one qualified candidate for each open position, the City Clerk shall submit a certificate of facts to the City Council and inform the governing body that it may adopt one of the following courses of action by the 75th day prior to the election: 1.Appoint to the office the persons who have been nominated. 2.Appoint to the office an eligible elector if no one has been nominated. 3.Hold the election, if either no one or only one person has been nominated. On August 22, 2024, the City Council convened a special meeting to consider these options and take action. Following deliberation, the City Council adopted Resolution No. 2024-4266 making the following appointments: Item: 5.A. 1 Honorable City Council 12/04/2024 Regular Meeting Page 2 Name Office Term Chris Barrett City Councilmember, District 2 2024-2028 Antonio A. Castro City Councilmember, District 4 2024-2028 Chris R. Enegren Mayor 2024-2026 The Elections Code provides that the persons appointed shall qualify and take office and serve exactly as if elected at a municipal election for office. Following the completion of the election and election canvas by the County Elections Division, the City Council would be presented with a resolution for adoption certifying the results of the General Municipal Election. However, in that the City Council took action on August 22, 2024, to appoint the members as noted, no further action is required by the governing body. This evening, members appointed by the adoption of Resolution No. 2022 -4266 will be sworn in through the administration of an Oath of Office by the City Clerk and begin their terms of office. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
