Star Fire Equipment, Inc.; and Authorizing City Manager to Sign and
Execute Donation Agreement of Training Materials and Equipment
BACKGROUND
On March 9, 2022, the City of Moorpark received a Notice of Award of Reimbursement
Grant Funding from the California Department of Housing and Community Development
(HCD) in the amount of $41,263. This funding is for an outreach and educational
campaign for residents of the cities of Moorpark, Simi Valley, and Thousand Oaks.
The City of Moorpark is the designated Fiscal Agent of the Grant. Representatives of the
three cities are coordinating with the Ventura County Fire Protection District (VCFPD) to
ensure the development and distribution of Community Emergency Response Team
(CERT) training materials and equipment of this grant complement existing and planned
community emergency response training and management initiatives.
The VCFPD collaborates with the cities of Moorpark, Simi Valley, and Thousand Oaks
and other cities and organizations to plan CERT trainings. Local emergency service
personnel coordinate the CERT program. Team coordinators are responsible for
recruitment, scheduling new and recurring activities, and making decisions about
mobilization and staging.
DISCUSSION
Staff obtained a quote for two (2) Lion Model Training Systems and two (2) six-gallon Lion
Model Air Compressors, including accessories, utilizing cooperative contract pricing
through Sourcewell, in accordance with the City’s purchasing ordinance. Sourcewell
Contract #0104240-LIO will be utilized for the purchase. The Lion Model Training System
is an innovative tool designed for fire extinguisher training. It allows trainers to simulate

various fire scenarios, including Class A (trash can), Class B (stove top), and Class C
(electric motor) fires, using customizable ad-on props. The compact design enables quick
setup by a single person, and the handheld controller allows for easy ignition of flames,
maximizing training efficiency. Additionally, the system uses rechargeable air/water
Smart Extinguishers, eliminating the mess and hazards associated with traditional
extinguishers, making training safer and more environmentally friendly.
Upon receipt of the training materials and equipment, they will be donated to the VCFPD
to educate and train volunteers in basic emergency and disaster response skills, including
fire safety and hands-on practice with fire extinguishers and suppression techniques.
Authorization is requested to procure the Lion Training System, air compressors and
accessories in the amount of $25,446.36, along with authorizing the City Manager to sign
and execute agreement to donate the training materials and equipment to the VCFPD,
and adoption of Resolution to amend the FY 2024/25 budget.
ENVIRONMENTAL DETERMINATION
This action is exempt from the California Environmental Quality Act (CEQA) as it does
not constitute a project, as defined by Section 15378 of the State CEQA Guidelines.
Therefore, no further environmental review is required.
FISCAL IMPACT
Appropriate $26,806.79 to Expenditure Account No. 1000-212-G0031-52000 offset by
grant reimbursement to Revenue Account No. 1000-000-G0031-46350.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.
STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED)
1. Authorize the City Manager to purchase materials and equipment from All Star Fire
Equipment, Inc. in the amount of $25,446.36; and
2. Authorize the City Manager to sign and execute donation agreement; and
3. Adopt Resolution No. 2025-____, amending Fiscal Year 2024/25 Budget by total
appropriation of $26,806.79, including a revenue appropriation of $26,806.79 and
expenditure appropriation of $26,806.79, from the General Fund unassigned fund
balance to the emergency management operations fund for the purchase of
Community Emergency Response Team training materials and equipment.

AGREEMENT FOR ASSUMPTION OF RISK AND RELEASE OF LIABILITY FOR THE
DONATION OF CERTAIN COMMUNITY EMERGENCY RESPONSE TRAINING
MATERIALS AND EQUIPMENT BY THE CITY OF MOORPARK TO THE VENTURA
COUNTY FIRE PROTECTION DISTRICT
This donation agreement (“Agreement”) is entered by and between the City of Moorpark,
a municipal corporation (“City”), and the Ventura County Fire Protection District, a
California fire protection district (“District”), as of _______________, 2025.
WHEREAS, City desires to donate certain training materials and equipment to District;
and
WHEREAS, District acknowledges that proper use of the donated materials and
equipment requires maintenance and extensive training; and
WHEREAS, District is responsible for obtaining any necessary maintenance and training
in order to use the donated materials and equipment; and
WHEREAS, District is solely responsible for proper operation of the donated materials
and equipment.
NOW, THEREFORE, City and District agree as follows:
1.RECEIPT OF EQUIPMENT.
District hereby acknowledges receipt of the donated materials and
equipment, all as described in Exhibit “A” attached hereto and incorporated by
reference herein (“Donated Materials and Equipment”.)
2.NO WARRANTIES.
District acknowledges that, upon the effective date of this Agreement, City
conveys all rights and interest in and to the Donated Materials and Equipment to
District “AS-IS”, without any representation whatsoever as to their quality, safety,
or suitability for District’s use, and without warranties of any kind, either express or
implied, including, but not limited to, the implied warranty of merchantability or
fitness for particular purpose. City disclaims and bears no responsibility
whatsoever with respect to design, development, manufacture, or District’s
handling, use, or maintenance, of the Donated Materials and Equipment.
3.ASSUMPTION OF RISK
District understands and agrees that handling, use and/or maintenance of
the Donated Materials and Equipment may result in serious or fatal injuries.
Nevertheless, by accepting possession and ownership of the Donated Materials

and Equipment, and being fully aware of the foregoing risks, District hereby
expressly assumes all such risks.
4. WAIVER OF CLAIMS AND RELEASE OF LIABILITY.
In consideration of being given possession and ownership of the Donated
Materials and Equipment, and to the fullest extent permitted by law, District hereby
waives, releases, and discharges in advance, City, its elected officials, officers,
employees, and agents (“City Parties”), with respect to any and all claims and
liabilities for damages including damages for bodily or personal injury, death,
property damage, any and all other damages and losses of any kind, regardless
of legal theory, that may accrue as a result of City’s conveyance to District, and/or
District’s handling, use, or maintenance, of the Donated Materials and Equipment.
In no event shall the City or its officers, employees or agents, be responsible or
liable, and District covenants not to sue, for any direct, indirect, special, incidental,
consequential damages, lost profits, or any other economic or physical loss or
damage to any individual or entity, regardless of legal theory, resulting from City’s
conveyance to District, and/or District’s handling, use, or maintenance, of the
Donated Materials and Equipment. The foregoing limitations on liability apply even
though the City may not have advised District of all possible risks or potential
damages.
5. INDEMNIFICATION.
To the fullest extent permitted by law, District further agrees to defend and
indemnify the City Parties with respect to any and all claims, liabilities and
damages, arising from City’s conveyance to District, and/or District’s handling, use,
or maintenance, of the Donated Materials and Equipment.
6. ACKNOWLEDGEMENT.
District has carefully read all provisions of this Agreement, including the
waiver and release of all claims and liability, and requirement to defend and
indemnify the City Parties. District has inspected, or been given the opportunity to
inspect, the Donated Materials and Equipment prior to accepting possession and
ownership. District understands and agrees that by signing this Agreement, District
is giving up important legal rights.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed the day and year first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING THE FISCAL
YEAR 2024/25 BUDGET BY APPROPRIATING FUNDS
FROM THE GENERAL FUND UNASSIGNED FUND
BALANCE TO THE EMERGENCY MANAGEMENT
OPERATIONS FUND FOR THE PURCHASE OF
COMMUNITY EMERGENCY RESPONSE TEAM TRAINING
MATERIALS AND EQUIPMENT
WHEREAS, the City of Moorpark received a Notice of Award of Grant Funding
from the California Department of Housing and Community Development (HCD) in the
amount of $41,263 on March 9, 2022, to fund an outreach and educational campaign for
the residents of the Cities of Moorpark, Simi Valley, and Thousand Oaks; and
WHEREAS, the City of Moorpark is the designated Fiscal Agent of the grant and
is coordinating with the Ventura County Fire Protection District (VCFPD) and the cities
of Moorpark, Simi Valley, and Thousand Oaks to ensure that the Community
Emergency Response Team (CERT) training materials and equipment purchased with
these funds complement existing and planned community emergency response training
and management initiatives; and
WHEREAS, the VCFPD collaborates with the Cities of Moorpark, Simi Valley,
Thousand Oaks, and other agencies to plan and deliver CERT training, with local
emergency service personnel coordinating and overseeing the program; and
WHEREAS, staff has obtained a quote for the purchase of two (2) Lion Model
Training Systems and two (2) six-gallon Lion Model Air Compressors, including
accessories, through cooperative contract pricing from Sourcewell Contract #0104240-
LIO, in accordance with the City’s purchasing ordinance; and
WHEREAS, the Lion Model Training Systems are innovative tools designed to
enhance fire extinguisher training, providing a safe, efficient, and environmentally
friendly training experience for CERT members; and
WHEREAS, upon receipt of the materials and equipment, they will be donated to
the VCFPD to educate and train volunteers in basic emergency and disaster response
skills, including fire safety and fire extinguisher techniques; and
WHEREAS, authorization is requested to procure the training system, air
compressors, and accessories in the amount of $25,446.36, and to authorize the City
Manager to execute the necessary agreements for the donation of the materials and
equipment to the VCFPD; and
WHEREAS, the adoption of this resolution will amend the Fiscal Year 2024/25
budget to appropriate funds from the General Fund unassigned fund balance to the

emergency management operations fund for the purchase of the aforementioned
training materials and equipment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby amends the Fiscal Year 2024/25 Budget
by appropriating a total of $26,806.79, including a revenue appropriation of $26,806.79
and an expenditure appropriation of $26,806.79, from the General Fund unassigned
fund balance to the Emergency Management Operations Fund for the purchase of
CERT training materials and equipment.
SECTION 2. The City Manager is hereby authorized to purchase the Lion
Model Training Systems, air compressors, and accessories from All Star Fire
Equipment, Inc. in the amount of $25,446.36, utilizing Sourcewell Contract #0104240-
LIO.
SECTION 3. The City Manager is hereby authorized to sign and execute the
necessary agreements to donate the purchased training materials and equipment to the
VCFPD for use in CERT training.
SECTION 4. The City Clerk shall certify to the adoption of the resolution and
shall cause a certified resolution to be filed in the book of original resolutions.
