MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ky Spangler, City Clerk DATE: 02/19/2025 Regular Meeting SUBJECT: Consider Ordinance Amending Section 2.04.020 (Meetings – Place) and Section 2.04.070 (Appointments to Boards and Commissions) of Title 2 (Administration and Personnel) of the Moorpark Municipal Code to Update the Location of Meetings and to Align Appointment Authority to Boards and Commissions with Government Code Section 40605 BACKGROUND The Moorpark Municipal Code (MMC), Title 2 (Administration and Personnel), Chapter 2.04 (City Council) establishes administrative aspects of the City of Moorpark’s governance, including but not limited to the time, place, conduct, and organization of City Council meetings as well as the manner in which appointments are made to City boards and commissions. With the relocation of City Hall and the upcoming completion of the new City Council Chamber, an update to the MMC is required to reflect a new meeting location. Also, a minor update within Chapter 2.04 regarding appointments to boards and commissions was identified and is being recommended in order to align the MMC with state law regarding appointments in general law cities with a directly elected mayor. DISCUSSION In November 2024, Moorpark City Hall relocated from 799 Moorpark Avenue to 323 Science Drive. Although City administrative operations relocated to the new City Hall, additional time was required to complete the procurement, installation, commissioning, and testing of broadcast equipment needed to televise City Council and Commission meetings and therefore meetings have continued to be held at 799 Moorpark Avenue. These efforts are reaching completion, and it is anticipated that meetings in the new City Council Chamber will commence in April 2025. The MMC, Section 2.04.020, identifies 799 Moorpark Avenue as the location of City Council meetings. The attached Ordinance updates the location to 323 Science Drive. Item: 9.E. 137 Honorable City Council 02/19/2025 Regular Meeting Page 2 Additionally, in reviewing Chapter 2.04, a revision to outdated language was identified and is being recommended for revision with this Ordinance. MMC Section 2.04.070 reads as follows, “Unless otherwise specifically provided in this code or by state law, all city board and commission appointments, except for ex officio members where applicable, shall be made by the city council” which has remained unchanged since City incorporation. In November 1988, electors of the City voted to directly elect the mayor and established a two-year mayoral term of office. Government Code Section 40605 reads as follows, “In general law cities where the office of mayor is an elective office pursuant to Article 5 (commencing with Section 34900) of Chapter 7 of Part 1 of Division 2 of Title 4, the mayor, with the approval of the city council, shall make all appointments to boards, commissions, and committees unless otherwise specifically provided by statute.” In order to align the MMC with Government Code Section 40605, a revision to MMC Section 2.04.070 to change “city council” to “mayor” is recommended. ENVIRONMENTAL DETERMINATION This action is exempt from the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION Introduce Ordinance No. ___ for first reading in title only, waive full reading, and place this Ordinance on the agenda for March 5, 2025, for the purposes of providing second reading and adoption of the Ordinance. Attachment: Draft Ordinance No. ___ 138 ATTACHMENT ORDINANCE NO. ___ AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 2.04.020, MEETINGS–PLACE AND CHAPTER 2.04.070– APPOINTMENTS TO BOARDS AND COMMISSIONS; OF CHAPTER 2.04, CITY COUNCIL; OF TITLE 2, ADMINISTRATION AND PERSONNEL; OF THE MOORPARK MUNICIPAL CODE WHEREAS, Moorpark Municipal Code Section 2.040.020 states that regularly scheduled meetings of the City Council shall be held at the Moorpark Community Center at 799 Moorpark Avenue; and WHEREAS, the City of Moorpark City Hall relocated from 799 Moorpark Avenue to 323 Science Drive effective November 4, 2024; and WHEREAS, since the relocation of City Hall, the Moorpark City Council and its appointed legislative bodies have continued to hold their regularly scheduled meetings at 799 Moorpark Avenue pursuant to the Municipal Code; and WHEREAS, the Moorpark City Council and its appointed legislative bodies will begin holding meetings in the City Council Chamber at 323 Science Drive in April 2025; and WHEREAS, further, Municipal Code Section 2.040.070 – Appointments to boards and commissions, requires amendment to align with state law with respect to general law cities with a directly-elected mayor, pursuant to Government Code Section 40605. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. Section 2.04.020, Meetings–Place, of Chapter 2.04 of Title 2 of the Moorpark Municipal Code is hereby amended to read as follows: “The regular meetings of the city council shall be held at Moorpark City Hall, City Council Chamber, located at 323 Science Drive, Moorpark, California.” SECTION 2. Section 2.04.070, Appointments to boards and commissions, of Chapter 2.04 of Title 2 of the Moorpark Municipal Code is hereby amended to read as follows: “Unless otherwise specifically provided in this code or by state law, all city board and commission appointments, except for ex officio members where applicable, shall be made by the mayor, with the approval of the city council.” 139 Ordinance No. ___ Page 2 SECTION 3. If any section, subsection, sentence, clause, phrase, part or portion of this ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 4. This ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a written record of the passage and adoption thereof in the minutes of the proceedings of the City Council at which the same is passed and adopted; and shall publish notice of adoption in the manner required by law.
