MINUTES OF THE PLANNING COMMISSION Moorpark, California August 14, 2024 A Special Meeting of the Planning Commission of the City of Moorpark was held on Wednesday, August 14, 2024, at 7:00 p.m. in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1.CALL TO ORDER: Chair Barrett called the meeting to order at 7:00 p.m. 2.PLEDGE OF ALLEGIANCE: Commissioner Alva led the Pledge of Allegiance. 3.ROLL CALL: Present:Commissioners Alva, Hamalainen, Landis and Chair Barrett. Absent:Commissioner Di Cecco. Staff Present:Doug Spondello, Community Development Director; Sara Durghalli, Assistant Planner; and Jeannine Lugo, Administrative Specialist. 4.PROCLAMATIONS AND COMMENDATIONS: None. 5.PUBLIC COMMENT: None. 6.REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 7.ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY THE COMMISSION: None. 8.PUBLIC HEARINGS: A.Consider Resolution No. PC-2024-709, Approving Conditional Use Permit No. CD-CUP-2024-0022 to Allow the Operation of an 1,858 Square-Foot Item: 10.A. 53 Minutes of the Planning Commission Moorpark, California Page 2 August 14, 2024 Restaurant (Waba Grill) Within an Existing Shopping Center (LA Spring Shopping Center), Located at 555 Los Angeles Avenue; and Making a Determination of Exemption Pursuant to the California Environmental Quality Act in Connection Therewith, on the Application of Navareet Boparai. Staff Recommendation: 1) Open the public hearing, accept public testimony, and close the public hearing; and 2) Adopt Resolution No. PC-2024-709 approving Conditional Use Permit No. CD-CUP-2024-0022 and finding the project exempt from the California Environmental Quality Act (CEQA). (Staff: Sara Durghalli) Assistant Planner Durghalli gave a presentation and staff report. Questions of staff included: 1) the impact of parking; 2) previous businesses at the proposed location; 3) clarification on tenant improvements proposed; 4)the city’s ability to request a parking management plan in the future; 5)clarification on the proposed CUP requiring planning commission approval due to the proximity of residential zoning. Chair Barrett opened the public hearing at 7:09 p.m. Jesus Cienfuegos answered questions on behalf of the applicant. Questions from the commission included whether the owner operates other Waba Grill locations and if they may desire to add exterior patio seating in the future. Chair Barrett closed the public hearing at 7:12 p.m. Commission discussion followed to address concerns about parking and the potential need or parking management plan. MOTION: Commissioner Landis moved, and Commissioner Alva seconded a motion to adopt Resolution No. PC-2024-709 approving Conditional Use Permit No. CD-CUP-2024- 0022 and finding the project exempt from the California Environmental Quality Act (CEQA). The motion carried by roll-call vote 4 – 0, Commissioner Di Cecco absent. B.Consider Resolution No. PC-2024-710, Approving Conditional Use Permit No. CD-CUP-2024-0023, to Allow the Production, Tasting, and Sale of Wine for Off-Site Consumption Within a 980 Square-Foot Tenant Space in an Existing Multi-tenant Commercial Building (Dexmoor Center), Located at 111 Poindexter Avenue, Suite D, and Making a Determination of Exemption Pursuant to the California Environmental Quality Act (CEQA) in Connection Therewith, on the Application of Peter Clausen (Friendly Noise Wines and Ciders). Staff Recommendation: 1) Open the public hearing, accept public testimony, and close the public hearing; and 2) Adopt Resolution No. PC- 2024-710 approving Conditional Use Permit No. CD-CUP-2024-0023 and finding the project Exempt from the California Environmental Quality Act (CEQA). Questions of staff included regulations regarding the proposed use near a school, police department review and conditions, and clarification on staff’s decision to recommend the project given it seemingly aligns with development of High Street corridor. Chair Barrett opened and closed the public hearing at 7:20 p.m. The Commission discussion revisited the project location being near a school, stating that existing winery neighboring the proposed project has not presented any impact to the school since opening. Commissioners also noted the school should be minimally impacted given the proposed hours of operation do not overlap with regular school hours. MOTION: Commissioner Hamalainen moved, and Commissioner Alva seconded a motion to adopt Resolution No. PC-2024-710 approving Conditional Use Permit No. CD-CUP-2024- 0023 and finding the project Exempt from the California Environmental Quality Act (CEQA). The motion carried by roll-call vote 4 – 0, Commissioner Di Cecco absent. 9.PRESENTATION/ACTION/DISCUSSION: None. 10.CONSENT CALENDAR: A.Consider Approval of the Regular Meeting Minutes of May 28, 2024. Staff Recommendation: Approve the minutes. MOTION: Commissioner Landis moved, and Commissioner Hamalainen seconded a motion to approve the Consent Calendar. The motion carried by unanimous voice vote. 11.ADJOURNMENT: MOTION: Commissioner Landis moved, and Commissioner Alva seconded a motion to adjourn the meeting.
